March 19 (Bloomberg) — The Federal Reserve Board must disclose documents identifying financial firms that might have collapsed without the largest U.S. government bailout ever, a federal appeals court said.

The U.S. Court of Appeals in Manhattan ruled today that the Fed must release records of the unprecedented $2 trillion U.S. loan program launched primarily after the 2008 collapse of Lehman Brothers Holdings Inc. The ruling upholds a decision of a lower-court judge, who in August ordered that the information be released.

The Fed had argued that disclosure of the documents threatens to stigmatize borrowers and cause them “severe and irreparable competitive injury,” discouraging banks in distress from seeking help. A three-judge panel of the appeals court rejected that argument in a unanimous decision.

The U.S. Freedom of Information Act, or FOIA, “sets forth no basis for the exemption the Board asks us to read into it,” U.S. Circuit Chief Judge Dennis Jacobs wrote in the opinion. “If the Board believes such an exemption would better serve the national interest, it should ask Congress to amend the statute.”

Our recent trip through Baltimore BWI Airport was a disturbing example of the authoritative behavior of TSA agents.

A TSA thug explains to a slave that while the government assumes the authority to look at your naked body, that you have no right to film them doing so.

The airport, likely many others in the U.S., had begun implementing now-notorious Body Scanners months before the Christmas Day Underwear Bomber episode that the powers-that-be have seized upon as a justification for implementing the invasive technology (though it has come out that the alleged terrorist Abdulmutallab never went through security and was allowed onto the plane via intelligence connections without even a passport).

Fellow cameraman Rob Dew and I have already refused to go through TSA scanners at Baltimore back in the fall and were prepared to do so again. However, we were not “randomly” selected to go through them this time. The suspects du jour were middle-aged women with make-up in their purses and well-dressed, but frumpy looking businessmen.

We decided to film people going through the scanners, as well as being wanded and frisked at great inconvenience—with no basis for suspicion and no real justification for their actions.

That’s when a very large and very tall TSA agent came over to intimidate us to tell us we couldn’t film. He began confronting Rob Dew before noticing that I too was filming. I knew they couldn’t violate both of our rights at the same time without losing control. NOTE—TSA & co. take full reign in scanning the genitals and naked bodies of our families and children, patting them down and looking through every item on their person or luggage—but we’re not supposed to film this going on.

It seemed to me like a gaggle of criminals who didn’t want their despicable actions to be under scrutiny. Though the TSA parade as a legitimate government agency, their actions are transparently unconstitutional and they apparently thrive on the element of intimidation. TSA’s unwarranted examination of every passenger would not stand long if The People stood up for themselves, yet the fearful atmosphere keeps heads low and objections under muttered breath.

A randomly-selected “potential terrorist” selected by TSA for secondary screening– a wanding followed by a complimentary rub down.

This is precisely why I felt morally compelled to object to their behavior and resist the easy supplication to their arbitrary power. When the TSA stooge commanded me to stop filming, I reminded him that he was violating the Fourth Amendment and the Constitution—that we have a right to be secure in our persons and possession, and that searches were unconstitutional when they had no basis for probable cause and where no warrant has been issued.

He didn’t want to hear it, uttering a sarcastic “Uh huh” to my lecturing. I told him to his face that is was wrong to scan children’s genitals and wrong to single out middle-aged women with nothing more than too much make up or, in one case I have witnessed in the past, a knitting needle and yarn.

His response to this was to close into my personal space, trying to intimidate me with his towering figure and large beer-belly. He told me that if I kept filming, he was “turn me over to police” and that I “wouldn’t be allowed to fly.” How would I like to have my trip cancelled and be barred from travel, he posed to me, both in words and body language. I’m sure it wasn’t a bluff—more than a million Americans and other travelers have already been put on no fly lists—many for simply having a common name, or even a name similar to a common or suspicious name.

“I have a right to travel,” I told him plainly. He reiterated his threat. I told him he was hurting America. I meant it. He huffed and puffed and walked away, leaving me filming.

The TSA agent gets in face when I tell him how wrong it is to violate the Fourth Amendment, single out ordinary Americans and scan the genitals of our children and families. In turn, he threatens to bar me from flying.

