Drivers may be given hefty fines of up to £1,000 if they do not renew their photo-card licence. Photo-card licences were put in place 15 years ago and over 30million drivers now have one. These are usually valid for 10 years and there is a legal requirement for drivers to renew the photograph at the same time as they renew their licence. If a driver is pulled over by police with an invalid driving licence, they could receive a fine of up to £1,000.

Ex-Rover's Star Guilty of Death by Careless Driving

The ex-footballer Scott Sellars killed a motorcyclist when he fell asleep at the wheel. He was driving home from work after returning from Dubai, where he had been coaching Manchester City's youth team. He pleaded guilty at an earlier hearing and later received a six-month suspended sentence. He also was ordered to do 300 hours of community service at Nottingham Crown Court.

Police Chase Ends in Death of Teenager

A 13-year-old girl was pronounced dead at the scene of a car crash after a police chase. A Peugeot 308 was being pursued by an unmarked police car which had its flashing lights and sirens on. The 308 then crashed into a Volkswagen Polo. The parents of the girl, who were in the polo, went to hospital but had no serious injuries. The driver of the 308 was taken into custody and his passenger was taken to hospital with minor injuries. Devon Mewell aged 32 from Peckham in London has now been taken to court, charged with causing death by dangerous driving, causing serious injury by dangerous driving, failing to stop for police, failing to stop at the scene of an accident and driving with no insurance or licence.

Facebook Points Towards Custody

Scott Woodburn has been jailed after he offered a sum of money to someone via Facebook to take penalty points on his behalf. Daniel Baggaley accepted £250 to take the penalty points, despite not having a licence. The police found out it was Woodburn after forensic evidence showed that he was at the wheel. He was sentenced to 5 months in prison and disqualified from driving for Conspiracy to Pervert the Course of Justice at Sheffield Crown Court.

Welsh Kerb Size Appeal

Christmas Drink Drive Campaign

Young drivers in Wales will be targeted for drink driving, due to the statistics that show the most common age group is between 20 and 24. Police tested 27,744 motorists in Wales as part of last year's campaign, with 545 (2%) testing positive or failing/refusing to take a breath test.

Drink Drivers – Life-Time Ban

The Government are coming down hard on drink drivers, with new ideas for punishment because the number of deaths caused by drink-driving has risen for the first time in years. Carol Whittingham, of the Campaign Against Drink-Driving, said “We would like to see a life-time ban if a person is caught drink-driving twice. They are a danger to the public and should not be allowed behind the wheel.” The Government may also get rid of the right to have blood or urine tests and only use the road side breath test because drivers can sober up just enough to pass the blood or urine tests.

Juggernaut Junkie kills Jogger

A jogger was killed by a banned driver, Mark Heeley, while he was driving a seven-ton lorry. He was a heroin addict, who had been given £50 by a friend to drive the tipper truck. He sped down a country road and mounted the payment and hit the victim with the wing mirror. He sped away but was later caught by the police. He was sentenced to 6 years in prison by Doncaster Crown Court and given a seven year driving ban for death by dangerous and driving while disqualified.

Case study – using a vehicle without insurance

I recently represented Mr M, who was accused of using a motor vehicle without insurance. On conviction, Mr M faced between 6 and 8 penalty points for the offence, together with a financial order.

One additional factor was that Mr M had only obtained his full driving entitlements approximately 12 months ago. In the event that even the minimum 6 penalty points were imposed for using a vehicle without insurance, Mr M faced revocation of his licence under the Newly Qualified Driver provisions.

The nature of Mr M’s special reasons argument was that he had been misled into believing that he was insured to use the vehicle at the time and date in question. Various documents were produced in support of Mr M’s argument and a witness was called to give live evidence at the hearing.

The magistrates found special reasons. The case was disposed of with an absolute discharge. Mr M’s driving licence was returned to him, without endorsement. There was no order for him to contribute towards prosecution costs.

As no penalty points were imposed, Mr M did not have his licence revoked under the Newly Qualified Driver provisions. He was not required to retake his test.

When offered a fixed penalty for an alleged offence, it can often appear that accepting the same is the only option. As demonstrated from the above, it can be very advantageous to seek legal advice from a specialist firm before deciding whether or not to accept a fixed penalty.

