&lt;p&gt;While Study UK welcomes the increasing awareness in Government of the benefits that international students bring to the UK, we are concerned to see that the research confirms that changes to Tier 4 have had a significant negative impact on the UK&amp;rsquo;s further education sector. The research shows not only that the increased restrictions on Tier 4 learners have led to lower student recruitment numbers and a loss of a significant amount of income for colleges, but that some colleges have reduced their overall course offer as they no longer have sufficient numbers to run these, creating a negative impact on individuals in their local communities that may want to take these courses.&lt;/p&gt;
&lt;p&gt;Although the research concentrates on publicly funded colleges, similar effects of the Tier 4 changes are being felt amongst independent providers. Study UK shares the concerns of public FE colleges that continuation of current Government policies will have a significant long-term negative impact on the cultural and economic benefits which our sectors bring to the UK, as well as damaging the reputation of the UK among international students in an increasingly competitive marketplace.&lt;/p&gt;

&lt;p&gt;Study UK is delighted to announce the election of three new members to its eight-strong Board of Directors, who bring with them a wealth of knowledge and experience in the fields of national and international business and education.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Sue Edwards&lt;/strong&gt; has an unrivalled record in promoting the UK as the destination of choice for international students, having worked for over 20 years with two of the industry&amp;rsquo;s biggest names, Aspect Education and Kaplan International Colleges, and currently serving as Chair of Study UK&amp;rsquo;s sister association English UK. Sue will be representing Study UK&amp;rsquo;s providers of international foundation year programmes on the Board.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;William Hunt&lt;/strong&gt; started Greenwich School of Management with his brother in 1973 and has led it through four decades of growth to reach its current position as one of the country&amp;rsquo;s largest independent providers of higher education, delivering a wide portfolio of specialist courses across three sites in London. William assumes representative duties for the association&amp;rsquo;s independent higher education institutions.&lt;/p&gt;
&lt;p&gt;&lt;strong&gt;Paul Kirkham&lt;/strong&gt; was inspired to take his successful career in business in a new direction after taking a course at the Institute of Contemporary Music Performance during a sabbatical break. Having acquired the Institute in 2003, he has overseen a programme of investment and development that has seen the organisation more than quadruple in size over the last five years. Paul becomes Study UK&amp;rsquo;s first director of communications, leading on its new public engagement and information strategy.&lt;/p&gt;
&lt;p&gt;Sue Hindley, Study UK Chair, said: &amp;ldquo;We are delighted to have three such tremendously talented and highly respected figures from the sector join our board. Sue Hindley, Chair of Study UK, explains:&lt;/p&gt;
&lt;p&gt;"Thousands of Indian students each year have chosen to take their degrees at one of the UK's excellent university partner colleges. These smaller, independent colleges offer full undergraduate and postgraduate degree programmes at convenient locations across the UK, with a friendly and supportive atmosphere and excellent value for money.&lt;/p&gt;
&lt;p&gt;"Sadly, none of these students will be allowed to work for even a single day while they're here, after the Government changed the visa rules to actively discriminate against independent colleges, even those with top marks from the Quality Assurance Agency and a clean bill of health from the UK Border Agency. Student can be fully registered with a leading university, studying the exact same course as their on-campus counterparts, and yet they won't have the chance to find a part-time job, or even voluntary work in the community.&lt;/p&gt;
&lt;p&gt;"The Prime Minister talks up the employment opportunities for Indian students who graduate here. &lt;p&gt;&lt;a href="http://www.homeoffice.gov.uk/media-centre/speeches/home-secretary-imm-speech-dec12"&gt;In a speech to the Policy Exchange think tank in London&lt;/a&gt;, Mrs May announced plans by the UK Border Agency to expand its programme of interviews for prospective students to 'considerably more than 100,000' per year from April 2013, but confirmed that there is "no cap on the number of students able to come here - and there are no current plans to introduce a cap". Also from April, non-EU students who complete PhDs in the UK will automatically be allowed to stay on for one year in order to find a job or start a business, to ensure that the UK benefits from their expertise.&lt;/p&gt;
&lt;p&gt;Paul Kirkham, Communications Director for Study UK, said:&lt;/p&gt;
