No used car lemons or the like are considered. Other states are a bit more liberal in their interpretation of these laws. New Hampshire is one of them as is New Mexico and North Carolina.&lt;br /&gt;&lt;br /&gt;Other states typically cover new cars, small trucks and vans in their car lemon law. Some are conditional when it comes to recreational vehicles, motorcycles and motor homes. For instance, the state of Illinois covers recreational vehicles under their lemon law but not motorcycles. In New Jersey however, they do cover motorcycles and even motor homes. Ohio covers motorcycles as does Washington.&lt;br /&gt;&lt;br /&gt;Depending on where you live, you will probably want to consult with one or two lemon law attorneys to interpret the law for you. Because some states just mention any motorized mode of transportation that you use for family or personal use that leaves the field wide open to speculation. What is interpreted as a motorized vehicle? Each state will probably have a different answer. Virginia, Wyoming, Oregon, Maine and Minnesota have more general interpretations than most.&lt;br /&gt;&lt;br /&gt;You could be a retiree with a brand new motor home, ready to hit the open roads of the United States. Or you could be a farmer or rancher that used tractors and recreational vehicles like a four-wheeler for farm work. Maybe you are a motorcycle rider trying to save on gas or you ride a moped around your college town. No matter what the circumstance, brush up on the lemon laws your state has or consult with lemon law lawyers if you are having difficulties with your new mode of transportation. A problem is usually considered serious when it threatens the use, value, or safety of the vehicle.&lt;br /&gt;&lt;br /&gt;Some examples of serious problems that would probably be covered include brake failure, transmission problems, and repeated non-starts. The lemon law in most states will not cover thing like funny noises, loose cup holders, and peeling paint - most times that's just fair wear and tear.&lt;br /&gt;&lt;br /&gt;The type or ownership of vehicles is also important when it comes to protection under the lemon law. In some states, leased vehicles are covered as well as wholly owned vehicles. Others exclude automobiles purchased for business purposes or special kinds of vehicles such as RVs and motorcycles. Even used vehicles may be covered if they come with a car warranty.&lt;br /&gt;&lt;br /&gt;Inevitably, some shady car dealers try and write a clause in sales contracts that states that no lemon law claims can be made against the vehicle. These provisions are totally invalid and can be ignored - as long as your vehicle has a car warranty and qualifies under the other automobile lemon law provisions, you will be covered no matter what you originally signed.&lt;br /&gt;&lt;br /&gt;Before any &lt;a href="http://lemonca.blogspot.com"&gt;&lt;span style="font-weight:bold;"&gt;car lemon law&lt;/span&gt;&lt;/a&gt; comes into effect you must give the manufacturer ample opportunity to repair the problem in question. This is usually defined as a specific number of repair attempts (for example, four attempts to repair the same problem) or a certain amount of time when the vehicle is out of action (for example, four weeks). A life-threatening vehicle defect may require only one attempt at repair before falling under the lemon law.&lt;br /&gt;&lt;br /&gt;So What Happens if I Qualify for the Automobile Lemon Law?&lt;br /&gt;&lt;br /&gt;If you believe that you qualify for protection you must file a claim with the manufacturer within a certain period of time. "Mr. Smith", they say, "we couldn't get the car financed and you need to sign a new loan with another bank"&lt;br /&gt;&lt;div class="fullpost"&gt;&lt;br /&gt;or "you need someone to co-sign", or "give us another $1000 and we can do the deal", or "Mr Smith, we need to increase your monthly payment to get this done". The dealer may even have delayed paying off a traded vehicle loan or refused to mail registration papers, all to place additional pressure on the consumer to do as they are instructed or to face dire consequences to their credit.&lt;br /&gt;&lt;br /&gt;Sound familiar? It gets worse.&lt;br /&gt;&lt;br /&gt;If you refuse, the dealer may threaten to repossess the car, tell you that you have no legal entitlement to keep it or even make you wait for hours at the dealership under some excuse, to wear you down. This situation is most common involving consumers with bad credit, since dealers perceive that such people are vulnerable and easy to take advantage of.&lt;br /&gt;&lt;br /&gt;Most consumers assume the dealer is telling the truth and will do whatever the dealer says, resulting in higher payments, additional money being spent over the life of the loan and/or thousands of dollars in increased "hidden" costs. Those who refuse, see their cars repossessed.&lt;br /&gt;&lt;br /&gt;What is happening here? It's a Scam. Dealer Fraud. Unlawful. Illegal. Call it what you will. The industry has given it a name: Spot Delivery, a description which refers to the dealer placing a consumer in a car "on the spot", to get the sale, only to "yo-yo" them back at a later date for additional funds. Played to perfection, a dealer can reap thousands of dollars in unearned fraudulent gain.&lt;br /&gt;&lt;br /&gt;What to know about Spot Delivery: If you signed purchase documents and registration applications and if you obtained insurance for the vehicle, had a new license plate put on the car and/or had your old plate transferred, the car belongs to you.