Dearness Allowance order</category><category>da july 2011</category><category>finmin</category><category>DA order 2011</category><author>noreply@blogger.com (bINu)</author><pubDate>Wed, 05 Oct 2011 02:26:09 PDT</pubDate><guid isPermaLink="false">tag:blogger.com,1999:blog-7940496935892628788.post-8884955234600109299</guid><description>&lt;h3&gt;&lt;u&gt;Payment of Dearness Allowance to central Government employees – Revised rates effective from 1.7.2011.&lt;/u&gt;&lt;/h3&gt;  &lt;p&gt;&amp;#160;&lt;/p&gt;  &lt;p align="center"&gt;NO. 1(14)/2011-E-II(B)&lt;/p&gt;  &lt;p align="center"&gt;Government of India&lt;/p&gt;  &lt;p align="center"&gt;Ministry of Finance&lt;/p&gt;  &lt;p align="center"&gt;Department of Expenditure&lt;/p&gt;  &lt;p&gt;&amp;#160;&lt;/p&gt;  &lt;p align="right"&gt;New Delhi, the 3rd October, 2011.&lt;/p&gt;  &lt;p align="right"&gt;&amp;#160;&lt;/p&gt;  &lt;p align="center"&gt;&lt;strong&gt;&lt;u&gt;Office Memorandum&lt;/u&gt;&lt;/strong&gt;&lt;/p&gt;  &lt;p align="center"&gt;&lt;strong&gt;&lt;u&gt;&lt;/u&gt;&lt;/strong&gt;&lt;/p&gt;  &lt;p align="left"&gt;&lt;strong&gt;Subject: &lt;u&gt;Payment of Dearness Allowance to central Government employees – Revised rates effective from 1.7.2011.&lt;/u&gt;&lt;/strong&gt;&lt;/p&gt;  &lt;p align="left"&gt;&lt;strong&gt;&lt;u&gt;&lt;/u&gt;&lt;/strong&gt;&lt;/p&gt;  &lt;p align="justify"&gt;The undersigned is directed to refer to this Ministry’s Office Memorandum No. 1 (2)/2011-E-II(B) dated 24th March,2011 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 51% to 58% with effect from 1st July, 2011.&lt;/p&gt;  &lt;p&gt;   &lt;br /&gt;The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No. 1 (3)/2008-E-II(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.&lt;/p&gt;  &lt;p&gt;&amp;#160;&lt;/p&gt;  &lt;p align="justify"&gt;The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;&lt;/p&gt;  &lt;p align="justify"&gt;These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways,respectively.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;In so far as the persons serving in the Indian Audit and Accounts Department are concerned, these orders issue after consultation with the Comptroller and Auditor General of India.&lt;/p&gt;  &lt;p&gt;&amp;#160;&lt;/p&gt;  &lt;p align="right"&gt;&amp;#160;&lt;/p&gt;  &lt;p align="right"&gt;sd/-&lt;/p&gt;  &lt;p align="right"&gt;(Anil. The wage calculation ceiling prescribed for payment of PLB to the eligible non-gazetted railway employees is Rs 3,500 per month,&amp;quot; she told reporters after the Cabinet meeting. &lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;This will be the highest PLB payment ever to be made by the Railways. Payment of PLB to eligible railway employees is made each year before the Dusshera holidays. &lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;&amp;quot;The decision of the Cabinet shall be implemented before the holidays,&amp;quot; Soni said. &lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;Last year, the Railways had given 77-day bonus to as many employees. The calculation ceiling of Rs. 3500/- will remain unchanged . The payment will also be admissible to the Central Police and Para-military Personnell of Armed Forces. The orders will follow the Central Pattern of the emoluments and are not covered by any othe bonus or ex-gratia scheme. &lt;/p&gt;  &lt;p align="justify"&gt;&amp;#160;&lt;/p&gt;  &lt;p align="left"&gt;2. The benefit will be admissible subject to the following terms and conditions. &lt;/p&gt;  &lt;p align="justify"&gt;&amp;#160;&amp;#160;&amp;#160; (i) Only those employees who were in service on 31.3.2011 and have rendered at least six months of continous service during the year 2010-11 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continous service during the year from six months to a ful year, the eligibility periodd being taken in terms of number of months of service (rounded off to the nearest number of months).&lt;/p&gt;  &lt;p align="justify"&gt;&amp;#160;&amp;#160; (ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments / calculation ceiling whichever is lower. To calculate Non-PLB (ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will thereafter be multiplied by the number of days of bonus granted. The relief comes on the back of high retail prices, as inflation has constantly been above the 9 per cent mark.