&lt;p&gt;"We are pleased that the Home Secretary has re-confirmed that there is no cap on international student numbers, and we welcome the growing understanding within Government generally of the value of international students to the UK. Unfortunately the speech also starkly demonstrates her department's continuing marginalisation of independent education providers, who play an essential and expanding role in the success of the UK's education sector.&lt;/p&gt;
&lt;p&gt;"Mrs May's statement that 'if you can speak English, and you can get a place on a proper course at a proper university' is typical of the prejudice and lack of recognition faced by high-quality independent institutions. The Home Secretary appears not to understand that many universities depend on the 'proper students' who access their courses by first studying 'proper courses' at 'proper independent colleges'. In fact, recent figures from Universities UK themselves confirm that a large proportion of their international students come through such providers. And it would also appear that she has failed to appreciate the significant contribution of the independent sector to the UK economy in terms of employment, export revenues and direct foreign investment.&lt;/p&gt;
&lt;p&gt;"The independent institutions represented by Study UK have risen to the challenges set by the Home Secretary last year. They have secured their future as Tier 4 sponsors, and have on every measure proven their commitment to responsible recruitment and high-quality provision. Study UK members include world-class institutions that attract talented students from every corner of the globe, many of whom go on to further study at UK universities. Since 2005 it has played a key role in helping to shape Government policy around international students and the visa system, in particular the development and implementation of Tier 4, and has remained the formal channel of communication between UKBA and the sector through its subsequent changes. Unfortunately as time went on JET lost much of its effectiveness as a policy and logistical discussion forum due mainly to its increasingly large and disparate membership, reaching by 2011 some 50 members and 30 separate organisations.&lt;/p&gt;
&lt;p&gt;Following a comprehensive internal review of its objectives and membership, JET has now been radically restructured into a core group of just half a dozen members representing education providers, joined by key Government officials from the Home Office and other relevant departments. This will allow it to regain its focus on enabling full and frank discussion of the key issues for the sector and hopefully become once more a vehicle for shaping future policy on education and immigration.&lt;br /&gt;&lt;br /&gt;We are delighted to confirm that&amp;nbsp;&lt;strong&gt;Study UK is a member of the new core JET group&lt;/strong&gt;, and the sole representatives of the independent tertiary education sector. Our sub-group meetings will be the main forums for individual Study UK members to make their board representative aware of what issues are most important to them. These issues will be discussed at Study UK board meetings, and key issues which need to be addressed by the Home Office can then be added to the agenda at the next JET meeting. In this way we hope to represent effectively to Government the interests of independent institutions of all types, covering HE, FE, sixth form, specialist, study abroad and university pathway providers. Study UK will be joined on the core JET group by the other key representative bodies (English UK, Universities UK, Guild HE and the UK Council of Colleges), as well as UKCISA and the British Council.&amp;nbsp;&lt;br /&gt;&lt;br /&gt;Most of JET's regular business will be conducted by the core group, while a wider stakeholder group will remain in operation for communications and annual meetings. &lt;p&gt;The report by &lt;a href="http://www.wildsearch.org/wild_research.htm"&gt;Wild ReSearch&lt;/a&gt;, 'Education: A Great British Export?', finds that tighter visa restrictions and the implied message that students are not welcome may already be impairing the UK's competitiveness in some of the world's most important markets. In a survey of Chinese school students and their parents, over 40% indicated that changes to the UK visa system would lead them to choose to study in rival countries such as the USA instead. Of particular concern was the imminent abolition of the Post-Study Work route, just as key competitor Australia is introducing its own PSW scheme.&lt;/p&gt;
&lt;p&gt;One of the authors, Graham Able, former head of Dulwich College and CEO of the Alpha Plus group of independent colleges, told &lt;a href="http://www.bbc.co.uk/news/education-17105028"&gt;BBC news&lt;/a&gt; yesterday that "the UK has some of the best colleges and universities, but we are in danger of losing market share to the US, Canada and Australia." His co-author, Fraser White, is an expert in exporting British education abroad through his Shangai-based company DCMI, which operates a number of British-model schools throughout East Asia, and shared his concerns that Chinese students were increasingly turning away from Britain towards American schools and universities.&lt;/p&gt;
