Walking away and stating new is not so bad as many large corporations are doing so as the math is simple. Why should individuals be any different? Loan Modification Not Working?

No one wants to lose their home, period. After all this is our dream home, we raise family here, we invite extended family and friends over for the holidays and on Sundays to watch football. But are we living in a house of cards? Is the writing on the wall but we fail to heed the inevitable for our blinders?

A Loan Modification is a great way to stay in your home, but only if the bank can get it right and modify your loan. They are reluctant to modify the loan balance, they are hesitant to modify the interest rate, after all they don’t want to lose any money. But as long as we keep our payment current the bank knows that we can keep the principal, rate and terms they dished out.

The HAMP program is here to make homes affordable! It’s an easy formula, simply take all of your monthly gross income and multiply it by 31% this will give you the amount that your mortgage must be to meet the criteria for a modification. This is assuming no other debt such as car payments, credit cards etc. If you do have a $400 a month car payment then you must bring in an additional $400 a month gross income to maintain that 31%, ditto for credit cards, etc.

If you run the numbers and you fit the criteria than you are a prime candidate for a loan modification. So lets say my wife and I gross $12,000 a month. This means that my mortgage payment can not exceed $3,720 per month. If I were to get a 5% interest rate my loan amount would need to be $625,906. If I have a jumbo loan say over 1 million dollars on a home I must ask myself will the bank modify my loan to $625,906? If not, then now is the time to think about plan “B”. The sooner you begin plan “B” the sooner you are working towards plan “A”.

California expands $10K buyer tax credit

The state of California has re-established and extended a $10,000 homebuyer tax credit.

The new law, AB 183, signed today by Gov. Arnold Schwarzenegger, allocates $200 million to the credit for homes purchased between May 1 and Dec. 31, and between Dec. 31 and August 1, 2011. That’s twice the amount allocated to a similar credit passed for purchasers of new homes last year. Those funds were quickly depleted and builders have been asking for the credit’s return ever since. Obama Fails American Homeowners

Today the Washington Post announced that the Obama administration has essentially failed in helping out American Homeowners with the highly touted Making Homes Affordable program. The Treasury Department initially said the program would reach as many as 4 million struggling borrowers. But a report issued on Tuesday claims the Treasury Department is now expecting that number to drop to 1.5 – 2 million homeowners.

The Obama administration launched the program that was to tap $50 billion from TARP and another $25 Billion from Freddie Mac and Fannie Mae, the mortgage financing companies. But so far fewer than 200,000 borrowers have received permanent loan modifications. In a recent report the Congressional Budget Office says only $31 million has been spent and expects only $20 Billion of the TARP money to be used.

The administration is now encouraging borrowers to consider short sales for homes that are over leveraged. Read it here from The Washington Post.