It was entirely clear that few, if any individuals, had ever stood up to the “power” of his uniform which he so plainly flaunted and hid behind. But, as Thomas Paine made clear in the Rights of Man so long ago, that power resides in the uniform, and not in the hollow, petty and largely illiterate body of the willing enforcer.

Like the Nazis and other worst offenders in history, the rights of The People have been stripped away when checkpoints and unauthorized searches were allowed to flourish. When minority groups and eccentric individuals were targeted, and the whole of the people did not stand up against it, that undue power has almost always spread like a contagion and taken over the population at large.

Today, if we’re not already at that point, we’re dangerously close to it. TSA checkpoints are a prime example of it, where nearly everyone fails to stand up to tyranny, silently condoning the unconstitutional behavior, and thus, letting it run wild. The end to that scenario is clear, unless people will reclaim their dignity and refuse to submit to this system.

Already, the check points and body scanners have extended to courthouses and may soon be implemented on subways, trains and other travel points if nothing is done to stand up to the invasion of our basic rights.

A Democratic Congressman has stated that he will refuse to vote yes on the pending health care reform bill, declaring that the legislation represents a vastly bloated giveaway to insurance companies and big pharma.

Rep. Stephen Lynch (D-MA) asserts that the Senate bill bankrolls the very companies that president Obama says are taking advantage of the American people.

“We’ve paid the ransom, but at the end of the day the insurance companies are still holding the hostages,’’ Lynch said in an interview with The Boston Globe yesterday.

“This is a very good bill for insurance companies and pharmaceutical companies. It might be good for Nebraska, I don’t know. Or Florida residents. But it’s not good for the average American, and it’s not good for my district. Or for Massachusetts.’’ Lynch added.

“The insurers still rule,” Lynch said. “Were just pumping subsidies into the current system, but that won’t drive down costs.”

The Congressman says he also opposes the way in which the House Democrats intend to pass the legislation, bypassing a traditional vote and opting for the so called Slaughter rule of “Deem and Pass”.

Lynch, has said that the parliamentary move would be “disingenuous” and would fundamentally harm the credibility of Congress.

He added that the move “may be unconstitutional.”

“It’s a stretch,” Lynch said. “I think it hurts our credibility to try to pull a prank like that. We should stand up and tell voters where we stand.”

As we reported yesterday, president Obama glossed over questions surrounding the process, stating “I don’t spend a lot of time worrying about what the procedural rules are in the House or the Senate.”

Unlike his Democratic colleague from Ohio, Dennis Kucinich, Lynch has stuck to his guns despite a meeting with Obama.

“The president was courteous and generous with his time,” Lynch said. “The president asked me if there was anything he could do that I should tell him, and I told him, ‘I have been over this bill and I still wasn’t satisfied.’ ”

“I continue to be opposed to the bill,” he said.

Kucinich had said he opposed the bill, citing the exact same points as Lynch, however, a 40 minute jaunt on board Airforce One with the president, in addition to veiled threats directed his way by Obama swayed Kucinich to change his mind.

“There doesn’t appear to be any way to put reform into this bill,” Lynch said. “It’s a very poor bill.”

“If they put reform back in the health reform bill, that would change my position,” he told reporters yesterday.

When reminded yesterday of Senator Ted Kennedy’s advice to not let the “perfect be the enemy of the good,’’ Lynch told reporters: “There’s a difference between compromise and surrender, right? And this is a complete surrender of all the things that people thought were important to health care reform.’’

House Speaker Nancy Pelosi and her leadership team, as well as Obama himself are intensely lobbying individual representatives before Sunday’s anticipated vote as they seek to win the 216 votes needed to pass the measure. According to reports, the Democrats are still six votes short.

There are now 5 states, Wyoming, Montana, Tennessee, Utah and South Dakota, that have passed laws for self declared exemptions from federal gun regulations on weapons made, bought and used inside state borders, according to WND reporter, Bob Unruh. Wyoming’s new law includes language that makes it a felony for any U.S. agent to “enforce or attempt to enforce” federal firearm regulations, which could be punishable by a fine of $2000 and/or imprisonment.(1) This week, Wyoming passed a 10th Amendment Sovereignty Resolution as well.

