<p>Similar to Canada’s introduction of the <span style="text-decoration: underline;color: #0000ff"><a title="Overview of CASL" href="http://blog.upaknee.com/2013/03/21/overview-of-canadas-casl/" target="_blank"><span style="color: #0000ff;text-decoration: underline">Canadian Anti-Spam Legislation</span></a></span> (CASL), the European Union is planning to introduce the European <span style="text-decoration: underline;color: #0000ff"><a title="Data Protection Legal Framework" href="http://ec.europa.eu/justice/data-protection/reform/index_en.htm" target="_blank"><span style="color: #0000ff;text-decoration: underline">General Data Protection Regulation</span></a></span> (GDPR) in early 2016. The new regulation is determined to unify data privacy law across European countries, as it will apply to all member states.</p>
<p><span id="more-4463"></span></p>
<p>This directive will affect anyone with data pertaining to European citizens and residents. According to the European Commission, &#8220;personal data is any information relating to an individual, whether it relates to his or her private, professional or public life. It can be anything from a name, a photo, an email address, bank details, posts on social networking websites, medical information, or a computer’s IP address.&#8221; With organizations aggregating marketing data from a variety of sources, email marketers sending CEMs to Europe will need be diligent to ensure compliance and protection.</p>
<p>The creation of the new bill has been in the works since January 2012 but due to a series of revisions and amendments, it has only come to mature recently, in June 2015 after tentative approval from the European Council, the European Commission, and the European Parliament. After an additional round of revisions, the bill is likely to come into effect in early 2016 and allow a two-year transition period to allow companies additional time to prepare.</p>
<p>Given the severity of this new bill, organizations of all sizes around the world are beginning to feel the pressure to get their data protection under control. Similarly to CASL, the GDPR is not limited to communications sent within Europe, but also countries transferring data outside of the European Economic Area (EEA); so if an international organization stores European client data in their own country (ie. Canada), they will have to ensure higher data protection services to ensure there are no possibilities of a breach.</p>
<h2>The Penalties</h2>
<p>Although there is still some uncertainty as to exactly how much the penalties will be and how they’ll be enforced, all signs are pointing to penalty amounts in the tens of millions of dollars. <span style="text-decoration: underline;color: #0000ff"><a title="10 Things You Need To Know About The New EU Data Protection Regulation" href="http://www.computerworlduk.com/security/10-things-you-need-know-about-new-eu-data-protection-regulation-3610851/" target="_blank"><span style="color: #0000ff;text-decoration: underline">ComputerWorldUK</span></a> </span>states that fines as high as €100m or 5% of the organizations’ global revenue could be issued to violators, meaning approximately $145 million for Canadian companies. Fines as high as this could have a hugely detrimental impact on organizations, especially small to medium enterprises with international customers or subscribers.</p>

<p>Organizations that use European customer data should be proactive in protecting themselves from GDPR violation. To do this, it’s important to make sure your organization’s IT and Digital Communications departments are aware of the regulations and penalties. Assigning an individual to be the official data officer of your organization is a great way to stay on top of the GDPR bill.</p>

<p>As of July 1st, 2014, the Canadian Government implemented CASL as a way to protect Canadians from receiving unwanted or harmful commercial electronic messages (CEMs) while ensuring that Canadian businesses and organizations remain competitive in local and global marketplaces.</p>
<p><span id="more-4419"></span></p>
<p>After an investigation launched by the CRTC, it was found that <span style="text-decoration: underline;"><a href="http://www.rogersmedia.com/" target="_blank">Rogers Media</a></span> failed to comply with the legislation. Specifically, Rogers Media was found to be using a faulty unsubscribe mechanism and failed to honour email-unsubscribe requests within 10 business days.</p>
<p>Since incurring the violation, Rogers Media has been proactive in resolving the non-compliance with Canadian Anti-Spam Legislation and has agreed to pay the $200,000 fine.</p>
<h2><strong>What Your Business Needs to Know About CASL</strong></h2>

<p>Having people subscribe to your email newsletter is a true gift, a sign that your business and what you stand for is a positive feature in readers everyday lives. Therefore, creating your email as a &#8220;noreply@domain.com&#8221; is your response to readers for subscribers, letting them know that you do not want to hear from them. This is a message that is most likely not very appreciated by your readers.</p>