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;Headline inflation, based on movement in wholesale prices, was 9.78 per cent in August, much above the comfort level of 5-6 per cent. The following terms will be offered to Central Government employees who are awarded the said fellowship in relaxation of Rule 51, 57 and 59 of Central Civil Services (Leave) Rules, 1972 :-&lt;/p&gt;  &lt;p&gt;   &lt;br /&gt;i) They will be granted study leave for the entire period of the Fellowship;&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;ii) They will be entitled to the benefits admissible to them in accordance with the Fellowship and in addition, entitled to draw leave salary only (without allowance) equal to the pay that they drew while on duty with the Government immediately before proceeding on such leave. Separately the revised eligibility conditions for SAG &amp;amp; HAG level for members of Organized Group A Services have been issued in this Department OMS dated 15.12.09 (Non-Technical) and 18.01.201 1 (Engineering Services). The provisions with regard to grant of functional scale of Rs. 14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in OM dated 29.12.2010 also refers. Instructions for grant of NFU as per 6'h CPC recommendations have been issued in OM dated 24.4.09    &lt;br /&gt;&lt;/p&gt;  &lt;p&gt;2. The undersigned is directed to refer to DOP&amp;amp;T O.M. No. 1201 1 /03/2008- Estt(Al1owance) dated 02-09-2008 and clarificatory OM No.12011/16/2009- Estt.(AL) dated 13.1 1.2009 on the Children Education Allowance(CEA) Scheme, this Department has been receiving references from various Departments seeking firther clarifications. The doubts raised are clarified as under:-&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;br /&gt;
&lt;b&gt;Q1.&lt;/b&gt; Whether children education allowance would be admissible beyond two children due to failure of&amp;nbsp; sterilization operation ?&lt;br /&gt;
&lt;br /&gt;
Ans1: The reimbursement of children education allowance is admissible only for the first child born after failure of sterilization operation.&lt;br /&gt;
&lt;br /&gt;
&lt;b&gt;Q2: &lt;/b&gt;Whether the admissible amount per annum per child (annual ceiling of Rs 15000/-) on account of CEA can be reimbursed in full in the first quarter of the financial / academic year itself ?&lt;br /&gt;
&lt;br /&gt;
&lt;b&gt;Ans2:&lt;/b&gt; It is clarified that a government servant is allowed to get 50% of the total amount subject to the overall annual ceiling in the first quarter and the remaining amount in the third and or fourth quarter. Frontloading of the entire amount in the first and the second quarter is not allowed.&lt;br /&gt;
(ii) A government servant can claim full amount subject to the annual ceiling of Rs 15000/- in the last quarter.&lt;br /&gt;

In addition to the above 14 Compulsory holidays mentioned in para 2, three holidays shall be decided from the list indicated below by the Central Government Employees Welfare Coordination Committee in the State Capitals, if necessary, in consultation with Coordination Committees at other places in the State. The final list applicable uniformly to all Central Government offices within the concerned State shall be notified after seeking prior approval of this Ministry and no change can be carried out thereafter. It is also clarified that no change is permissible in regard to festivals and dates as indicated.&lt;/p&gt;  &lt;p align="justify"&gt;&amp;#160;&lt;/p&gt;  &lt;p align="justify"&gt;1. AN ADDITIONAL DAY FOR DUSSEHRA   &lt;br /&gt;2. HOLI    &lt;br /&gt;3. JANAMASHTAW (VAISHNAVI)    &lt;br /&gt;4. RAM NAVAMI    &lt;br /&gt;5. MAHA SHIVRATRI    &lt;br /&gt;6. GANESH CHATURTHI / VINAYAK CHATURTHI    &lt;br /&gt;7. MAKAR SANKARANTI    &lt;br /&gt;8. RATH YATRA    &lt;br /&gt;9. ONAM - PONGAL    &lt;br /&gt;11. SRI PANCHAMI / BASANTA PANCHAMI la. VISHU/ VAISAKHI / VAISAKHADI / BHAG BIHU / MASHADI UCZADI / CHAITRA SAKLADI / CHETI CHAND / GUDI PADA 1m NAVRATRA /    &lt;br /&gt;NAURAJ/CHHATH POOJA/KARVA CHAUTH.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;3.2 No substitute holiday should be allowed if any of the festival holidays initiallly declared subsequently happens to fall on a weekly off or any other nonworking by or in the event of more than one festivals falling on the same day.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;4. The list of Restricted Holidays appended to this O.M. is meant for Central&amp;#160; Government Offices located in Delhi / New Delhi. The Coordination Committees&amp;#160; at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted    &lt;br /&gt;holidays.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;5.1 For offices in Delhi / New Delhi, any change in the date of holidays in    &lt;br /&gt;respect of Idul Fitr, Idul Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public&amp;#160; Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;5.2 For offices outside Delhi / New Delhi, the Central Government Employees&amp;#160; Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idul Fitr, Idul Zuha, Muharram and Id-e-Milad.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through T.V. / A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;6. During 2012, Diwali (Deepavali) falls on Tuesday, November 13, 2012    &lt;br /&gt;(Kartika 22). