Subject: Payment of Dearness Allowance to central Government employees – Revised rates effective from 1.7.2011.

The undersigned is directed to refer to this Ministry’s Office Memorandum No. 1 (2)/2011-E-II(B) dated 24th March,2011 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 51% to 58% with effect from 1st July, 2011.

The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No. 1 (3)/2008-E-II(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.

The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.

These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways,respectively.

In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.

78 Days Bonus to Railway Employees for the year 2010-11 – Cabinet Decision

Railway Employees Bonus Order 2010 - 2011

Over 12.60 lakh non-gazetted Railway employees will benefit from a decision by the Union Cabinet today to give the highest ever Productivity Linked Bonus (PLB) equivalent to 78 days' wages to them this festival season.

Information and Broadcasting Minister Ambika Soni said the Union Cabinet has accepted the proposal of the Ministry of Railways for payment of PLB equivalent to 78 days' wages for 2010-11 for all eligible non-gazetted Railway employees.

The decision is likely to benefit 12.61 lakh non-gazetted Railway employees, she said.

"The financial implication of payment of 78 days' PLB to railway employees has been estimated at Rs 1,098.58 crore. The wage calculation ceiling prescribed for payment of PLB to the eligible non-gazetted railway employees is Rs 3,500 per month," she told reporters after the Cabinet meeting.

This will be the highest PLB payment ever to be made by the Railways. Payment of PLB to eligible railway employees is made each year before the Dusshera holidays.

"The decision of the Cabinet shall be implemented before the holidays," Soni said.

Last year, the Railways had given 77-day bonus to as many employees. Though there are a total of 13.26 lakh railway employees, 1.26 lakh are not covered under the PLB.

"PLB is based on the productivity indices reflecting the performance of the Railways and its payment is expected to motivate the employees for working towards improving the same in future," Soni said.

Subject: Grant of Non-productivity linked bonus (ad-hoc) bonus to central Government employees for the year 2010-11.

The undersigned is directed to convey the sanction of the President to the grant of Non-Productivity linked bonus (ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2010-11 to the central government employoees in Group ‘C’ and Group ‘D’ and all non-gazetted employees in Group ‘B’, who are not covered by any Productivity linked Bonus Scheme. The calculation ceiling of Rs. 3500/- will remain unchanged . The payment will also be admissible to the Central Police and Para-military Personnell of Armed Forces. The orders will follow the Central Pattern of the emoluments and are not covered by any othe bonus or ex-gratia scheme.

2. The benefit will be admissible subject to the following terms and conditions.

(i) Only those employees who were in service on 31.3.2011 and have rendered at least six months of continous service during the year 2010-11 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continous service during the year from six months to a ful year, the eligibility periodd being taken in terms of number of months of service (rounded off to the nearest number of months).

(ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments / calculation ceiling whichever is lower. To calculate Non-PLB (ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will thereafter be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of Rs. 3500 (where actual aveage emoluements exceed Rs. 3500), Non-PLB (ad-hoc Bonus) for thirty days would work out t Rs 3500*30/30.4 Rs. 3453.95 (rounded off to Rs. 3454/-)

Dearness Allowance (DA) Hiked by 7% – Cabinet Decision

DA Hike for July 2011

Central government has hiked the dearness allowance (DA) by a minimum of 7 per cent, benefiting over 50 lakh central government employees and 38 lakh pensioners.

The hike will be applicable from July 1, 2011.

Dearness allowance is revised twice a year, on January 1 and July 1. The relief comes on the back of high retail prices, as inflation has constantly been above the 9 per cent mark.

Headline inflation, based on movement in wholesale prices, was 9.78 per cent in August, much above the comfort level of 5-6 per cent. Food inflation, too, was close to 9.5 per cent for the week ending September 03.

Now the Current DA rate is 58%.

Release of additional installment of Dearness Allowance to Central Government employees and Dearness Relief to pensioners.

The Union Cabinet today approved release of additional installment of Dearness Allowance to Central Government employees and Dearness Relief to pensioners as due from 01.07.2011 at the rate of 7 per cent over the existing rate of 51 per cent.

The total financial implications on account of both Dearness Allowance and Dearness Relief would be Rs.7228.76 crore per annum and Rs.4819.22 crore in the current financial year.

