julius Malema’s farm has been nationalised. The Asset Forfeiture Unit seized his Limpopo farm yesterday after he failed to oppose a Pretoria High Court order granted to SARS in December.According to National Prosecuting Authority spokesman Medupe Simasiku, the unit was granted a forfeiture order for the farm on Monday. The registered owner is Gwama Properties, a business of Malema confidant Lesiba Gwangwa.

The NPA alleges that the farm belongs to Malema.

“It is noteworthy that the unit’s application was opposed neither by Mr Gwangwa nor his company, Gwama Properties, nor by Mr Malema, who is alleged to be the real owner,” Simasiku said.

The farm was part of “a money-laundering scheme”, he said.

Granting a freeze order on the farm on December 5, the high court ruled that the farm was bought with funds acquired through theft, fraud and corruption, or that the property had alternatively been used to launder money, Simasiku said.

The SA Revenue Service applied to have the expelled ANC Youth League leader’s assets sequestrated to recoup a R16-million tax debt.

According to SARS’s court application, Malema’s Ratanang Family Trust was to purchase a farm, Schuilkraal, but it was instead purchased by Gwama Properties.

According to the founding affidavit of SARS senior manager for tax and customs enforcement investigations Pieter Engelbrecht, “. the deed of sale was cancelled by the trust and a new deed of sale was entered into, in terms whereof the property was to be purchased for the same purchase consideration by Gwama Properties, the shareholder being Guilder Investments, and which entity is linked to L Gwangwa”.

Engelbrecht said Malema “consented in writing that the monies deposited to the transferring attorneys’ trust account, in lieu of the purchase consideration on behalf of the trust, may be used as payment of the purchase consideration on behalf of Gwama Properties”.

Malema is charged with fraud and racketeering in connection with the allegedly irregular awarding of a R52-million Limpopo roads and transport tender to On-Point Engineers, of which Gwangwa is CEO.

Public Protector Thuli Madonsela found last year that Malema’s Ratanang trust was paid more than R2-million by On-Point Engineers.

It is not known whether Malema will ask the court to be allowed to file his affidavit opposing the sequestration. He had given notice of his intention to do so but missed the deadline.

Mbeki pulled no punches on Tuesday as he spoke on the political and economic state of the country and his concerns over the direction it was taking.

“The ANC is not the future of the country. We should stop obsessing about the ANC. The ANC has ceased to be the future of South Africa if it continues (as it has been),” he told the Cape Town Press Club. “We have to ask ourselves now: who is the future of the country?”

He said there was a steep decline in the calibre of ANC leaders. The emergence of the “song-and-dance brigade, like Zuma and (ANC Youth League president) Julius Malema, who claim to be leaders”, indicated there was a lack of intellectual and visionary leaders but also leaders of sound morals and values.

He dismissed Malema as insignificant and spoke bluntly about Zuma’s reluctance to act on the recommendations of the public protector after investigations into the leases for two police headquarters.

“I don’t really think much of Julius. I don’t think he’s an important factor… Julius likes to compare himself with the (ANC leaders) of the ‘40s… there’s no comparison, absolutely no comparison,” said Mbeki.

“Up to now the ANC has been led by leaders from that time, they don’t have that – now we have the song-and-dance brigade like Zuma and Julius, who claim to be leaders.”

On Sunday, Afrikaner rights group AfriForum laid a charge of corruption against Malema after revelations of a secret trust, of which he is the sole trustee, which allegedly operated as a conduit for cash paid by business people in exchange for help from the ANC Youth League president in securing tenders and push political agendas.

Malema faces multiple probes into his financial dealings, and has to explain himself to the ANC.

Mbeki said that throughout his tenure Zuma had been criticised by commentators, opposition parties and from within the tripartite alliance as being soft on corruption and for his inability to take bold decisions.

“Zuma has neither the will nor the ability to change the situation… The report released by the public protector last week, Zuma hasn’t done anything yet.

“He says he’s studying it, but all of us know what’s in the report,” said Mbeki.

Politicians, he said, would not create competition for themselves and it was up to citizens to jolt them into action by using their vote to punish or reward them.

However, he said, citizens were “happily marching and dancing to the edge of the cliff with no one caring about where we are going”.

“Blatant corruption” was taking place at the ANC’s investment arm, Chancellor House, he said, with reference to the multibillion-rand deal with Hitachi Power Africa, which in 2007 jointly won a contract with its parent body to supply Eskom with boilers for its two new power stations, Kusile and Medupi.

