today's gannett/the alexandria daily town talk has more on the recent legal action taken against councilman roosevelt johnson by alexandria mayor jacques roy. see alexandria mayor seeks 'accountability' in lawsuit against councilman.

the news report gives a pretty good background as to how the history of the lawsuit that was filed by the mayor in august 2007 after the council voted to override his veto.

before the council voted to override mayor roy's veto, there appeared a reverend who addressed the council who told them about a "premonition" he had and warned them about their unwillingness "to follow leadership."

immediately thereafter, the council went ahead and voted to override the veto and it's been downhill for them ever since as well as the council's attorney, jock scott who died.

judging from the information that the mayor is seeking in the subpoenas, it appears highly likely that if he is allowed to amend his petition and litigate it on out, that councilman johnson and possibly other councilpersons could be facing malfeasance in office and/or other charges.

near the conclusion of tonight's alexandria, la., city council meeting, councilman roosevelt johnson mentioned something about an upcoming court hearing on 06 february 2012, involving the mayor and he and something about the mayor's brother, alexandria attorney chris roy, jr.

we couldnt imagine what he was on about. it took a little while of searching and we learned that chris roy, jr., on 10 november 2011, enrolled as co-counsel of record in the roy vs. alexandria city council lawsuit originally filed way back on 29 august 2007.

some subpoenas issued to roosevelt johnson and councilwoman mitzi gibson around mid november 2011. there's a subpoena in there for myron lawson too, but he was nowhere to be found. rpso attempted to serve him at least four times -- page 18. it's unclear, from what's available on the rapides clerk of court's website, if he was ever served.

anyway, supposedly both councilman johnson and councilwoman gibson each gave video depositions and we cant wait to see the vids. if we get them of course we'll share them with you.

there is a letter (page 14) from chris roy, jr., to the clerk of court dated 01 december, 2011 in which mr. roy mentions "our recently filed supplemental petition." however, we cant locate it on the clerk's website.

the pleadings we've posted speak for themselves and it looks like some are potentially in a world of trouble.

the place to be on monday, 06 february, 2012 at 9:30 am is at the rapides parish court house in judge harry randow's court room.

rapides parish clerk of court records show that mr. sadler and the provosty firm were both served with ms. thompson's petition on 22 november 2011. however, as of the date and time of this post no answer has been filed.

January 23, 2012

On January 22, 2012 at 12:26 AM the Pineville Police Department received a report of an Armed Robbery that occurred at Circle K, 3234 Military Highway in Pineville.

There were no reported injuries to the clerk that was on duty at the time of the incident.

The clerk reported to the officers that a male subject dressed in a black “hoodie” and blue jeans wearing a black ski mask walked into the store and brandished a knife.

The robber then demanded money from the clerk.

The clerk complied with the demands of the robber and gave the robber an undetermined amount of money from the cash register.

The robber then fled from the store through the door facing King’s Country Shopping Village.

It is unknown at this time the direction of travel of the robber or his method of transportation from the scene of the incident.

As more information becomes available it will be released.

If anyone has possible information concerning this incident, please contact Detective Casey Blake with the Pineville Police Department at 442-6603.

this article from 09 november 2011, says that britain's advertising standards authority, responding to complaints about this ad, stated that:

"We noted that the model was holding up the perfume bottle which rested in her lap between her legs and we considered that its position was sexually provocative.

We understood the model was 17 years old but we considered she looked under the age of 16.

We considered that the length of her dress, her leg and position of the perfume bottle drew attention to her sexuality. Because of that, along with her appearance, we considered the ad could be seen to sexualise a child."

and that:

Coty, makers of Oh, Lola! said it did not believe the ad suggested the model was underage or that it was "inappropriately sexualised' as it didn't show any "private body parts or sexual activity".

They said the giant perfume bottle - shaped like a vase holding a blooming pink flower - was "provoking, but not indecent". [emphasis added]

apparently, this happened in early november 2011. we only learned about it yesterday when we followed a sponsored link at the bottom of a gannett/the town talk news story.

although the ad was banned in the united kingdom, one way "the media" gets around this is to promote it as a legitimate news story.

we believe that one of the subliminal suggestions that this advertisement seeks to implant into the mind of its viewer, is to associate the essence of this perfume with the scent of this seventeen year old (presumably virgin) girls' vagina.

The Secret Service says it is investigating and a parade of Jewish leaders quickly moved to denounce Andrew Adler, publisher and owner of the Atlanta Jewish Times.

back on 07 december 2011, local realtor rod noles on his weekly ksyl economic update radio program, mentioned that the rayford office building, located in alexandria, louisiana is for sale:

Rayford Office Building with 4 acres of land plus the jet air plane is for sale at $3,500,000. If there were ever a building that could brand a company this is the spot. ~ source rod's notes for wednesday 12/07/11

we dont know if the building will sell or of the prospective new owners will keep the usaf jet located next to the building; we hope that they do. we'd never been inside the building and have only seen the jet airplane from the highway, but in any event, we had an opportunity to take a few photographs of it:

What has caused the rift between friends and allies — Jews and Arabs — in the last few decades?