Gun control is not only a 2nd Amendment issue, it also relates to other parts of the Constitution. The 2nd Amendment states, “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” The 10th Amendment states, “The powers not delegated to the United States by the Constitution, nor prohibited by the States, are reserved to the States respectively, or to the people.”

In a conversation with G. Edward Griffin, he said that there are two competing philosophies about the Bill of Rights:

1. The states are sovereign and can do anything they want (so long as it does not involve a power delegated to the federal government by the Constitution). The Bill of Rights restricts only the federal government.

2. States also must adhere to the Bill of Rights the same as the federal government.

Mr. Griffin said that the last words of the 2nd Amendment: “… shall not be infringed” presents an ambiguity as to who would be infringing: the federal government? The state and local governments? However, he said that this question is answered by the 1st Amendment which begins with the words: “Congress shall make no law …” We conclude, therefore, that all of the following amendments carry the same clarification that it is CONGRESS that is being limited, not the states. This understanding supports the conclusion that the states, indeed, are free to do what they wish.

Chicago has had a gun ban for 27 years, and it now is being tested in the Supreme Court (McDonald vs. Chicago).(2) There is a real dilemma here. McDonald claims that his right to bear arms may not be infringed by local governments, even though the 2nd Amendment was not intended to protect that right at the local level. Why not? Because, he says, the 14th Amendment’s “equal protection” clause prohibits states from denying “to any person within its jurisdiction the equal protection of the laws.” That makes sense as far as it goes, but it does not answer the question of whether or not the right to bear arms is a “law” and especially if it is a law in Illinois. So there is a great deal of wiggle room left for legal argument on both sides.

The bad news is that, regardless of how the decision turns out, American tradition will lose. If the Court rules in favor of the 14th Amendment, this could diminish states’ rights, and the fear is that new federal “rights” could be invented (such as the right to health care) and that states would be required to go along. If the Court rules in favor of states rights, then the right to bear arms is vulnerable to attack at the state level.

To further muddy the waters, there is a lawsuit in Montana against U.S. Attorney General Eric Holder for attempting to impose federal regulations of weapons made, bought and used within the state. The federal government asserts that the Commerce Clause (Article 1, Section allows it to regulate anything that is traded solely within a state because it affects commerce across state lines.(3) With this interpretation, there literally in nothing that can be considered outside interstate commerce. The federal government has used this interpretation for many years to rationalize authority over the states and, unfortunately, the Supreme Court generally can be relied on to uphold it.

Lastly, Hillary Clinton has announced that the U.S. will participate in a UN Treaty(4) that will regulate conventional arms sales in every nation. Many fear it will be the beginning of a back-door international move to eliminate American 2nd Amendment rights.

The back door is known as The Supremacy Clause of the U.S. Constitution, which states: “This Constitution, and the laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

Over the years, the Supremacy Clause has been corrupted on behalf of internationalists who seek the elimination of American sovereignty. After winning freedom from Britain in the Revolutionary War, the Framers of the Constitution would never have favored turning that freedom over to foreign entities by treaty or anything else. Yet, in 1922, the Supreme Court applied the Supremacy Clause (in Missouri vs. Holland) and declared that a treaty with Canada regarding migratory birds was superior to the laws of the states dealing with the same topic. From that date forward, the federal government has assumed that the issue is resolved and that the 10th Amendment no longer provides sovereignty to the states.

But the battle is not over. Along the way, there have been a number of attempts to restore original intent to the Constitution, and it looks like a new wave of awareness may bring this issue back to the courts and into the consciousness of the American people.

Health Care: Obama Approves Sabotaging The Constitution

On Thursday, Robert Gibbs, Obama’s press secretary, responded to a question about the so-called “Slaughter Rule” (named after Rep. Slaughter, who sits on the rules committee) that will be used by Democrats to force through Obama’s totalitarian care bill, probably over the weekend.

Gibbs’ answer was deliberately opaque. By not addressing the question, he essentially said “deem and pass” will be used in the future to enact unpopular legislation, including a bill that will legalize millions of illegal immigrants.

It is now official — the Constitution is dead. It may as well be used to wrap fish.

Article 1, Section 7 of the Constitution requires that both houses of Congress hold recorded yea-or-nay votes on a bill before it can be presented to the president for his signature and before it can become law.