&lt;p&gt;This new report, arriving soon after British Council research drew similar conclusions, emphasises the huge potential of the education sector to be a key driver of the UK's economic growth through exports, but also the real danger that recent successes could be easily reversed. The authors conclude that "long-term growth must not be sacrificed for the short-term political gains of government departments" and call for "a consistent approach across government to help promote and develop education from British providers".&lt;/p&gt;
&lt;p&gt;A key recommendation of the report is for official immigration statistics to show separately the number of students entering the UK, echoing a &lt;a href="http://www.timeshighereducation.co.uk/story.asp?sectioncode=26&amp;amp;storycode=418822&amp;amp;c=1"&gt;recent call by Universities UK&lt;/a&gt; to exclude students from the Government's ambitious target for reducing net migration. Study UK would strongly support such a move to enhance the transparency and usefulness of these statistics while avoiding the economic and educational disaster of artificially restricting student numbers.&lt;/p&gt;
&lt;p&gt;Study UK Association Manager Alex Proudfoot said: "the UK's long-term economic strength and global influence may very well depend on our ability and willingness to be the world's educator. Our centuries-long history of academic excellence cannot be matched by any other country, and it is an asset that we squander at our peril. Many leading figures in emerging nations are educated abroad and we should strive to ensure that British values and ideas inform their worldviews and that the UK is first in the line of potential partners for these thriving economies."&lt;/p&gt;</description><pubDate>Thu, 23 Feb 2012 00:00:00 +0000</pubDate><guid>http://www.study-uk.org/about-study-uk/latest-news-events/report-shows-uk-slipping-in-global-education-stakes/</guid></item><item><title>British Council warns Government on student visas</title><link>http://www.study-uk.org/about-study-uk/latest-news-events/british-council-warns-government-on-student-visas/</link><description>&lt;p&gt;New research published by the British Council yesterday has called into question Government policies aimed at reducing the intake of international students. &amp;nbsp;The Education Intelligence report &lt;a href="http://ihe.britishcouncil.org/ihe-exchange/visa-research"&gt;'Impact of Visa Changes on Student Mobility and Outlook for the UK'&lt;/a&gt; looks at the recent experiences of the USA and Australia in tightening student visa controls and the effect that it had on their higher education sectors and economies.&lt;/p&gt;
&lt;p&gt;It warns that the adoption of policies that other countries have now abandoned has "managed to single out the UK as the country with the toughest immigration regime when compared to its competitors" and risks losing "genuine and career-driven students" to Australia, Canada and the US. &amp;nbsp;The report warns further that "the publicity overseas of recent closures of private colleges is expected to have a negative impact on the UK education brand as a quality destination".&lt;/p&gt;
&lt;p&gt;Dr Jo Beall, director of education and society at the British Council, told &lt;a href="http://www.timeshighereducation.co.uk/story.asp?sectioncode=26&amp;amp;storycode=418963&amp;amp;c=1"&gt;&lt;em&gt;Times Higher Education&lt;/em&gt;&lt;/a&gt; that the Government's policies on student visas and post-study work needed "urgent review... if we're not going to undermine the economic benefit that higher education as an export sector brings" and accused the Home Office of favouring "short-term" goals over "the strength of our industrial innovation, our research and development base, [and] our reputation as a higher education provider".&lt;/p&gt;
&lt;p&gt;Study UK welcomes the British Council's valuable contribution to this ongoing and essential debate, and calls on the Government to respond with new measures to repair the UK's reputation as a country that welcomes international students and the economic, academic and cultural benefits they bring. &amp;nbsp;Alex Proudfoot, Study UK Association Manager, said: "Dr Beall makes an important point by recognising the essential part that private colleges play in giving students from diverse backgrounds a pathway into higher education. In &lt;a href="http://www.centreforum.org/index.php/mainpublications/299-tier-4-tears"&gt;'Tier 4 tears: how government student visa controls are destroying the private HE sector'&lt;/a&gt;, CentreForum issues a damning verdict on the effect of changes to the student visa system, which have been "devastating for many in the sector".&lt;/p&gt;
&lt;p&gt;Study UK's own research indicates that enrolments in the sector have dropped by around 70% as a result of the rule changes and interim cap on recruitment, costing some &amp;pound;400 million in lost tuition fees and an even greater impact on the wider economy. The CentreForum report concludes that "the government must act if we are to avoid seeing the destruction of much of the private HE sector in the UK" and calls for the reinstatement of part-time work rights for students at independent colleges.&lt;/p&gt;
