<p> In the theoretical sense, an immigrant is a person who has been born in a particular country but has parents of foreign origin. He or she may also be an individual who crosses the border of a particular country and enters with the intention of remaining there. This means that the person has traveled to become a part of the population by means other than by birth. People cannot be termed as immigrant to United States of America more than once. Implication of any statistics depends mainly on interpretation of the unit in which the statistics are expressed.</p>

<p>The statistical and administrative meaning of immigrant has not been fixed by the statute law, but is derived by definitions and meanings put forth by Bureau of Immigration. These meanings and definitions may also depend and vary with the law and administrative decisions.</p>
<p>Official statistics of immigration are subject to certain qualifications, which reflect imperfectly on the total immigration. Various agencies provide statistical information about immigration. There are professional statistical organizations that review statistical methods adopted by such agencies, programs, data, products, and priorities. Most organizations include guidance and suggestions given by statistical agencies and data could be shared with other users.</p>
<p>Immigrants in the statistical meaning is termed for a person who is liable to pay head tax. Immigration statistics is indicated in figures and these figures indicate net increase in population due to immigration. This data is true for an increase projected in the last eight years. Figures quoted have been slightly more than two-thirds of the calculated immigration. These figures increase by an estimated amount if people arrive by land.</p>
<p>The estimated number of immigrants is approximately 3,750,000, instead of 4,820,000 since 1898-1905. 			<content:encoded><![CDATA[<p>Choosing a Law School can be a difficult decision. Besides the obvious things such as ranking, expense, location and reputation many potential law students are interested to know what famous attorneys came from the schools they are thinking of attending. Yet, unless someone does independent research on numerous institutions or wants to research the backgrounds of a particular attorney they are a fan of there is no real good resource that provides such information. To remedy this, I thought I'd pick out a handful of my favorite attorneys and list where they got their Juris Doctors from.</p>
<p>My personal favorite attorney has to be former California Prosecutor Vincent Bugliosi of 'The Manson Murders' fame. Mr. Bugliosi was able to convict Charles Manson despite the fact that Manson never was actually at the crime scene and committed his crime by brainwashing and planning the Tate/La Bianca murders from afar. He has since gone on to be an internationally acclaimed writer beginning with the legendary 'Helter Skelter' and including the more recent 'Outrage' and 'The prosecution of George W. Bush For Murder'. Vincent Bugliosi attended UCLA Law School and graduated in 1964.</p>

<p>Next up is the famous 'country' lawyer and tv commentator, Gerry Spence. Mr. Spence is well known as a commentator during the OJ Simpson trials and has the distinction of having never lost a case in 40 years. He attended the University of Wyoming Law School gaining his degree in 1952. He is known for pioneering the 'Matlock' style of 'narrative' lawyering. He uses stories, allegories, metaphors and carefully crafted emotional hooks to convince a jury of his convictions.</p>
<p>No list would be complete without Professor Alan Dershowitz of Harvard Law School. Besides his role in the OJ trial, Mr. Dershowitz has obtained a reputation as a great civil liberties lawyer. He graduated first in his class at Yale Law School and was Editor-in-chief of the Yale Law Journal. He has one of the most prestigious client lists of any attorney including such notables as Michael Milken, Leona Helmsley, Mike Tyson, Penthouse, Patricia Hearst, John Landis and even fellow attorneys F. Lee Bailey(Boston University Law School 1960) and William Kunstler(Columbia Law School).</p>
<p>Speaking of the OJ Simpson trial, Johnnie Cochran attended Loyola University School of Law in Los Angeles as did the fiery tv and radio commentator Gloria Allred. Barry Scheck of the 'Innocence Project' at Cardozo Law School got his degree at UC Berkeley School of Law. Robert Shapiro, OJ's lawyer through much of the early stages of the trial attended UCLA Law School. On the other side of the court, Marcia Clark attended Southwestern University School of Law and Christopher Darden attended the University of California, Hastings College of The Law. Finally on the other side of the bench, judge Lance Ito obtained his law degree from UC Berkeley (1975).</p>
<p>Finally, I thought I'd throw in some of my own personal favorites mostly based on their accomplishments and personality. I'm a big fan of the radio host Larry Elder and Larry got his JD from the University of Michigan School of Law in 1977. His sometime rival on KABC radio is civil rights attorney Leo Terrel who attended UCLA School of Law. Since Larry's been off the air I've become a fan of Mark Levin who got his JD from Temple University. Mark has achieved tremendous success over the past two years and most recently authored his best selling book 'Liberty and Tyranny'. </p>