Obama approves of sabotaging the Constitution. He said he does not “spend a lot of time worrying about what the procedural rules are,” in other words violating the spirit and law of the Constitution is not a biggie for him. “What I can tell you is that the vote that’s taken in the House will be a vote for health care reform. And if people vote yes, whatever form that takes, that is going to be a vote for health care reform,” he told Bret Baier of Fox News.

“These constitutional rules set forth in Article I are not mere exercises in formalism,” former federal appeals court judge Michael McConnell told the Wall Street Journal earlier in the week. “They ensure the democratic accountability of our representatives.”

Author and talk show host Mark Levin’s Landmark Legal Foundation plans to file an immediate lawsuit if House Democratic leaders try to use the unconstitutional maneuver to pass the Senate version of Obama’s totalitarian care.

Good for Levin. However, according to constitutional experts, the underhanded procedure is unlikely to be reversed by the courts.

In short, Obama and Congress will not be called to task. The Constitution is now about as relevant as the Sunday funnies.

US Forest Service admits putting surveillance cameras on public lands

Last month, Herman Jacob took his daughter and her friend camping in the Francis Marion National Forest. While poking around for some firewood, Jacob noticed a wire. He pulled on it and followed it to a video camera and antenna.

The camera didn’t have any markings identifying its owner, so Jacob took it home and called law enforcement agencies to find out if it was theirs, all the while wondering why someone would station a video camera in an isolated clearing in the woods.

He eventually received a call from Mark Heitzman of the U.S. Forest Service.

In a stiff voice, Heitzman ordered Jacob to turn it back over to his agency, explaining that it had been set up to monitor “illicit activities.” Jacob returned the camera but felt uneasy.

Why, he wondered, would the Forest Service have secret cameras in a relatively remote camping area? What do they do with photos of bystanders?

How many hidden cameras are they using, and for what purposes? Is this surveillance in the forest an effective law enforcement tool? And what are our expectations of privacy when we camp on public land?

Saying insurance firms have ‘hostaged’ Congress, Democrat won’t vote for health bill

A liberal Democrat says he won’t vote for President Barack Obama’s signature healthcare bill, asserting that the measure is a giveaway to large health insurance and pharmaceutical companies.

“We’ve paid the ransom, but at the end of the day the insurance companies are still holding the hostages,” Rep. Stephen Lynch said in an interview with the Boston Globe on Thursday. “This is a very good bill for insurance companies and pharmaceutical companies. It might be good for Nebraska, I don’t know. Or Florida residents… But it’s not good for the average American, and it’s not good for my district. Or for Massachusetts.”

Lynch voted for the House version of the health care package when it was passed last December. But the House version included a provision for a “public option,” or government-run competitor to private insurance firms. He says the final bill subsidizes the companies that Obama himself has demonized for preying on consumers.

“The insurers still rule,” Lynch said. “Were just pumping subsidies into the current system, but that won’t drive down costs.”

“Lynch had counted himself earlier this week as undecided. He said he decided to vote no within the last several days. He said he is also opposed to the parliamentary procedures Democrats plan to use,” the Globe added. “Because their numbers in the Senate have diminished, they are planning to pass changes through a budget reconciliation process, which restricts the types of changes that can be made to ones that have a budgetary impact.

Multiple strikes over new tax ‘cripple’ Athens

Strikes over government-proposed taxes to help rein in Greece’s burgeoning public debt have taken on new dimensions as more workers join the walkouts.

Taxi drivers and gas station workers are the latest groups to join strikes in Athens after doctors’ strike yesterday in protest against the government’s payments and benefits cuts and new taxes.

The drivers are protesting against new tax proposals, due to become law imminently, which will require them to issue receipts and pay tax on their income, while gas station workers say higher taxes are driving their customers into neighboring Bulgaria for cheaper gas, local media reported.

A strike by doctors is also reportedly spreading to other parts of the country, with “many” hospitals in the capital operating with emergencies staffs only.

Power cuts have also been reported as employees of the country’s power sector went on strike over salary cuts and freezes on employment, the United Press International (UPI) reported.