&lt;p&gt;Picking up the story yesterday, &lt;a href="http://www.independent.co.uk/news/education/education-news/home-office-and-business-department-do-battle-over-overseas-students-6296340.html"&gt;the Independent on Sunday&lt;/a&gt; highlighted the disconnect between Home Office policies and efforts by the Department for Business, Innovation and Skills to promote more choice in Higher Education. As Chris Nicholson, CentreForum chief executive and the report's author, puts it: "the student visa controls make a mockery of the Government's aim to promote greater diversity in higher education. The private sector is being critically undermined."&lt;/p&gt;
&lt;p&gt;Study UK member Cavendish College is one of those forced to close by the squeeze on recruitment caused by Tier 4 changes and has been used as a case study for the CentreForum report. Its Principal, Dr John Sanders, told the Independent: "Withdrawal of these part-time work rights has really killed off recruitment for private colleges. They are clearing out a lot of good colleges as well as the bad".&lt;/p&gt;
&lt;p&gt;Alex Proudfoot, Study UK Association Manager, responded today: "It is very sad that a highly regarded college such as Cavendish has had to shut its doors after 25 years of providing an excellent education to students from diverse backgrounds. We share the Government's aim of protecting the sector from the profiteers that once thrived thanks to lax regulation, but we cannot support a sledgehammer approach that hits good institutions as hard as the bad. &lt;p&gt;Under Home Office proposals, international students on a university-accredited degree course taught at a private college will not have the right to work part-time to support their studies, whereas students doing exactly the same course at a university will.&lt;/p&gt;
&lt;p&gt;An uneven playing field is bad news. Private colleges that provide low cost degrees will struggle if they cannot attract international students.&lt;/p&gt;
&lt;p&gt;The CentreForum report &lt;a href="http://cminteractive.net/url/click?3VZeVNFtc=seed"&gt;Tier 4 Fears: Why government student visa proposals are unfair&lt;/a&gt; offers an alternative. International students studying degree courses at private colleges should have the right to work part-time, as long as the awarding university is prepared to sponsor the students' visa applications. That way, universities could continue to expand the scope of their degree courses through collaboration with the most suitable providers.&lt;/p&gt;
&lt;p&gt;Commenting on the Home Office proposals, CentreForum's Chief Executive Chris Nicholson said:&lt;/p&gt;
&lt;p&gt;&lt;em&gt;"The government is in real danger of shooting itself in the foot. Its proposals risk putting many private HE colleges out of business at a time when it wants them to expand and provide competition to universities to keep fees down."&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;Sue Hindley, Chair of Study UK, commented:&lt;/p&gt;
&lt;p&gt;&lt;em&gt;"High quality private sector colleges have proved they can provide a low cost solution for expanding higher education by working closely with UK universities. But many of my colleagues in the independent sector feel that the government&amp;rsquo;s plans might force them to close down in the next 12-18 months.&lt;/em&gt;&lt;/p&gt;
&lt;p&gt;&lt;em&gt;Study UK supports the government in targeting those organisations that have been causing a problem for immigration officials, but the new rules go too far and will penalise the good providers with the bad. If the government is willing to make some minor changes to their proposals they could ensure that genuine students who want to come to the UK to study are not deterred by draconian rules."&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;Key recommendations of the CentreForum report:&lt;/p&gt;
&lt;ul&gt;
&lt;li&gt;There should not be any discrimination in immigration law between private and public sector HE colleges. If a private sector college can prove it has a good record in admitting genuine students then its students should be allowed to work part-time just as they are at public colleges.&lt;/li&gt;
&lt;li&gt;The government should strengthen the student visa regime by allowing the universities that award degrees through private sector colleges to sponsor student visas directly at those colleges. This would mean that universities would only choose partnerships with reputable colleges or they would risk losing their right to sponsor visas with working rights.&lt;/li&gt;
&lt;li&gt;If a student gets sponsorship for their visa from a university then they should be allowed to work part-time, regardless of whether they are taught their degree at the university or through one of the university&amp;rsquo;s private sector partners. Discriminating against students at private sector colleges is unfair and will deter many international students from studying in the UK.&lt;/li&gt;

&lt;p&gt;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Initially, the discussion was to include pipeline or foundation courses and English language requirements, the former led to a discussion of HTS and the overall aims of the consultation so the English language requirement was not discussed. It was made clear that the protection of the Higher Education sector is important to ministers but that the premise for the consultation was to reduce net student migration.&lt;/p&gt;