We all have been witness to the tragedy of the strife and bloodshed, in the most holy of places, the Holy Land. From ancient times, the relations between the Jewish and Arab peoples, have been those of peace, brotherhood and harmonic coexistence. Friendship reigned between them in all the Muslim countries. The answer is actually very clear and simple.

The birth of a wholly new and entirely materialistic movement named “Zionism.” “Zionism” is the basis of the State of “Israel,” and is not the same as the religion, Judaism. In fact it is antithetical to Judaism. Zionism is a political movement, created almost entirely by non-religious Jews. Its existence is a mere hundred years.

The philosophy of Zionism is the transformation of Judaism, from a religion and spirituality, to a base nationalism. It is a materialistic goal to have a land, army etc., removing the Almighty out of the equation.

Orthodox Jews have opposed the ideology of Zionism since its inception and the State of “Israel” from the day of its ratification. The existence of the State of Israel is in direct contradiction to the teachings of the Torah which forbids the establishment of a Jewish state and commands Jews to remain in exile until released from that exile by the Almighty Himself, without any human intervention, at which time all nations of the world will live together in peace.

This rebellion against the Almighty has been compounded immeasurably by the fact that in order to create this State, a land has been taken, clearly against the will of the indigenous population, the Palestinian people. Many have been murdered, their homes and properties have been confiscated and untold thousands have been expelled, etc., their suffering continues unabated until the present day.

We decry, in the strongest of terms this ongoing crime and tragedy. The anti Zionist Jewish people sees itself as simply continuing the Jewish people’s age old obligation of living humbly and in peace with all nations, in loyalty to the authorities of the nations in where they reside, as is required by the Torah.

Contrary to the common misconception, Torah true Jews have always opposed and combated the concept of Zionism and the State of Israel, continuously since its inception and up until the present day.

Supporting the Palestinian people, does not make one, in any way, less of a friend of the Jewish people and most certainly does not label one an anti-Semite.

In fact, the contrary the mere existence of the state of “Israel” and the actions that emanate from it is the greatest cause of the exacerbation of anti-Semitism throughout the world.

How much more Arab and Jewish blood must be spilled?

May we merit to see the day, soon in our times, when all humanity will serve the Almighty in brotherhood and harmony. AMEN.

according to the petition of burnis edward delrie, jr. and andrew r. basco they bought a 2010 ford focus from hixson autoplex only to quickly discover that it had been wrecked.

they then notified hixson and hixson's banksters capitol one auto finance that "they wished to return the vehicle and cancel the sale."

according to the petition, capitol one told them to return the vehicle to hixson autoplex and have hixson cancel the sale and the financing agreement but hixson autoplex refused.

so now they're suing hixson autoplex l.l.c. pursuant to La. R.S. 51:1409 for violating La. R.S. 51:1405.

the plaintiffs are represented by devan pardue of the springfield,(livingston parish) louisiana, pardue law firm.

the suit is in the ninth judicial district court and was allotted to division "c" judge mary lauve doggett.

ever since we first heard it probably in the early 1980's "if you dont want me to" or the freeze has been one of our favorite songs.

the thing about this song is that it's very mysterious. we'd hear it occasionally on the radio but could never find out the name or what album of mr. milsaps' that it was on.

there is also a real snappy line dance that we would see people at parties dance when the house band would play it live.

over the years we'd search for it with no luck and no leads in music stores in virginia, north carolina, new jersey, florida are a few that come to mind.

then in the late 1980's we were in the alexandria, la. mall and went in to a popular at the time, music store they used to have there called musicland. there was a real young guy behind the counter and we went into our spiel about a song by ronnie milsap that starts out with a piano one of the lines is something like 'if you dont want me too' and there is a line dance ... he smiled and stopped us in mid sentence and said the name of the song is "if you dont want me to" or the freeze and it's not available and that they couldnt order it and that they get people in there every week if not every day looking for it. so that was that.

so skip ahead to 2000 - 2001 when we first got on the internet and napster was going strong and legal so we signed up for napster just to see if we could get that song file and indeed it was the very first file we ever downloaded from there.

despite napster being legal, we didnt feel bad about downloading the file because we had made every good faith effort we could think of to purchase it; on a side note, what was so great about napster -- besides having probably every song ever made on there -- was that it was a great resource for speeches and other historical events.

we're lucky to be able to walk and chew gum at the same time -- much less dance but we've always enjoyed watching line dancing and last night we were on youtube looking for some line dance videos and just happened to search for the freeze and came across a video which was only uploaded to youtube this past august in which mr. milsap gives some of the history behind this song. see below.