For this reason, it is more important than ever that the criminal defense of a noncitizen focus not just on minimizing time in custody, but equally on avoiding the deportation that the noncitizen may face upon completion of their sentence. In California, criminal defense attorneys are required to inform their noncitizen clients of the actual immigration consequences involved in the particular defense strategy, such as a plea agreement. However, it is not uncommon to find that the client has not in fact received that critical information.</p>
<p><span id="more-621"></span></p>
<p>Far too often the immigration consequences have not been taken into account because the attorney does not see their job as including a defense of the client from the severe immigration consequences. That being said, there are many criminal defense attorneys who are skilled at providing a defense that attempts to mitigate the possibility of deportation at the same time as reducing the possible time spent in custody. For clients who have a history that includes criminal conduct it is important to determine the exact immigration consequences of that activity prior to traveling or filing an application with USCIS. Either is these actions can bring the existence of the criminal conduct to the attention of USCIS, and this can result in very drastic consequences.</p>
<p>At the less disastrous end of the spectrum of these immigration consequences is the inability to establish the required "good moral character" due to criminal conviction or conduct. This might prevent an applicant from being approved for naturalization, and it operates to prevent applicants from qualifying for a number of forms of relief from deportation in immigration court. At the other end of the spectrum of immigration consequences are the grounds of deportation for such activity. The dreaded "aggravated felony" crimes are among the worst examples of this movement toward exile of noncitizens for crimes that don't necessarily carry long sentences when committed by citizens. In addition, a person who returns to the U.S. without authorization after deportation for an aggravated felony faces a potential 20 year federal prison sentence, and United States Attorneys are increasingly prosecuting such cases.</p>
<p>The immigration consequences of criminal activity are grouped into the two broad categories of inadmissibility and deportability. The grounds of inadmissibility apply principally to applicants who are seeking a benefit from immigration such as admission to the U.S. at a port of entry, permanent resident status, citizenship, or a visitor visa. The grounds of deportability apply principally to those who already have status in the United States and are at risk of having that status taken from them in the process of being deported. However, someone with permanent resident status may face the grounds of inadmissibility upon attempting to return to the U.S. after a vacation. These crimes include quite minor drug offenses and crimes deemed to evidence "moral turpitude." For this reason, it is extremely important to consult an immigration attorney prior to travel, if the traveler has a history of criminal convictions.</p>
<p>DRUG OFFENSES<br />Drug offenses, even those which are quite minor, such as being under the influence, can result in both inadmissibility and deportability. Sale of a controlled substance or possession of a controlled substance for sale are both aggravated felonies and can trigger deportation. In addition, a state drug conviction that is analogous to a federal drug offense in the aggravated felony definition counts as an aggravated felony. Conviction of an offense "relating to a controlled substance" will also cause deportability and will cause inadmissibility for one who is not already admitted or for a lawful permanent resident who is returning from travel. And, even without any conviction, a determination of drug addiction or abuse after being admitted to the U.S. will cause deportability.</p>
<p>And, again, even absent a conviction, one who is a drug addict or abuser is inadmissible to the U.S., or if Immigration has "reason to believe" that she has assisted a drug trafficker or has benefited from such activity as the spouse or child of a trafficker. Finally, admission of all of the elements of a controlled substance conviction will also cause inadmissibility. A conviction of simple possession or even possession of paraphernalia will cause deportability and inadmissibility, unless the conviction is eliminated through state rehabilitative relief.</p>
<p>Crimes involving moral turpitude</p>
<p>The term, "crime involving moral turpitude" (CMT) refers to a classification of crimes which cause both inadmissibility and deportability for non-citizens, even when these same offenses would not be severely punished if committed by a U.S. citizen. It is not uncommon for crimes of moral turpitude to also be classified as aggravated felonies, when a sentence of a year or more has been imposed.</p>
<p>A crime is often classified as involving moral turpitude when there is an intent to defraud or to steal, to cause great bodily harm, where there is "malice", or where there is a "lewd intent." One conviction of crime of moral turpitude causes inadmissibility. The same is true for the admission of committing the offense, even without a conviction. The exception to this harsh rule is what is known as the "petty offense exception" for one CMT carrying a maximum possible sentence of one year and for which the noncitizen received a sentence of no more than six months.</p>