&lt;p&gt;The UKBA are not minded to have a numeric cap on student migration at the moment but, with the aim of the consultation being to reduce the number of international students in the UK, if the proposals don't have an effect a cap could be considered in the future.&lt;/p&gt;
&lt;p&gt;The UKBA have had over 21,000 responses to the consultation document, largely from individuals, submissions from institutions and interest groups are expected. Following the consultation, the UKBA proposals will go to the Cabinet for approval and will be published in mid March. The 6&lt;sup&gt;th&lt;/sup&gt; April will be the first date for any changes to come into effect with the remaining being introduced over the following 12 - 18 months.&lt;/p&gt;
&lt;p&gt;Annual renewal of HTS was noted by Study UK as an impairment to long term business planning. It was suggested that HTS could be valid for up to 4 years with questions built into annual audits. It is likely that the level of study, below degree level, will be incorporated into the HTS framework.&lt;/p&gt;
&lt;p&gt;The UKBA wants to understand feeder courses and their importance for Universities so that they can better protect them. A clearer picture of student progression to degree level was requested.&lt;/p&gt;
&lt;p&gt;HTS will be one of the tools used to reduce net student migration and over the course of the next 18 months a new tier on the sponsor register, with more requirements, could be introduced.&lt;/p&gt;
&lt;p&gt;The accreditation process will be reviewed and will not be overseen by Ofsted but it is possible that the accreditation association will have both academic and immigration responsibilities.&lt;/p&gt;
&lt;p&gt;Some regions are seen to be higher risk than others and institutions should be wary of recruiting only in these areas.&lt;/p&gt;

&lt;p class="MsoNormal"&gt;Alongside representatives from UKCISA, UEA, English  UK, Universities UK and the National Union of Students, Sue Hindely,  Chair of Study UK, participated in a press conference on Wednesday 26  January. &lt;span&gt;&amp;nbsp;&lt;/span&gt;With the final date for responding to the UKBA consultation document on Monday 31&lt;sup&gt;st&lt;/sup&gt; January the press conference highlighted the potential damage the UKBA  proposals would have across the whole education sector. &lt;p&gt;&lt;strong&gt;ENGLISH UK WINS HIGH COURT JUDICIAL REVIEW CASE ON ENGLISH LANGUAGE COURSES UNDER THE POINTS BASED VISA SYSTEM&lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;More than 3,000 jobs and over &amp;pound;600 million a year in foreign earnings have been saved for the UK economy by a High Court judgement on which international students can come to the UK.&lt;/p&gt;
&lt;p&gt;English UK has today won its case in the High Court against the last Home Secretary's decision to raise the level of English which students must have before they can get a UK visa to learn the language here.&lt;/p&gt;
&lt;p&gt;On March 3 2010, the level was raised from elementary to intermediate (from A1 to B1 on the Common European Framework of Reference for Languages) for students who wanted to take courses of longer than six months and so needed a General Student Visa. They could no longer study on a course at a lower level than B2, roughly equivalent to A Level.&amp;nbsp; In effect, this meant that they had to have a good standard of English before they could come to the UK to learn it.&lt;/p&gt;
&lt;p&gt;The change was not directly put before Parliament, but was made through a paragraph in an appendix to the immigration rules which gave the UK Border Agency (UKBA) the blanket power to specify the minimum academic level of course which students can come to the UK to study on the General Student visa (GSV).&lt;/p&gt;
&lt;p&gt;In his written judgement, Mr Justice Foskett said anything which "changed materially" the criteria of entry for overseas students must be done through a change in the rules, and not through a change in the guidance.&lt;/p&gt;
&lt;p&gt;He agreed with counsel for English UK that a recent ruling from the Court of Appeal, on another immigration case, also applied to the way the language requirement was changed.&lt;/p&gt;
&lt;p&gt;The rationale for the judgment in the &lt;em&gt;Pankina &lt;/em&gt;case, Mr Justice Foskett said, was that 'a provision that reflects &lt;span style="text-decoration: underline;"&gt;a substantive criterion for eligibility for admission or leave to remain&lt;/span&gt; must be the subject of a process that involves a true Parliamentary scrutiny' (his emphasis).&amp;nbsp; The increase in the level of English was not in fact subject to Parliamentary process, but done through a change in administrative guidance.&lt;/p&gt;
&lt;p&gt;On this, Mr Justice Foskett said: 'I do not doubt that the changed approach in the new guidance &lt;span style="text-decoration: underline;"&gt;does&lt;/span&gt; operate to change materially the substantive criteria for entry for foreign students who wish to study English in the UK, and...that cannot be achieved by a change in guidance - it must be achieved through the medium of a rule change.'&amp;nbsp;&lt;/p&gt;
&lt;p&gt;He went on to conclude that 'extrinsic guidance cannot be used...to make a material or substantive change in existing immigration policy without the negative resolution procedure set out in section 3 (2) of the 1971 Immigration Act being implemented'.&lt;/p&gt;