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on &amp;quot;Narakachaturdasi Day&amp;quot;. In view of this, there is no objection if holiday on account of Deepavali is observed on &amp;quot;Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices,in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi's birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2012. subject to para 3.2 above.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;8. Union Territory Administrations shall decide the list of holidays in terms of Ministry of Home Affairs letter No.14046/27/83- GP-I dated 15.2.1984 by which&amp;#160; they would observe a total of 16 holidays including the three National Holidays Vi. Republic Day, Indep-e ndence Day &amp;amp; Mahatma Gandhi's birthday. –.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;9. In respect of Indian Missions abroad, the number of holidays may be    &lt;br /&gt;notified in accordance with the instructions contained in this Department's O.M. No.12/5/2002-JCA dated 17th December, 2002. In other words, they will have the&amp;#160; option to select 10!Ten) holidays of their own only after including in the iist, three&amp;#160; National Holidays md Milad-un-Nabi or Id-E-Milad, Buddha Purnima, Idul Zuha (Bakrid) and Muharrarn included in the hst of compulsory holidays and falling on days of weekly off.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;10. In respect of Banks, the holidays shall be regulated in terms of the extant instructions issued by the Department of Financial Services, Ministry of Finance.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;11. The Registrar of the Supreme Court&lt;/p&gt;  &lt;p align="left"&gt;   &lt;br /&gt;Subject:- Harmonization of fee payable under the Right to lnformation Act. 2005.    &lt;br /&gt;    &lt;br /&gt;Sir, &lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;Sections 27 and 28 of the Right to lnformation Act, 2005 empower the appropriate Governments and the Competent Authorities to make rules to prescribe,inter-alia, the fees payable under the Act. In exercise of the powers. the Central Government, State Governments, High Courts etc. have notified rules. It has been observed that the fee prescribed by different appropriate Governments/Competent Authorities is at great variance.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;2. The 2nd Administrative Reforms Commission has, in this regard recommended that the States should frame Rules regarding application fee in harmony with the Central Rules and ensure that the fee should not become a disincentive for using the right to information.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;3. All the States/Competent Authorities are, therefore, requested to kindly review their Fee Rules and to prescribe fee in consonance with the fee prescribed by the Government of lndia. A copy of the Right to lnformation (Regulation of Fee and Cost) Rules, 2005 notified by the Government of lndia is enclosed for ready reference.&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;4. As per DoPT OM No. 2801615/85-Estt.(C) dated 3 1/1/1986, appointment of an officer in a Central Public Enterprise after acceptance of his technical resignation from Government is treated as immediate    &lt;br /&gt;absorption. As per the terms and conditions contained in this OM, a Central Government Servant taking appointment in the Central Public Enterprises on Immediate Absorption basis was entitled to encashment of Earned Leave to his credit at the time of acceptance of his resignation from Government Service, subject to a limit of 180 days. Half Pay Leave stood forfeited. (The limit of Earned Leave which could be thus encashed was later raised to 300 days).&lt;/p&gt;  &lt;p align="justify"&gt;   &lt;br /&gt;3. It&amp;#160; was stipulated that all the backlog vacancies existing in the Ministries / Departments and its Attached Offices / Subordinate Offices / Public Sector Undertakings / Autonomous Bodies etc. as on 1 5.1 1.2009 shall be filled up by 15.7.2010. It could, however, not happen. The Drive was, therefore, extended upto 3oth June 201 1 vide OM of even no. dated 04.0 1.20 1 1 and all the Ministries / departments were requested to make concerted efforts to fill up the backlog reserved vacancies which had remained unfilled till then during the extended period of the Drive.&lt;/p&gt;  &lt;p align="justify"&gt;&amp;#160;&lt;/p&gt;  &lt;p align="justify"&gt;2. In view of the fact that the drive would conclude on 30.06.2011, it is requested that earnest efforts be made to fill up all the identified backlog vacancies by the said date.&lt;/p&gt;  &lt;p align="justify"&gt;&amp;#160;&lt;/p&gt;  &lt;p align="justify"&gt;3. All Ministries / Departments are requested to submit the progress of the drive to this Department, in preformed already prescribed earlier, in respect of the Ministry / Department and all its attached subordinate offices and autonomouslpublic sector undertakings by 20.07.2011.&lt;/p&gt;  &lt;p align="justify"&gt;&amp;#160;&lt;/p&gt;  &lt;p align="justify"&gt;4.