Moreover, a lot of emails in this day in age seems to feature one large image, to the detriment of text and words. </p>
<p>However, using only one <strong>BIG</strong> image with little or no words is a spammer favourite &#8211; so this might increase your chance of being flagged as a spam email or sent to the junk folder to your contacts. <span id="more-4166"></span> </p>
<p>Plus, using only one image can cause extra problems, such as inaccurate information in regards to your open and click rates (if your images do not appear). </p>
<p>Though its extremely tempting to just create a campaign with one captivating image and nothing else, sometimes it does not work as you wanted due to:</p>
<ul><strong>
<li>images unable to load</li>
<li>the link of the image could be incorrect</li>
<li>the image could get deleted</li>
<p></strong>
</ul>
<p>The biggest thing for everyone to realize is that using just one big image for your campaign, what you see isn&#8217;t always what your contacts will really get. </p>
<h3>Consider theses steps when working with images and text in a Campaign:</h3>

We are more than happy to answer it because the truth is&#8230;there is many out there that never ask. Most of them go ahead and change it without even considering consequences, so I hope this post reaches some of those people.</p>
<p>The direct answer to this question is a <strong>YES</strong>, but there are actions you need to do a certain way in order to avoid problems. <span id="more-4096"></span></p>
<p>In the ever diverse and lively land of Email Delivery, your From address should be thought of as your identity. It is similar to your telephone number or personal email address. If you changed either of these you would probably tell your friends and family about it because that is an important change, right? Well same goes with email marketing and here&#8217;s why&#8230;</p>
<p>When individuals receive your emails, they will often add your From address to their Contact or &#8220;Safe list&#8221; (whether knowing or not). Even if they click &#8220;enable images for this sender&#8221; it can give future emails you send them preferential treatment. Most ISPs will then <strong>WHITELIST</strong> emails you send that person (from that address) from that point forward, unless the sender tells them otherwise.There are few things to consider:</p>
<ul>
<li> It will prevent future emails getting sent to the junk folder</li>
<li> It will enable images and links by default and help improve your reputation</li>
<li> Adding your From address to their Address book will give you positive results</li>
</ul>
<p>Once you change your from address, those perks will all disappear. Changing the prefix to the domain is not as bad as changing the actual domain, but any change you make does have a negative impact on your deliverability. That doesn&#8217;t mean you should should be stuck with the same From address forever, but you should expect a slight drop in delivery if you do consider making the change (especially if you break the SPF/DKIM authentication).</p>
<ol>
<h3>To Ensure you minimize that drop, you need to follow some rules:</h3>
<li><strong>Tell Everybody</strong> and keep your recipients informed before you conduct this change. Send them an email warning a few weeks in advance announcing the change and encouraging them to add your new From address to their Contact list as soon as possible (preferably before you send the first email).</li>
<li><strong>Insert Warnings</strong> to the top of all your campaigns leading up to and even beyond the day you change over to the new address. You want to make sure as many people are aware about this, remind them consistently so it will trigger recognition when the new email address arrives in their inbox.</li>
<li><strong>Keep the same URL</strong> that they initially went to sign up. For example if they signed up at http://www.cbc.ca your e-mail should be &#8220;info@upaknee.com&#8221; or &#8220;info@mail.upaknee.com&#8221; or if it is sent from different departments with the same company: &#8216;info@billing.upaknee.com&#8217;, &#8216;billing@upaknee.com&#8217;, etc&#8230;</li>

<p>John Levine, President of the Coalition Against Unsolicited Commercial Email (CAUCE), commented: </p>
<p><em>“CASL makes Canada a place where abusive messaging will no longer be tolerated; it provides a toolkit to protect lawful businesses and consumers from the bad actors ruining online experiences of millions, by putting a hard stop to email spam and all types of messaging abuse, while laying out clear and workable standards for proper opt-in online marketing.”</em></p>
<p>The Government of Canada estimates the annual cost of Internet spam on the Canadian economy to be more than $3 billion. CASL allows companies to send business-related messages (internally or business-to-business) as well as emails regarding product recall information, in response to consumer inquiry. The law will still permit charities’ ability to use electronic messaging to reach potential donors. The enforcement of CASL will hinder, and in fact ban, the most deceptive forms of spam, protecting people’s personal information from identify theft, phishing and spyware. </p>
<p>Consumers will control the electronic messages they receive via consent. Companies will be required to clearly identify themselves in their messages, while it is also imperative to allow consumers to unsubscribe from future electronic messages within every message. </p>
<p>Three agencies are tasked with the enforcement of CASL: <a href="http://www.competitionbureau.gc.ca/eic/site/cb-bc.nsf/eng/home" target="_blank"><u>The Competition Bureau of Canada</u></a>, <a href="http://www.priv.gc.ca/index_e.asp" target="_blank"><u>The Office of the Privacy Commissioner of Canada</u></a> and <a href="http://www.crtc.gc.ca/eng/home-accueil.htm" target="_blank"><u>The Canadian Radio-Television and Telecommunications Commission</u></a>. Failure to comply with CASL’s standards will result in financial penalties.</p>