&lt;p&gt;Tony Millns, Chief Executive of English UK, which represents 440 fully-accredited English language centres, said: "This judgement upholds our basic case that the Home Secretary was wrong to introduce a substantive change in the entry criteria for GSV students without laying that change before Parliament.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;"We have asked the court to rule that the English language requirement must now revert to what it was before 3 March, in other words students must be at level A1 to take an English language course at A2.&amp;nbsp; This will give our 440 member centres some immediate help since many of them faced losing a damaging number of students this summer and autumn."&lt;/p&gt;
&lt;p&gt;He added: "We brought this case as a last resort, and will now seek to discuss with UKBA ways in which we can help formulate a more sensible policy which our members can support and which will contribute to immigration control.&amp;nbsp; Genuine colleges have no desire to enrol people who are not genuine students.&amp;nbsp; We are pleased that Mr Justice Foskett saw the merits of our case and we believe that his decision is good for the UK economy, to which the English language sector contributes about &amp;pound;1.5 billion in foreign earnings each year."&lt;/p&gt;
&lt;p&gt;English UK's case was led by Nichola Carter of Penningtons Solicitors LLP and Judith Farbey of Doughty Street Chambers.&amp;nbsp; Commenting on the case, Nichola Carter, immigration partner at Penningtons, said: "Creating an immigration system which both denies entry to those with unlawful intentions and allows the UK to retain its reputation for world-class English language teaching is a complex process involving decisions of cultural and economic importance.&amp;nbsp; This ruling confirms that parliament must be included in decisions which will significantly change the immigration system.&amp;nbsp; In the months between the implementation of this unlawful policy and the hearing of this case, English UK continuously offered its assistance in creating a policy which was effective, sensible and lawful, and maintains that offer now."&lt;/p&gt;

&lt;p&gt;15 agents from Brazil, Chile, Colombia and Venezuela met with 12 Study UK member colleges in 15 minute one-on-one appointments, which were scheduled in advance using an online appointment system called eSchedule Lite. There were breaks for refreshments and lunch, where agents and educators could mingle more and get to know each other better. Study UK Chair, Sue Hindley, also provided the agents with a short presentation on the activities of Study UK and welcomed them to the workshop on behalf of the association.&lt;/p&gt;
&lt;p&gt;Feedback from members and agents alike was very positive. One member commented that the workshop was "a cost effective way to get to know a good selection of quality agents from South America", while an agent from Brazil said, "My opinion is that all schools and contacts were very important. I can use all of them in different cases and from each school I learnt a lot."&lt;/p&gt;

&lt;p&gt;The day began with a presentation by Study UK Chair, Sue Hindley, outlining Study UK's lobbying activities and meetings in recent months, our judicial review on HTS, and feedback on UKBA's Best Practice Recruitment document.&amp;nbsp;Sue also outlined some of her frustrations from a college principal's perspective, and&amp;nbsp;discussed further areas where lobbying is needed.&lt;/p&gt;
&lt;p&gt;Penny Salmon from Penningtons Solicitors LLP then provided an interesting presentation on problems and issues she finds when going to do compliance checks for Tier 4 colleges.&lt;/p&gt;
&lt;p&gt;To conclude the seminar, Nichola Carter, a Partner in Penningtons' specialist immigration team, provided a legal perspective to the discussions. She explained the balance of power between the government, the courts and Tier 4 sponsors and the powers and responsibilities of each. She then spoke about the UKBA's new Highly Trusted Sponsor Scheme.&amp;nbsp;&lt;/p&gt;

The mission took place on 9-10 February, and followed a scoping visit undertaken by English UK in November 2009, which identified significant opportunities for private colleges in the Sri Lankan market.&lt;/p&gt;

&lt;p&gt;Day one of the mission focused on understanding the Sri Lankan market. In the morning, delegates were briefed by Tim Davies, UKBA Entry Clearance Officer, and Janet Ford,&amp;nbsp;the Head of Trade &amp;amp; Investment at the British High Commission.&amp;nbsp;The group then&amp;nbsp;headed to the British Council to discuss opportunities in the education sector more specifically.&lt;/p&gt;
&lt;p&gt;A networking lunch was then held with 5 selected government officials, and this was followed by meetings with the Sri Lankan Board of Investment to find out more about government&amp;nbsp;incentives for private education providers wanting to set up in Sri Lanka.&lt;/p&gt;
&lt;p&gt;In the evening, a reception was hosted by the British Ambassador, Peter Hayes, at his residence.&amp;nbsp;Approximately 50 people attended from both government and industry, and this proved an excellent networking opportunity.&lt;/p&gt;