&lt;br /&gt;&lt;br /&gt;Spot Delivery happens to unsuspecting consumers throughout the United States. It is very popular with dealers in Pennsylvania, New Jersey and Delaware. If you find yourself in this situation, the chances are good that you have legal remedies available to right this wrong. Tools to Protect Yourself from Spot Delivery or Dealer Fraud:&lt;br /&gt;&lt;br /&gt;* Remember that if you have signed papers, you own the car, regardless of whether the vehicle has been financed.&lt;br /&gt;* Your credit was good or the dealer would not have delivered the car to you at the price you agreed to pay&lt;br /&gt;* A finance document showing payments, deposit, interest rate and other financial items is a binding contract, giving you specific legal rights.&lt;br /&gt;* You own the car subject to making payments only. The dealer cannot change that once you take possession.&lt;br /&gt;* Keep all copies of your paperwork and anything else associated with the sale (including calendars, photographs, advertisements). If the finance manager asks for your papers at any time for any reason, refuse! Keep these documents in a safe place, not the car.&lt;br /&gt;* If you are called back to the dealership to sign additional papers, either do not go or do so in a different car than the one you bought.&lt;br /&gt;* Have a friend or spouse drive you and witness whatever is being told to you. This will prevent the dealer from taking your car as hostage, an all too common happening.&lt;br /&gt;* If a dispute arises with the dealer over the contract and the dealer demands the car is returned, park it in a garage or remote location until the matter is resolved, to prevent it from being taken against your wishes.&lt;br /&gt;* Put together a complete timeline of everything that happened from the time you thought of purchasing the car until the car was taken away. Try to remember specific names of dealership personnel and any statements that were made to you during conversations with the sales and finance staff.&lt;br /&gt;* Keep track of all monies you had invested into the purchase, including registration, insurance, down payment and trade. People pay more money for their cars than for just about anything other than their homes. For those situations, every state has passed a lemon law, a statute that exists to backup the manufacturer's written warranty that comes with the vehicle. But most people don't know anything about lemon laws and rarely give them a thought until something goes wrong. And once people start to given lemon laws some thought, they often realize that what they thought they knew about them is wrong.&lt;br /&gt;&lt;br /&gt;Here are a few things about lemon laws that are often misunderstood:&lt;br /&gt;&lt;br /&gt;# Used cars are covered under state lemon laws. Generally, this is not true. Most states' lemon laws cover the original owner of a new car only. If you are the second owner of a car, even if it is still under warranty, you may find that your state's lemon law doesn't protect you. There are a few states that cover the car during the duration of the warranty regardless of the number of owners and a few that even have special lemon law for used cars. If in doubt, check with your state's Attorney General's office.&lt;br /&gt;&lt;br /&gt;# If you buy a new car, you may return it for a refund within three days of purchase. Again, generally not true. It may be true if you buy a toaster, but for large purchases such as a car, once you buy it, you own it. For that reason, make sure that you test drive any new vehicle that you are thinking about buying. And not just one like it – drive the exact car you intend to buy. If you are buying a used car, have an independent mechanic check it out before you buy to make sure that it is in good order.&lt;br /&gt;&lt;br /&gt;# The dealer must inform you if the vehicle has been in an accident. Most states do not require this. Furthermore, it's not always possible for a dealer to even know if a vehicle has previously been in an accident. Dealers are, however, generally required to disclose information about any known damage to the vehicle. Don't expect the dealer to be forthcoming with information that he or she may not necessarily want you to know. Be proactive and ask a lot of questions. And again, if it's a used car, be sure to have an independent mechanic look it over before you buy.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-weight:bold;"&gt;&lt;a href="http://lemonca.blogspot.com"&gt;Car Lemon laws&lt;/a&gt;&lt;/span&gt; are there to protect consumers from defects in workmanship and to make sure that the dealer and/or manufacturer will repair any problems that arise during the warranty period. The manufacturer is also held liable if the car sold does not conform to the terms of the written warranty.&lt;br /&gt;&lt;br /&gt;In New York, this covers new and used cars including "demos" under 4 conditions.&lt;br /&gt;&lt;div class="fullpost"&gt;&lt;br /&gt;1. First, the car was covered by the manufacturer's new warranty at the time it was delivered to the owner.&lt;br /&gt;&lt;br /&gt;2. The car was purchased, leased or transferred within the first 18,000 miles or two year from the original date of delivery.&lt;br /&gt;&lt;br /&gt;3. The car should be purchased, leased or transferred in New York and presently registered there.&lt;br /&gt;&lt;br /&gt;4. The vehicle is primarily used for personal purposes. The definition of personal includes using the car to do household errands, drive to and from work. You can however use this for business and still be covered under the lemon law as long as personal use is predominant.