“Nature is disrupted. It rains when it shouldn’t rain.” Marisa Marcavillaca of Peru said through a translator. “We have freezing temperatures when we shouldn’t have freezing temperatures. Because our yields are down, it is difficult to feed our children.”

“Warmer temperatures in her farming area have spurred plant diseases, and the quality of agricultural seeds has degenerated, cutting into local women’s ability to earn a living, she said.”

Yes, I know that Al Gore et. al. started referring to the imagined phenomenon as “climate change” and “the climate crisis” some time ago, but if it’s not about warming (and is rather about “climate change”) why does he keep showing us graphs that purport to show the earth warming at an unprecedented rate?

P.S. “It rains when it shouldn’t rain.” That’s a strange statement the more you think about it. The only time I can definitively say it “shouldn’t rain” is when there are no clouds in the sky – all other times it most certainly could rain. So, is she implying that it rained on a clear day?

Showdown Health Care Vote Likely This Weekend

March 19 (Bloomberg) — U.S. House Democrats, who cleared a big hurdle in their effort to overhaul the health-care system by producing compromise legislation, picked up fresh support for a likely showdown vote this weekend.

Democrats need about six more votes from House members to pass the 10-year, $940 billion bill, Obama administration officials said today.

White House and Democratic leaders aim to collect those votes from a pool of about 14 to 15 undecided lawmakers to get to the 216 votes needed to pass the measure, according to the officials, who spoke on condition of anonymity.

Obama has met or called about three dozen lawmakers in the last five days and has cleared his schedule today for more last- minute appeals, including a campaign-style rally in nearby Fairfax, Virginia.

Sarkozy Opposes IMF Loan to Greece, Widens Rift With Germany

March 19 (Bloomberg) — President Nicolas Sarkozy opposes Germany’s call for an International Monetary Fund loan to Greece, a French government official said, pitting the euro area’s biggest members against one another over a rescue plan.

The official, who declined to be named under government ground rules, said Sarkozy favored a European solution to help Greece and said the monetary union must act to restore investor confidence and shrink Greek borrowing costs.

“I want to be very clear: if it were necessary, the states of the euro zone would fulfill their commitments,” Sarkozy said in Paris March 7 after a meeting with Greek Prime Minister George Papandreou. “There can be no doubt in this regard.”

The comments, coming the week before an EU summit in Brussels, follow a shift by German Chancellor Angela Merkel toward an IMF-led package for Greece, which is struggling to reduce Europe’s biggest budget deficit. Merkel said this week that in the absence of a European lender of last resort, calling in the IMF “would probably have to be the way out right now if action were to be taken.”

Computer snafu is behind at least 50 ‘raids’ on Brooklyn couple’s home

Blame it on a computer.

Embarrassed cops on Thursday cited a “computer glitch” as the reason police targeted the home of an elderly, law-abiding couple more than 50 times in futile hunts for bad guys.

Apparently, the address of Walter and Rose Martin’s Brooklyn home was used to test a department-wide computer system in 2002.

What followed was years of cops appearing at the Martins’ door looking for murderers, robbers and rapists – as often as three times a week.

After the Daily News exclusively reported on the couple’s plague of police raids yesterday, apologetic detectives from the NYPD’s Identity Theft Squad showed up at their home.

Biden: “We’re Going To Control The Insurance Companies”

TAPPER: When you talked to these members of Congress, you told me what you tell them. What do you hear back from them? Do you hear back from venerable members who are worried this bill will cost them their jobs?

BIDEN: Well, I yes. Some of them I say they say, well, Joe, look, man, I mean, you know, you guys haven’t massaged this very well. And, you know, this thing has gone on so long, I don’t know. And my response is, hey, man, the proof of the pudding is in the eating. I’m telling you, you know, pre-existing, they’re going to be covered.

You know we’re going to control the insurance companies. You know people aren’t going to lose their health care with their employer like is being advertised. So you’ve got to if you really want to make sure that you get the benefit of what you’ve already done, vote for the bill.

And I look, Jake, I really, truly believe that the worst place to be, as a legislator, is being in the position where your side is being pummeled for an idea and there’s misrepresentations about all the bad
things the idea is going to generate.

And then the idea fails and then they go, see, I told you Jake was for it. And had I not stopped, Jake, there would have been death panels.