&lt;p&gt;On the second day of the mission, the focus shifted to doing business. Delegates met with about 15-20 companies which included agents promoting organisations locally to students wishing to go abroad, and organisations delivering courses locally looking for joint venture partners.&lt;/p&gt;
&lt;p&gt;Following the mission, Brink Gardner from Blake Hall College said, "I was personally overwhelmed by the response and the number of institutions wanting to work with us in partnership or collaboration. From a personal perspective, I can assure you that it has been more than fruitful."&lt;/p&gt;
&lt;p&gt;Study UK hopes to organise more outward missions for members in the future. &lt;p&gt;Delegates were split into two groups and enjoyed presentations from a number of speakers including&amp;nbsp;Bharat Pamnani&lt;strong&gt; &lt;/strong&gt;from the UK Border Agency, Steve Bristow, Head of Inspections at the BAC, and Nichola Carter, Partner at Penningtons Solicitors which specialises in immigration law.&lt;/p&gt;
&lt;p&gt;In addition, Sue Hindley, Chair of Study UK, shared her experience of using the Sponsor Management System, highlighting the difficulties she'd encountered in creating CAS&amp;nbsp;and providing tips for colleges from a practitioner's viewpoint.&amp;nbsp;&amp;nbsp;&lt;/p&gt;
&lt;p&gt;More than 150 delegates from over 120 institutions attended the event, and feedback was very positive.&lt;/p&gt;
&lt;p&gt;Fiona Cartwright from London International College said, "I enjoyed the talk by Nichola from Penningtons.&amp;nbsp;Sue from Study UK was also informative and actually went through system usage and misuse."&lt;/p&gt;
&lt;p&gt;Annika Tayler from ESCP Europe said,&amp;nbsp;"[It was] good to find out that other institutions have similar concerns and problems with these new rules."&amp;nbsp;&lt;/p&gt;

&lt;p&gt;More than half the membership attended, enjoying interesting presentations and&amp;nbsp;benefiting from&amp;nbsp;the chance to network with representatives from the broad spectrum of colleges within our membership.&lt;strong&gt; &lt;/strong&gt;&lt;/p&gt;
&lt;p&gt;The day began with&amp;nbsp;a buffet lunch and refreshments, kindly funded by UK Trade &amp;amp; Investment, which proved a&amp;nbsp;great way for delegates to get to know each other before&amp;nbsp;the formal proceedings got underway.&lt;/p&gt;
&lt;p&gt;Once everyone had finished lunch, delegates moved into the meeting room for welcome greetings by Study UK Chair, Sue Hindley, and BAC Chief Executive, Gina Hobson. They then&amp;nbsp;enjoyed a keynote presentation by Lord John Tomlinson, life peer in the House of Lords and Chair of AIHEP, on future public/private partnerships in higher education, and&amp;nbsp;were able to learn more&amp;nbsp;about the work of the UK Council for International Student Affairs (UKCISA) from Beatrice Merrick, Director of Services and Research.&lt;/p&gt;
&lt;p&gt;After a short refreshment break, discussions turned to Tier 4 and Study UK's representation and lobbying efforts. Members&amp;nbsp;were eager to hear Sue Hindley, who represents Study UK at the Joint Education Taskforce (JET), give an update&amp;nbsp;on recent developments and upcoming changes. &lt;p&gt;Study UK and the BAC jointly hosted an event called "Validating Internal Awards" at the Westminster Conference Centre on 14th October.&lt;/p&gt;
&lt;p&gt;The event was attended by approximately&amp;nbsp;150&amp;nbsp;educational institutions wanting&amp;nbsp;to find out what options are available to them for continuing to recruit international students onto programmes that currently do not fit the UK Border Agency's Tier 4 criteria for an approved programme. The UKBA has instructed that from 31 March 2010, only students studying on courses leading to approved qualifications will be eligible to receive a general student visa (as&amp;nbsp;stated in &lt;a href="../../../../media/workspace/files/UKBA_approved_qualification_requirements1.pdf" target="_blank"&gt;paragraph 200&lt;/a&gt; of the Guidance for Sponsors).&amp;nbsp;&lt;/p&gt;
&lt;p&gt;The day&amp;nbsp;began with welcome speeches by BAC Chief Executive, Gina Hobson, and Study UK Chair, Sue Hindley. This was&amp;nbsp;followed by a presentation by Neil Hughes, Director of the Economic and Family Migration Programme at the UK Border Agency.&amp;nbsp;Neil gave an update on Tier 4 PBS and&amp;nbsp;answered questions from attendees on all aspects of the new system.&lt;/p&gt;
&lt;p&gt;Following this, delegates enjoyed a buffet lunch kindly provided by UK Trade and Investment, before meeting with representatives of regulatory, awarding and validating bodies in the exhibition rooms.&lt;/p&gt;
&lt;p&gt;The Association of Business Executives, British Computer Society, Confederation of Tourism and Hospitality, Edexcel, Institute of Legal Executives, Institute of Business Consulting, Management Standards Centre, Middlesex University, Mindspring, NCC Education,&amp;nbsp;Open College Network (London Region),&amp;nbsp;Open University Validation Services, Sonis&amp;nbsp;and the Vocational Training Charitable Trust all had exhibition stands to provide information to colleges and discuss what options they have for continuing to recruit visa students onto currently unapproved programmes.&lt;/p&gt;