&lt;br /&gt;&lt;br /&gt;Just like the state of California, New York allows motor homes to be covered under this law except to other items like the appliances, fixtures, systems and other parts that are residential in nature. Motor vehicles and off road vehicles are not also covered. Leased cars are covered only if the lessee is responsible for the repairs.&lt;br /&gt;&lt;br /&gt;If you suspect that your car is a lemon, you must immediately report this matter to the manufacturer or authorized dealer. Under the law, the notice given to the dealer is considered also a notice to the manufacturer.&lt;br /&gt;&lt;br /&gt;During this time, the dealer has to conduct the necessary repairs. If they refuse to do so, another letter must be written and this time addressed to the manufacturer which must be completed within the next 20 days. If the problem is not repaired after reasonable attempts, the manufacturer or dealer has no choice but to refund the full purchase or offer a comparable replacement unit. The decision is up to the customer.&lt;br /&gt;&lt;br /&gt;If you are getting a refund, this includes the price of the car, title and registration fees as well as any other governmental charges. There may be some deductions if the car has traveled more than 12,000 miles but less than that, there are none. Should the lemon car be leased, the refund is divided between you and the leasing company.&lt;br /&gt;&lt;br /&gt;Those of you who choose to get a comparable replacement car should know that what you get in exchange for the lemon car is usually the same model and year as well as approximately the same mileage as the one being replaced.&lt;br /&gt;&lt;br /&gt;But before a refund or a replacement car is given, you have the choice of participating in an arbitration program or suing the manufacturer and taking this matter to court. If the manufacturer has an arbitration procedure, you have to participate in this first. This law contains a fee-shifting provision, which means that if the consumer prevails, the manufacturer must pay all attorney fees and legal costs on top of what you receive.&lt;br /&gt;&lt;br /&gt;This law defines when a manufacturer has breached its written warranty and what the purchaser is entitled to for such a breach of warranty. Additionally, there are various other lemon laws which can be used to recover money for consumers. This law provides consumers with a powerful and effective way to get rid of a defective vehicle or receive a cash settlement. One cannot only get rid of the lemon or the faulty vehicle, but can also get loan paid off and even get the money back. For example, a car is considered a “lemon” under the California Lemon Law if it has been repaired four times and the defect or problem has not been resolved or fixed within the period of 18 months or 18,000 miles&lt;br /&gt;&lt;div class="fullpost"&gt;&lt;br /&gt;whichever comes first. Using the word “lemon” this way has most likely become increasingly popular due to the many companies and “slightly south of honest” car sales folks selling faulty products. Buying a car is not like buying a hair dryer, since you cannot return it to the store for a refund if you do not like it, or if it has a manufacturing defect.&lt;br /&gt;&lt;br /&gt;Technically, your newly purchased car is only considered a lemon if you have given proper attention to all of its problems, if all efforts to fix these problems have been exhausted, and if the manufacturer has been given the opportunity to try and fix the problem but cannot. If it seems your car is in the repair shop time and time again for the same repair, you may be the owner of a real lemon. If that is the case, you have rights as well as some responsibilities to deploy those rights.&lt;br /&gt;&lt;br /&gt;The descriptive term “lemon” applies equally to a defective or malfunctioning car as to a citrus fruit. Basically, the California Lemon Law holds the manufacturer of a car responsible for the proper and satisfactory functioning of the car while it is under its warranty period. This also assumes that the owner of the car exercised good judgment and care of everything that would logically be expected of the car owner.&lt;br /&gt;&lt;br /&gt;Does the car warranty matter? Of course. The repair is covered under the vehicle warranty or extended warranty, but it's always in the shop. In many states, arbitration is used to solve problems when a car still under warranty turns out to be a lemon. If the vehicle is new, it should come with a warranty that includes a money-back option. This may be something to note to yourself next time you are shopping for a new car, since shopping for the right warranty is just as important as the car and the price you negotiate.&lt;br /&gt;&lt;br /&gt;You must report the defect within a reasonable timeframe, or before the warranty expires. Report it to the dealer and do it in writing, and make sure you save your copy. If it malfunctions while under warranty, the manufacturer is held liable for repairs. Basically, California’s Lemon Law, sometimes also known as Consumer Warranty Law, specifies that the manufacturer carry a high degree of responsibility for sold products.&lt;br /&gt;&lt;br /&gt;Almost every state has passed a lemon law, a statute that exists to backup the manufacturer's written warranty that comes with the vehicle. The degree of liability and responsibility varies widely from state to state, so make sure you know what the lemon law is in your state.&lt;br /&gt;&lt;br /&gt;The bottom line is that you as the purchaser of the vehicle have responsibilities for proper maintenance of the vehicle, which hopefully you would do anyway. When the ruling is made in favor of the customer, you can choose whether to get a refund or have this replaced.