Insurance Gets Up to Speed

"Our claims statistics show that drivers who have committed a speeding offence could be a higher risk than drivers who do not commit speeding offences." A young model, Rebecca Caine, was killed by a drink-driver on the M62 when he drove the wrong way down the motorway. Wilfred Museka pleaded guilty and received an 8 year custodial sentence for death by dangerous driving at Manchester Crown Court.

MP Banned from Driving

Jon Cruddas, Labour MP for Dagenham and Rainham in East London, was arrested for no insurance and an expired MOT. He was disqualified from driving for eight weeks, fined £200 and told to pay £85 costs and a £15 surcharge. The MP pleaded guilty at Westminster Magistrates Court. He intimated that he thought he had had a week left to renew. He said it was ‘totally fair’ he was banned.

Halloween and Death by Careless Driving

A teenager driving home the morning after a Halloween party crashed into the back of a lorry, killing one of her friends and seriously injuring the other three. The car burst into flames after the crash. Witnesses and the lorry driver managed to get Eleanor Coleman, the driver, and the three backseat passengers out of the car. Ellie Tweed’s Body was found after the flames were put out. Coleman was jailed for 15 months at Norwich Crown Court. Hit and Run on 4-year-old

A 4-year-old girl was hit by a car and left in a critical condition in hospital. The girl was hit by a car at 6:30p.m. on Tuesday 23^rd October 2012 in College Road, Kingstanding, where she had been walking with her mother when they became separated. The driver handed himself in to Birmingham police station at 11:30p.m. on the same day, his car has also been seized.

Notting Hill Carnival Stabbings

A fight broke out at the Notting Hill Carnival in North Kensington resulting in three men being stabbed. One of the men is in a critical condition. Another 2,000 police were called to the carnival to keep the peace. A few other revellers were injured during the carnival, such as a 14-year-old who was slashed with a sharp object and a 16-year-old who had a small leg wound. A gang of 34 people did not make it to the carnival due to being stopped at Victoria station for fears of them causing trouble, 15 of them were arrested.

Pill That Stops Breathalyser Detection?

It is reported that businessman Arthur Kibble has developed a pill which can cut alcohol levels by a ninth, by preventing the way in which alcohol normally enters the bloodstream. This could, potentially affect the reading provided in a breathalyser test.

Suspect bailed following alleged dangerous driving and being unfit to drive through drink or drugs

Four people were injured following a road traffic collision on the M23 on Sunday. Officers believe that a Honda Accord and Renault Megane made contact with a Mercedes. The southbound carriageway was closed for approximately eight hours following the crash, which caused tailbacks to junction eight for Reigate on the M25. The suspect has been bailed until 7^th November.

Police outrun by Audi RS5 in 180mph chase

The chase began when officers attempted to apprehend Ben Westwood, who was with others trying to open a cash machine in the West Midlands. Westwood made off in the stolen Audi RS5 ‘getaway car’ and a pursuit ensued. He even began to outpace a helicopter at one point during the chase. Westwood received 9 years’ imprisonment in connection with offences of dangerous driving and conspiracy to burgle and steal. He is thought to be Britain’s fastest getaway driver. Previously, the highest speed recorded was 172mph, by a Porsche 911.

Death by Drunken Drivers

Deaths and Serious Injuries caused by drink driving have risen for the first time in nearly 10 years. There were 280 deaths last year compared to 250 in 2010. Driver Jailed After Admitting Causing Death by Careless Driving Whilst Unfit Through Drugs

17 year old Lara Smith was killed in a car accident, due to a driver falling asleep at the wheel. The Luton Crown Court heard that Matthew Norcott had only slept for up to 5 ½ hours in the previous 47 hours. He was en route to a party in Worcestershire with three passengers, one of which was Miss Smith when his vehicle crashed into a barrier at 83mph. He received seven and a half years imprisonment after admitting offences of causing death by careless driving whilst unfit through drugs, causing death whilst driving uninsured and possession of class A drugs with intent to supply.

Aggravated Vehicle Taking with Devastating Effects

Following a 100mph police chase, two young men crashed a stolen vehicle into that of a young law graduate. After crashing into the back of Jackie Stretton’s Toyota Aygo, her back was broken. She has been told that she will never make a full recovery. Judge Roger Hayward-Smith imposed the maximum sentence of two years for aggravated vehicle taking but the two men received a discount of one third, as they had entered guilty pleas. Both were disqualified from driving for five years. Judge Hayward-Smith expressed dissatisfaction at the fact that the two men would be released from prison and get their lives back, after ruining someone else’s.