"if you dont want me to" was finally released as a track on his newest cd called "country again." so we'll be on the look-out for that cd.

the youtube commenter bobby71446 says that the man in the video lives in leesville, louisiana and that they call him pop.

question: "your first single 'if you dont want me to,' the freeze, hit radio last week; what inspired you to write a song about a new dance craze?"

ronnie milsap: "well, what it is, this song was out a few years ago; it has quite an odd history to it, in that, it was very popular down in louisiana. it was on the 'b' side of a couple of singles to service the juke boxes and folks in louisiana played this song for a celebration. any kind of celebration they play it. where there's a wedding or any other kind of celebration. this dance became so popular we decided it ought to be the first single from this cd." ~ source "ronnie milsap web series - the freeze" 17 august 2011.

we've noticed that since we've been posting some lawsuits and pleadings that we've been receiving some googlers from all over; we assume, judging from the keywords and search strings, looking for various types of pleadings to serve as a template for their own lawsuits.

most of these visits appear to be coming from private individuals but there are also some law firms.

back in 2009, louisiana supreme court chief justice, catherine d. "kitty" kimball, in her first address to the joint session of the louisiana legislature, told the lege, that "as the cost of litigation continues to be high and as the economy weakens more and more of our citizens who must utilize the court are trying to handle legal matters on their own."

this case should have something for just about everyone. there's motions to compel discovery, motions to extend time to respond, motions to recuse judges, tons of witness and deposition subpoenas and on and on.

there's even some la. code of civil procedure art. 971. special motion to strike, although an article 971 motion wasnt really applicable to this case; even if one were, compared to others that we've read, this one was horribly pled by mr. pugh's attorney, s. aaron siebeneicher (johnson & siebeneicher) and mr. sansings' timothy shumate (chris roy, sr.).

for the best chance for success an article 971 motion should be its own well briefed, stand alone motion. instead what happened here is the attorneys decided to include it, almost as an afterthought, in a motion for peremptory and dilatory exceptions and reconventional demand.

several of cleco's many attorneys richard a. rozanski, (wheelis & rozanski) and jennifer l. thornton, (stanley, fanagan & reuter), both of whom are freaking pit bulls, totally destroyed them in their opposition briefs and the trial court (judge george c. metoyer, jr.) eventually denied them.

we cant tell where the third circuit appeals court took it up on a supervisory writ -- although on page 623 the third circuit did grant a motion to strike for mr. sansing regarding "the references to the depositions of sonny craig and ned randolph and the affidavit of samuel sansing are hereby ordered stricken as they were not submitted to the trial court." but that doesnt appear to be related to the article 971 special motion to strike.

nevertheless, if you're looking for a template for an article 971 special motion to strike -- dont use this one. check this one out .pdf 16 pages [187 kb].

what this case boiled down to is that mr. sansing and mr. pugh both worked for cleco and when they left cleco's employ "cleco paid pugh a severance package of $76,668" and mr. sansing $175,000.00.

mr. sansing and mr. pugh were aware that cleco had been over billing or defrauding the city of alexandria and its electricity rate payers for many years amounting to millions of dollars.

so instead of going to the police and reporting it so that the police could investigate and the city and its rate payers could recover 100% of the over billings -- they go to the alexandria city council and its then mayor and in a complete abdication of their fiduciary duty to the city and its rate payers, they enter into an agreement with mr. sansing and mr. pugh to give them an incredible 50% of any money they recovered.

as you can imagine all this angered and likely frightened cleco and in one of the pleadings there is a vague reference to an unnamed alexandria city councilman who had a physical confrontation with an unnamed cleco employee at an unnamed local restaurant that happened right after cleco learned that the city had signed this contract with mr. sansing and mr. pugh and their energy management services, l.l.c.

cleco wanted their severance money back and didnt mind spending what must have amounted to hundreds of thousands of dollars in legal fees to recover what amounted to around $252,000.00.

the louisiana supreme court is what saved mr. sansing and mr. pugh.

mr. sansing wanted cleco to produce "a certain document" which cleco declined and wanted a protective order which judge metoyer refused to grant and ordered cleco to produce the document.

cleco fought this all the way to the supreme court who remanded it back to judge metoyer and instructed him "to render a new ruling on cleco's motion for protective order, including specific findings on the applicability of the crime-fraud exception, after appropriate briefing from the parties and, if necessary, an additional in camera review of the privileged documents."

after the supremes ruling in mid may 2009, it appears that cleco abandoned the case as there has been no activity since.