<li>Primary (messages from friends/family and other messages that don’t appear in other tabs)</li>
<li>Promotions (deals, offers and other promotional messages)</li>
<li>Social (messages from social networks, media-sharing sites, gaming platforms, etc.)</li>
<li>Updates (notifications such as confirmations, receipts, bills and statements)</li>
<li>Forums (messages from online groups, discussion boards and mailing lists)</li>
<p><span id="more-3986"></span></p>
<p>This means that all the emails we receive are organized and at a glance we can see what’s new and decide which emails to read and when.</p>
<p>So what does this mean for email marketers? We’ll outline the good and the bad of this change, along with what you can do to help ensure that your legitimate messages reach the inbox, are opened and read by your audience.</p>
<h2>Gmail Open Rates Declining</h2>
<p>For starters, evidence shows that the new tabs may be impacting Gmail open rates. According to <a href="https://litmus.com/blog/gmail-opens-drop-18-are-tabs-to-blame" title="Litmus Blog - Gmail Opens Drop 18%">Litmus</a>, although there has been a positive trendline over time, Gmail opens have decreased 18% in the past three months. Is Gmail tabs to blame?</p>
<h2>Downfalls to Email Marketers</h2>
<p>This new layout can cause newsletters and other promotional material to end up in the Promotions tab, rather than the Primary inbox, causing great concern for marketers. Grouping all promotional material means that your message may no longer stand out; your subject lines will appear directly next to your competitors. This also means that last-minute reminder emails (“Only ONE Hour Left…”) may not be seen as quickly or even after-the-fact. </p>
<p>Lastly, Gmail users may treat the Promotions tab as another spam box, performing mass deletions before browsing the contents of the tab.</p>
<h2>The Good News</h2>
<p>An email that looks like it came from an ESP will be automatically categorized under the Promotions tab (or possibly the Updated tab) by Google. However, if the subscriber is utilizing tabs but did not opt to using the Promotions tab, Gmail will deliver the message to the Primary inbox instead. </p>
<p>Although Gmail opens have slightly declined, it is too early to tell if the new tabs are to blame or if this is a new trend. It’s also important to note that while Gmail users have the ability to open their email in any email client, using programs such as Outlook, Apple Mail or mobile devices, not all these environments support the tabbed interface. Also, keep in mind that although Gmail is a popular email client, it is not the only email client.</p>
<p>Above all else, using best practices to consistently deliver legitimate and relevant messaging to your audience, incur few complaints and experience low bounce rates, will greatly impact your audience’s willingness to open and read your emails, regardless of the new tab layout.</p>
<h2>Surviving Gmail Tabs</h2>
<p><strong>Be Proactive </strong>– In your next scheduled email campaign, include a clear call to action (near the top of the campaign) that asks/prompts your subscribers using Gmail to “star” your messages (clicking the star located left of the sender line). This will ensure that your messages are placed in the Primary inbox as opposed to the Promotions tab.</p>
<p><strong>Be Bold </strong>– Directly ask your subscribers using Gmail to <a href="https://support.google.com/mail/answer/3055016?hl=en" title="Google Support - Inbox Tabs and Category Labels">manually move your messages</a> into their Primary tab (if they have switched to the new layout). Gmail users can drag-and-drop emails from one tab to the next and create a filter for that sender in order to send future messages to the desired tab. Include a clear call to action in your next scheduled email campaign, send a stand-alone campaign, write it on your blog, or talk about it on social media so that your subscribers will take action.</p>
<p><strong>Be Resourceful </strong>– For the audience who loves to hear from you, utilize your blog and social media to support and promote important emails. In other words, use these outlets as a reminder to your subscribers to check their inbox for important emails from you, such as time-sensitive offers or interesting content.</p>
<p><strong>Be Creative </strong>– When a tab is inactive, Gmail dictates that only the sender name will be displayed. Thus, the subject line will not be visible in this case. As a result of this, ensure that your sender name is short and recognizable. If multiple emails hit the tab at once, Gmail will abbreviate sender names and it may be unrecognizable to your subscriber upon first glance. If you are clear and concise, your subscribers will click, be able to see the subject line, and hopefully open your email. Keep in mind that well-written subject lines are still extremely important, especially when competing against other promotional messages.</p>
<p><strong>Be Relevant </strong>– Revisit your existing subscriber lists and analyze your subscribers and campaign results. Determine how you can further segment your lists to ensure your messages are relevant and valuable to your audience, and to increase the likelihood that your messages will be opened. Be sure to only send messages when you have something new, exciting, valuable and useful to share.</p>
<p><strong>Be Consistent </strong>– Continue to follow best practices to maximize your results. If your tactics have worked in the past, there is no reason to leave them behind – simply adjust your campaigns for Gmail users.</p>