Study Leave for Fellowships offered by reputed Institutes – DoPT Latest

DoPT Circular regarding Study Leave for Fellowships

The feasibility of bringing more Fellowships under the purview of Study Leave, on the same terms and conditions as the Jawaharlal Nehru Memorial Fellowships (.INMF) has been under consideration of' this Department for some time. On the basis of the inputs from various Departments/Ministries regarding fellowships offered by reputed institutions and in consultation with Department of Expenditure, it has been decided to include the Fellowships offered by

(i) K.K. Birla Foundation,
(ii) Indian Institutes of Management,

(iii) Management Development Institute. Gurgaon and

(iv) Fok Nayak Jayaprakash Narayan National Institute of Criminology Sc. Forensic Science on the same terms as that of the fellowship offered by JNMF at present. The following terms will be offered to Central Government employees who are awarded the said fellowship in relaxation of Rule 51, 57 and 59 of Central Civil Services (Leave) Rules, 1972 :-

i) They will be granted study leave for the entire period of the Fellowship;

ii) They will be entitled to the benefits admissible to them in accordance with the Fellowship and in addition, entitled to draw leave salary only (without allowance) equal to the pay that they drew while on duty with the Government immediately before proceeding on such leave. However, they will be entitled to Dearness Allowance at the Central Government rates on the leave salary admissible to them;

ii) Where considered necessary, the official may be allowed during the
period of the Fellowship, the continued use of the facility of the residential telephone officially allotted to him, subject to payment by him of the bills for the rental and call charges of the telephone. 2. So far as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are being issued after consultation with the C&AG of India.

1.5 Lakhs post offices to Postal banks.

Telecom minister Kapil Sibal has an ambitious plan to convert post offices in India into banks and offer its services at low rates especially to the rural areas. This comes in the wake of the post offices fast becoming extinct even in cities with modern forms of communications overtaking the letters and telegrams as well money orders.

The cities are witnessing merger of many post offices and recruitment has long back stopped. To raise revenue the post offices now accept mobile bills of private operators and undertake bulk mail from private players at rates below couriers. Speed Post diversified into Speed Post money orders where instant money is delivered. Sub post offices are wound up and postmen now have to cover more areas but with lesser load.

Old timers say that they have no clue as to who the postman is whereas earlier each household knows the postman a popular figure. He used to turn up on festival days to get his tips. The situation took a turn with mobile phones fanning out and internet connectivity reaching out and the advent of emails putting hand written letters out of fashion.

Postal telegrams have shifted to email delivery to regions with connectivity and post offices in turn deliver it instantly. Postal savings offer the most competitive rates and more tax savings but it is not aggressively marketed since the agents are given low percentage.

Sibal says that even SBI would not able to match the Postal network and now that it has the buildings ready then only the other facilities has to be in place. With not much money spent on infrastructure the bank can offer services at rates much cheaper than nationalized banks.

Separately the revised eligibility conditions for SAG & HAG level for members of Organized Group A Services have been issued in this Department OMS dated 15.12.09 (Non-Technical) and 18.01.201 1 (Engineering Services). The provisions with regard to grant of functional scale of Rs. 14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in OM dated 29.12.2010 also refers. Instructions for grant of NFU as per 6'h CPC recommendations have been issued in OM dated 24.4.09

2. As the Recruitment Rules/Service Rules are required to be amended after incorporating the above instructions, all the ministries / Departments / Cadre Controlling Authorities of Organized Group 'A' Services may take immediate necessary action for notification of Service Rules positively by 31.3.2012 in consultation with DOPTIUPSC 8 Ministry of Law.

Children Education allowance Clarification:

The undersigned is directed to refer to DOP&T O.M. No. 1201 1 /03/2008- Estt(Al1owance) dated 02-09-2008 and clarificatory OM No.12011/16/2009- Estt.(AL) dated 13.1 1.2009 on the Children Education Allowance(CEA) Scheme, this Department has been receiving references from various Departments seeking firther clarifications. The doubts raised are clarified as under:-

Q1. Whether children education allowance would be admissible beyond two children due to failure of sterilization operation ?

Ans1: The reimbursement of children education allowance is admissible only for the first child born after failure of sterilization operation.

Q2: Whether the admissible amount per annum per child (annual ceiling of Rs 15000/-) on account of CEA can be reimbursed in full in the first quarter of the financial / academic year itself ?

Ans2: It is clarified that a government servant is allowed to get 50% of the total amount subject to the overall annual ceiling in the first quarter and the remaining amount in the third and or fourth quarter. Frontloading of the entire amount in the first and the second quarter is not allowed.
(ii) A government servant can claim full amount subject to the annual ceiling of Rs 15000/- in the last quarter.

5.1 For offices in Delhi / New Delhi, any change in the date of holidays in
respect of Idul Fitr, Idul Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi.

5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idul Fitr, Idul Zuha, Muharram and Id-e-Milad.

5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through T.V. / A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.

6. During 2012, Diwali (Deepavali) falls on Tuesday, November 13, 2012
(Kartika 22). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on "Narakachaturdasi Day". In view of this, there is no objection if holiday on account of Deepavali is observed on "Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices,in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government.

7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi's birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2012. subject to para 3.2 above.

8. Union Territory Administrations shall decide the list of holidays in terms of Ministry of Home Affairs letter No.14046/27/83- GP-I dated 15.2.1984 by which they would observe a total of 16 holidays including the three National Holidays Vi. Republic Day, Indep-e ndence Day & Mahatma Gandhi's birthday. –.