He slammed the ANC’s model of racial preference, including black economic empowerment, as a tool which had been used to benefit an elite group.

“It (racial preference) was a disaster with the National Party and it’s a disaster now,” said Mbeki.

He said South Africans were living off mineral wealth, which was in decline and unsustainable.

Countries such as South Africa – middle-incomers – were the casualties of globalisation, while big players such as the US and poorer countries which had huge populations and markets were the biggest winners.

Old industrial practices and management systems like those of the mining industry, which still had same-sex hostels, were to the detriment of the economy.

The word “farmer” is used in this context as an expletive to refer to whites, or more specifically to Afrikaners. AfriForum Youth has launched a campaign to stop Julius Malema’s inciting statements for once and for all. This campaign will only succeed if YOU participate in it. The campaign will include the following:

• A complaint of hate speech at the Equality Court

A hate speech complaint has been submitted by AfriForum Youth and AfriForum against Malema. Julius Malema is the first respondent and the ANC the second respondent. The ANC has been added as party, because they stated that there is nothing wrong with the words “Shoot the farmers”. In this case, AfriForum Youth and AfriForum demand:

1. That the song “Awudubule (i)bhunu” should be declared to be hate speech;
2. That Julius Malema is ordered to apologise for his conduct;
3. That Julius Malema is ordered to pay a fine and that this money should go to organisations that work with the victims of farm attacks; and
4. That the case is referred to the National Director of Public Prosecutions for the criminal prosecution of Malema.

• Stop Malema petition

A petition has been launched to prove that South Africans do not condone Malema’s actions. The petition will be sent to Malema’s email address. This will also serve as evidence against Malema in court. Petition forms can be downloaded from here and faxed back to AfriForum Youth. In addition R10-00 can be contributed to the campaign by sending the word “STOP” by SMS to 38655 (in other words each SMS is charged at R10-00).

• Protest march to Malema’s office

On Friday, 19 March 2010, at 10:00, AfriForum Youth, AfriForum and members of the public will protest at Julius Malema’s office. Well-known people will attend and a list of the names of more than 1 600 victims of farm attacks will be handed to Malema.

Cape Town – Twitter users have targeted ANC Youth League president Julius Malema by declaring Friday as "Julius Malema Day".

Several new accounts in the name of the youth leader have been opened on the micro-blogging service in defiance of threats by the ANCYL to close the website over fraudulent accounts.

Twitter users have gone further than just creating Malema accounts – they have also started circulating jokes featuring the firebrand leader.
"So wait today is julius malema friday AND international toilet day?!? Bwahahahaha what a brilliant connection!" wrote Twitter user GarethWoods84.

"One day a teacher finds Julius Malema in the library, photocopying blank paper, so she asks him ‘what are u doing Julius?’ He replies, ha maam, ‘I’m making more paper,’" wrote "divantow".

The goal of the "Julius Malema Day" is to illustrate how "amazing" social networking can be, according to the Bangers and Nash website.

Political analysts have warned that it is important for politicians to take social media seriously.
"All political parties are starting to understand the value of social media and some politicians are more active than others," Idasa online communications manager Samantha Fleming told News24.

Fleming said US president Barack Obama’s presidential campaign had generated enormous traction and some South African politicians were starting to take the site more seriously, particularly as more people joined. It also serves the majority of the population who do not have computers.
"Mobile is really huge – it’s not like you need to have an iPhone. Even people with a basic phone can access social media. They aren’t organising and mobilising on Facebook; it’s just chatting to friends, but it’s a small step to get there," she said.

The ANCYL, though, had initially dismissed social networking.
"We don’t follow up on petty issues; it’s not even a story. We have bigger battles to fight and this internet doesn’t even speak to our people," spokesperson Floyd Shivambu told News24 in March.

Since then the party has threatened to shut down the site over the fraudulent accounts, and users have reacted with anger.
"The ANC YL has in more than one occasion reported these impersonators and hackers, yet no action has been taken against them by the twitter administrators. We will now approach the relevant authorities to report these hackers and call for the closer of twitter if its administrators are not able to administer reports for violation of basic human rights and integrity," (sic) it said in a statement.

Despite repeated attempts, the ANCYL was unavailable for comment on Friday.