<p>A noncitizen is deportable if convicted of one CMT committed within five years after last admission to the U.S. for which a sentence of one year or more could have been imposed, or for two CMT convictions at any time after admission which did not arise out of a single scheme of criminal conduct regardless of the length of sentence. It is possible to be deportable but not inadmissible for a CMT. This means that a noncitizen is eligible to apply for adjustment of status to that of a lawful permanent resident in removal proceedings, even though he or she is deportable.</p>
<p>A noncitizen is inadmissible if he or she has been convicted of two or more offenses of any type for which the aggregate sentences to confinement actually imposed equaled five years or more. This will also be a bar to a finding of good moral character for purposes of naturalization, VAWA and other forms of relief, though in some cases a waiver may be available.<br />Conviction for domestic violence, regardless of the sentence imposed, is a ground of deportability. Domestic violence is not necessarily a CMT, unless actual infliction of harm or intent to cause serious bodily harm are proven.</p>

<p>immigration including new arrivals and their children accounts for an increase of about 1.5 million more people a year, which represents more than half of the total U.S. population growth. Today the debate of immigration in the United States is seemly never ending. There are many reasons that explain why people are boiling over the issue of illegal immigration. Many of the claims in my two articles states that illegal immigration threatens jobs and lower wages. In the articles, there are many ways in which economists convey their ideas to deal with the issue of immigration's effect on the job market. Some of their ideas include deporting all illegal immigrants back to their native countries, making immigrants pay for penalties, and building a computerized electric fence that would indicate where the immigrants would cross the border. Both of the articles express concerns about this debate and presents many ideas on possible solutions to this issue. However, many of the articles lack evidence, objections, and rebuttal to their reasonability of the debate. Another very important element that most articles lack is giving the appropriate reasons as to why their claim or statement is sufficient.</p>
<p><span id="more-619"></span></p>
<p>One example of an article that lack evidence, objections, and rebuttal to its claims is an article written by an unknown journalist at the Wharton School of Finance on a Cornell University professor, Professor Briggs - who opposes to illegal immigration. In this article, The Immigration Debate: Its Impact on Workers, Wages, and Employers, Professor Briggs speaks about sending messages to illegal workers through their employers by "clamping" the employers down who hired them so that a clear message is sent to the workers that illegal immigration is not to be tolerated. His claim is that "illegal workers exert downward pressure on wages and reduce job opportunity for low-skilled citizens." As mentioned earlier, this article lacks objection, evidence, and rebuttal. This professor failed to mention the effects of immigrant workers on wages and working conditions in other parts of the world. He also failed to explain why illegal immigrants force down wages by simply responding "that's how the market works." The author and the professor clearly failed to provide any justifiable reason or evidence as to how the market works.</p>
<p>A further example of another University professor with plenty of bold statements but not enough evidence and not willing to take in hand other ideas is Bernard Anderson, professor in Wharton's management department. Professor Anderson on the hand supports the topic of immigration. In the same article provided by the Wharton School of Finance, Professor Anderson claims that "illegal immigrants work hard, do not come to the United States to receive welfare, and should be allowed to remain in the U.S. after paying penalties." He then later on states that "while illegal workers do have some effect on wages and displace some American workers, their impact is far less dangerous than what professor Briggs assert." He agreed with Professor Brigg's statement that illegal workers do force down wages however Professor Anderson failed to explain why the U.S. economy needs such low-skill immigrant laborers to do such kinds of work. It is clearly a political question at this point. If we want to benefit low-skill American workers, we must reduce the amount of illegal immigration and the opposite would be done if we want to benefit immigrants in the United States.<br />The second article is written by Thomas Lifson called The Neglected Truths of the Immigration Debate. In this article, he states very good claims in which "Poor and unskilled immigrants are expensive for the rest of society." He then followed to provide good evidence that the "net cost for just ten million illegal immigrants at $2.6 trillion, and more if the number is 12 million or higher. " However he failed to mention any kind of objection or rebuttals in this article. This article is mainly a one sided fact source that clearly opposes to the topic of immigration. It acknowledged other options that may possibly be solutions to solving the issues of immigration but failed to provide reasons for his claims. As this topic of immigration is heating up, it is important to know the reasons behind claims.