&lt;p&gt;Study UK also had an exhibition stand to promote our services to BAC accredited non-member colleges, where we handed out our membership flyer, professional services handbook and agent brochure.&lt;/p&gt;
&lt;p&gt;Seminars&amp;nbsp;continued in the afternoon, with Alan Sampson and James Gregory from Edexcel presenting a session about selecting&amp;nbsp;external awards.&amp;nbsp;Martina Wilson from OUVS&amp;nbsp;then presented&amp;nbsp;"Institution and programme validation by Open University Validation Services" and Sue McGlynn from Ofqual discussed how colleges can become awarding bodies. There was also a panel discussion, which was chaired by the BAC's Head of Inspection Services, Steve Bristow, and included&amp;nbsp;representatives from Southampton Solent University, CATS Cambridge, QAA and the Study UK Chair, Sue Hindley.&amp;nbsp;Please scroll down to download a copy of the event programme.&lt;/p&gt;
&lt;p&gt;Feedback from&amp;nbsp;educational institutions and exhibitors alike&amp;nbsp;was very positive, despite the broad range of needs and expectations of those who attended. One college commented, "UKBA representatives and OU Validation Services were knowledgeable and informative." Another commented that the event provided "reassurance that a lots of us are so unsure of many aspects of change, especially from April 2010."&lt;/p&gt;

&lt;p&gt;The agents met with 10 Study UK member colleges in 20 minute one-on-one appointments, which were scheduled in advance using an online appointment system called&amp;nbsp;eSchedule Lite.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;There were breaks for refreshments and lunch during the day, where agents and educators could mingle more and get to know each other better. Study UK Board member Simon Cleaver also gave a short presentation about the activities of Study UK and the advantages of studying at an independent college.&lt;/p&gt;
&lt;p&gt;There was a very productive and friendly atmosphere during the&amp;nbsp;day - feedback from agents and members alike was very positive. One member commented, 'This was an excellent opportunity to meet a range of agents, with nothing but a day away from the office.'&amp;nbsp;&lt;/p&gt;

Students and parents were particularly interested in finding out more about foundation programmes, top-up degrees and postgraduate courses. The Study UK brochure, which was recently produced in cooperation with UK Trade &amp;amp; Investment, proved popular and nearly all were picked up by attendees.&lt;/p&gt;

&lt;p&gt;In the morning, representatives from BAC, Study UK, Ofqual, etc will go through the current situation and your options. In the afternoon these organisations, and other awarding and validating bodies, will have stalls at an exhibition where you can get information from them, network with colleagues and decide on your course of action.&lt;/p&gt;
&lt;p&gt;The conference will take place at Westminster Conference Centre, 1 Victoria Street, London SW1H 0ET on Wednesday 14 October. &lt;p&gt;GETEX is the Middle East's largest education, training, professional development and education supplies technology event. This year, there were 403 exhibitors and 31,129 visitors to the event over the four days.&amp;nbsp;&lt;/p&gt;
&lt;p&gt;Visitors to the Study UK / English UK exhibition stand&amp;nbsp;included students, parents, agents and working professionals, from a wide&amp;nbsp;range of countries in the region. The stand was very popular and nearly all Study UK member brochures were picked up by attendees.&lt;/p&gt;
&lt;p&gt;This was the first joint marketing opportunity that Study UK has undertaken for members. &lt;p&gt;A&amp;nbsp;password-protected secure area allows members to keep up-to-date with industry news, download logos and other important documents, as well as find out about joint promotional opportunities.&lt;/p&gt;
&lt;p&gt;With an online application form and more detailed information about the benefits of membership and current subscription fees, the website also makes it easier for BAC-accredited colleges to join Study UK.&lt;/p&gt;

&lt;p&gt;The event was led by the Chairman of Study UK,&amp;nbsp;Sue Hindley, along with Study UK Association Secretary Tony Millns, BAC Chief Executive Stephen Vickers and other members of the Study UK Board. 16 out of the association&amp;rsquo;s 43 members were in attendance.&lt;br /&gt;&lt;br /&gt;The event began with a presentation about Study UK&amp;rsquo;s past and present activities, current membership numbers, and the association&amp;rsquo;s future direction. Members were encouraged to share their opinions and discuss priorities for Study UK going forward.&lt;/p&gt;
&lt;p&gt;An update on the new Points Based System for student visas, which will go into effect at the end of March, was then led by Study UK&amp;rsquo;s Chairman Sue Hindley. Members had the chance to hear from those representing Study UK members&amp;rsquo; interests in the various government forums and receive up-to-date information on the changes, while also having the opportunity to put forward their opinions and ask questions. After the formal discussions were concluded, members were able to network and discuss common issues over refreshments.&lt;br /&gt;&lt;br /&gt;The event was a huge success, with positive comments received from all who attended.