<p>You may remember a time, years back (perhaps circa 2008), when 90% of the emails in your Inbox were spam and only about 10% of them were legitimate emails from the office or friends and family. I also remember having to create two separate email addresses during that time – one personal address that I would share with friends and family, and another address specifically to sign-up for e-newsletter and e-bill subscriptions. Interestingly enough, I’ve had both email addresses since 2008, and I must admit – I am pleasantly surprised at how little spam I receive. I expected my second email, designated for e-newsletters and e-bills, to fill up relatively quickly with emails I did not explicitly sign-up for. However, that has not been the case. So what has impacted this decrease of spam communication in the last four years?<span id="more-3785"></span></p>
<h3>1. CONSUMERS</h3>
<p>Consumers have become increasingly aware of hints of spam and have become accustomed to hitting the spam button  when they see an unsolicited commercial email. Here are some things to look for, courtesy of the Government of Canada. If the email:</p>
<li>Asks for sensitive information such as your address or bank information, it is a sign of spam. Not even your bank will ask you for this sort of information through electronic means of communication!</li>
<li>Impersonates companies or people you may know. When you know that your friend would call you, instead of writing you a one-liner email about how you knew each other in high school and want to reconnect, listen to your gut instincts – they’re most likely right!</li>
<li>Uses scare tactics such as pass this email on to at least 10 people or your account will be deleted. This is a ploy to gather as many email addresses as possible – don’t do it!</li>
<li>Asks for money in advance such as a $5 deposit before you will receive your $100 gift certificate. This is a ploy to receive your credit card information or other payment options you use.</li>
<li>Seems too good to be true. Emails such as “You win $1,000 – just send us your personal information!” Again, never give out your personal information electronically, even if it’s to a friend.</li>

<h3>2. EMAIL MARKETING BEST PRACTICES</h3>
<p>Canada released Best Practices for Email Marketing back in May of 2005 to complement the Personal Information Protection and Electronic Documents Act (PIPEDA), which came into full effect on January 1, 2004 <a href="http://laws-lois.justice.gc.ca/eng/acts/P-8.6/index.html" title="PIPEDA" target="_blank"></a>). Businesses and organizations have since been adapting these best practices in their daily processes and e-marketing communications. This has established a positive example of what commercial or marketing emails should look like. Recommended <a href="http://www.ic.gc.ca/eic/site/ecic-ceac.nsf/eng/gv00330.html" title="Best Practices" target="_blank">best practices</a> include:</p>
<li>Create a clear and transparent process for obtaining recipient consent;</li>
<li>Send emails only to recipients who have willingly provided their full consent;</li>
<li>Provide a web-based way for recipients to opt-out of receiving further email communications;</li>
<li>Clearly identify the sender, to be easily recognized by recipients;</li>
<li>Accurately reflect the purpose or content of each message in the subject line;</li>
<li>Provide a link to your organization’s privacy policy;</li>
<li>Establish a confidential, fair, and effective complaint-handling system.</li>
<h3>3. CANADA&#8217;S ANTI-SPAM LEGISLATION (CASL)</h3>
<p>CASL was passed in December of 2010, and will come into force once approved by the Governor General – while this date is pending, the new expected date of enforcement is early 2014. This legislation is meant to regulate all forms of commercial electronic messaging including, email and text messages. Details on the CASL legislation and its impacts on commercial email messages by organizations can be found <a href="http://blog.upaknee.com/2013/03/21/overview-of-canadas-casl/#more-3740" title="blog" target="_blank">HERE</a>.</p>
<p>Spam was a bigger problem for Canadians in 2008 when the Cisco 2008 Annual Security Report ranked Canada fourth on its Spam by Originating Country list that year. <p>We have seen a substantial decrease in spam communications over the last four years, and with the help of the CASL legislation to come into effect later this year, we hope to see this decrease even further.