9. In respect of Indian Missions abroad, the number of holidays may be
notified in accordance with the instructions contained in this Department's O.M. No.12/5/2002-JCA dated 17th December, 2002. In other words, they will have the option to select 10!Ten) holidays of their own only after including in the iist, three National Holidays md Milad-un-Nabi or Id-E-Milad, Buddha Purnima, Idul Zuha (Bakrid) and Muharrarn included in the hst of compulsory holidays and falling on days of weekly off.

10. In respect of Banks, the holidays shall be regulated in terms of the extant instructions issued by the Department of Financial Services, Ministry of Finance.

Subject:- Harmonization of fee payable under the Right to lnformation Act. 2005.

Sir,

Sections 27 and 28 of the Right to lnformation Act, 2005 empower the appropriate Governments and the Competent Authorities to make rules to prescribe,inter-alia, the fees payable under the Act. In exercise of the powers. the Central Government, State Governments, High Courts etc. have notified rules. It has been observed that the fee prescribed by different appropriate Governments/Competent Authorities is at great variance.

2. The 2nd Administrative Reforms Commission has, in this regard recommended that the States should frame Rules regarding application fee in harmony with the Central Rules and ensure that the fee should not become a disincentive for using the right to information.

3. All the States/Competent Authorities are, therefore, requested to kindly review their Fee Rules and to prescribe fee in consonance with the fee prescribed by the Government of lndia. A copy of the Right to lnformation (Regulation of Fee and Cost) Rules, 2005 notified by the Government of lndia is enclosed for ready reference.

4. Kindly inform us of the action taken in this regard.

Office Memorandum

Subject : Encashment of Leave to be granted to Government Servants on
their appointment in Central Public Enterprises

The undersigned is directed to state that this Department has been receiving references from various Ministries / Departments seeking clarification regarding the entitlement to leave encashment on appointment of Government Servants in Central Public Enterprises.

2. As per DoPT OM No. 2801615/85-Estt.(C) dated 3 1/1/1986, appointment of an officer in a Central Public Enterprise after acceptance of his technical resignation from Government is treated as immediate
absorption. As per the terms and conditions contained in this OM, a Central Government Servant taking appointment in the Central Public Enterprises on Immediate Absorption basis was entitled to encashment of Earned Leave to his credit at the time of acceptance of his resignation from Government Service, subject to a limit of 180 days. Half Pay Leave stood forfeited. (The limit of Earned Leave which could be thus encashed was later raised to 300 days).

3. It is clarified that as per rule 39-D of the CCS (Leave) Rules, 1972, the calculation of leave encashment in case of permanent absorption in Public Sector Undertaking / Autonomous Body wholly or substantially owned or controlled by the Central / State Government will be as per mlc 39(2)(b) which has been amended vide Notification GSR 170 dated 1/12/2009 to read as under:-

The cash equivalent of leave salary under Clause (a) shall be calculated as follows and shall be payable in one lump sum as a onetime settlement

(i) Cash Equivalent for Earned Leave	-	Pay admissible on the date of retirement plus Dearness Allowance admissible on that date / 30	*	Number of days of unutilized earned leave at credit subject to the total of earned leave and half Pay leave at credit not exceeding 300 days
Cash payment in lieu of Half Pay Leave component	-	Half pay leave salary admissible on the date of retirement plus Dearness allowance admissible on that date / 30	*	Number of days of Half Pay Leave at credit subject to the total of Earned leave and Half Pay leave at credit not exceeding 300 days

No commutation of Half Pay Leave shall be permissible to make up the
shortfall in Earned Leave.

4. All Ministries / Departments may note for further action accordingly.

Subject: Conclusion of Special Recruitment Drive launched for filling up the backlog reserved vacancies of Persons with Disabilities.

The undersigned is directed to refer to this Department's OM of even
number dated 27.1 1.2009 whereby a Special Recruitment Drive for filling up the backlog reserved vacancies of SCs, STs and OBCs was launched. It was stipulated that all the backlog vacancies existing in the Ministries / Departments and its Attached Offices / Subordinate Offices / Public Sector Undertakings / Autonomous Bodies etc. as on 1 5.1 1.2009 shall be filled up by 15.7.2010. It could, however, not happen. The Drive was, therefore, extended upto 3oth June 201 1 vide OM of even no. dated 04.0 1.20 1 1 and all the Ministries / departments were requested to make concerted efforts to fill up the backlog reserved vacancies which had remained unfilled till then during the extended period of the Drive.

2. In view of the fact that the drive would conclude on 30.06.2011, it is requested that earnest efforts be made to fill up all the identified backlog vacancies by the said date.

3. All Ministries / Departments are requested to submit the progress of the drive to this Department, in preformed already prescribed earlier, in respect of the Ministry / Department and all its attached subordinate offices and autonomouslpublic sector undertakings by 20.07.2011.

4. It may be noted that progress of the drive is to be submitted to the
Cabinet immediately on completion of the drive and as such it would be important that complete and up to date information is sent to this Department by the above date so that correct progress may be reported to the Cabinet, for which Ministry / Department would be responsible.
