Yudhoyono: second term, first crisis

THIS was to have been Susilo Bambang Yudhoyono’s second honeymoon. Inaugurated for a second presidential term last month after a landslide election victory in July, he should have been basking in his recent international popularity and preparing for a regional summit in Singapore. Instead, he has been consumed by the fallout from a political scandal. On November 2nd he set up a team to look into an investigation by the police of members of the Corruption Eradication Commission, known as the KPK. The commission’s high-profile prosecutions had helped improve the country’s corrupt image and boosted the president’s standing.

Mr Yudhoyono was responding to mounting public pressure and street protests that followed the arrest of two KPK deputy chairmen on dubious charges of abuse of power and extortion. This was the culmination of a months-long feud pitting the KPK against the national police and the attorney-general’s office. The two KPK officials, Chandra Hamzah and Bibit Samad Rianto, were accused of taking bribes from Anggoro Widjojo, a corruption suspect, so that he could flee abroad. They say their arrests were part of a plot to frame them and weaken the KPK.

A day after Mr Yudhoyono announced the investigation, a nationally televised court hearing broadcast more than four hours of tapped telephone conversations compiled by the KPK. They featured a man believed to be a state prosecutor, Mr Anggoro’s brother, who is an important police witness, and other unnamed figures. They suggested a plot to frame the KPK officials. Speakers also cited the president as backing the moves against the KPK. Within hours of the broadcast, the two KPK men were freed from jail (but remain under investigation). Mr Anggoro’s brother was detained for questioning.

The scandal is overshadowing all Mr Yudhoyono’s plans for economic reform, and denting the mood of optimism that followed his re-election. His government has run an international television campaign touting Indonesia’s transformation from South-East Asia’s basket-case ten years ago into its leading democracy. The president’s election platform focused on the rule of law, fighting corruption and wooing foreign investment.

Critics say the KPK was seen as going too far, gunning for Mr Yudhoyono’s political enemies and settling old scores with rivals in the police and attorney-general’s office. The fight has been extremely personal: the chief police detective, Susno Duadji, whose phone was tapped by the KPK in another corruption probe, famously compared KPK attempts to take on the police to “a gecko versus a crocodile”. Now Mr Susno himself has resigned under a cloud, as has the deputy attorney-general.

The worry is that the scandal could cripple Mr Yudhoyono’s second-term agenda. Few doubt that it shows how the police and attorney-general’s office, widely regarded as among Indonesia’s most corrupt institutions, need serious reform. Worse, the revelations—including the suggestion that one of the KPK officials might be killed in jail—show that the bad habits of the authoritarian Suharto regime still haunt Indonesia a decade after its fall.

After setting up his investigative team, Mr Yudhoyono promised to “uphold legal supremacy”. But it is still not clear that he grasps the severity of the crisis. He is known for his willingness to share political spoils and his preference for consensus. In this case, however, the public seems to yearn for confrontation: to see him take on the rot in Indonesia’s legal framework, and get rid of it.

Indonesia Officials Resign in Graft Scandal

JAKARTA, Indonesia — After mounting pressure from the public and the news media, two senior law enforcement officials suspected of trying to undermine the country’s respected anticorruption agency were forced to resign Thursday.

Advocates of government accountability said the resignations of top officials in the national police and the attorney general’s office — two of Indonesia’s most powerful, though corrupt, institutions — were a positive step in the country’s fight against graft.

The resignations were the culmination of a very public, four-month-long battle that pitted the police and the attorney general’s office against the Corruption Eradication Commission, the nation’s chief investigator into corruption. The dispute was seen as a test of President Susilo Bambang Yudhoyono’s commitment to stamp out corruption.

Despite praise for his anticorruption drive during his first term, Mr. Yudhoyono, who was re-elected in July, has been criticized by watchdog groups for distancing himself from the recent clash. Mr. Yudhoyono was forced to intervene Thursday after wiretapped conversations, disclosed in court this week, exposed what appeared to be a plot by police officials and prosecutors to fabricate a case against two senior anticorruption officials.

In a cabinet meeting, Mr. Yudhoyono said he “advised the police chief and the attorney general to suspend those whose names were mentioned in the tape recordings and discharge them from their duties.”

Later, using stronger language, he said he wanted to rid the country of the “legal mafia,” a reference to the pervasive corruption in the judiciary and law enforcement.

But anticorruption advocates said that, given the president’s initial response, it was unlikely that he would push more far-reaching reforms inside the national police and attorney general’s office in his second term.

“The K.P.K. received a lot of support from the public but not from the government,” said Danang Widojoko, a coordinator at Indonesia Corruption Watch, a private organization, referring to the anticorruption agency by the initials of its name in Indonesian. “It was the failure of the president to handle this situation in the beginning that led to the current problems.”

The officials, Abdul Hakim Ritonga, a deputy attorney general, and Commissioner General Susno Duadji, a high-ranking police official, resigned Thursday after being named in wiretaps whose contents were submitted during a hearing at the Constitutional Court on Tuesday and broadcast live on television. The police chief and the attorney general said both men had resigned, but Mr. Ritonga said later that he was stepping down only as deputy attorney general. Both men have yet to comment on the wiretaps.

Mr. Susno had become the central figure in the police’s fight with the anticorruption agency after being caught in a wiretap asking for a $1 million bribe in a case. Mr. Susno denied that he had been serious about the bribe and, referring to the anticorruption agency’s investigation of the police, likened it to “a gecko challenging a crocodile.”

Though comparatively small, the agency, armed with tools like warrantless wiretaps, has led the nation’s charge against corruption since it was established in 2003. It has investigated, prosecuted and convicted businessmen, politicians and bankers, as well as prosecutors and police officials.

Watchdog groups have long said that politicians, prosecutors and the police were trying to cripple the agency.

The events that led to the resignations on Thursday were set in motion last week with the arrests of two deputies at the anticorruption agency on charges of graft and abuse of power.

The arrests prompted outrage among anticorruption advocates, as well as on the Internet and in Indonesia’s news media.

Ini seharusnya menjadi bulan madu kedua Presiden SBY. Demikian The Economist mengawali tulisannya. Dilantik bulan lalu setelah kemenangan mutlaknya dalam pilpres, SBY seharusnya menikmati poularitas internasional dan bersiap untuk pertemuan tingkat tinggi regional di Singapura. Namun SBY malah dihadapkan pada skandal politik yang melibatkan KPK, kepolisian dan kejaksaan agung.

Masih menurut The Economist, skandal ini menenggelamkan rencana-rencana SBY untuk reformasi ekonomi serta mengurangi optimisme menyusul terpilihnya kembali SBY.

Skandal ini bisa melumpuhkan agenda pemerintahan SBY. Ada yang menganggap skandal tersebut memperlihatkan bagaimana kepolisian dan Kejaksaan Agung sangat membutuhkan reformasi serius. Parahnya lagi, skandal tersebut menunjukkan bahwa kebiasaan-kebiasaan buruk rezim Soeharto masih menghantui Indonesia.

Setelah membentuk Tim 8 untuk menyelidiki skandal tersebut, SBY berjanji akan mempertahankan supremasi hukum. Namun menurut The Economist, masih belum jelas apakah SBY memahami beratnya krisis ini. Apalagi SBY dikenal akan kesediaannya untuk berbagi keuntungan politik dan preferensi untuk konsensus. Dalam kasus ini, publik ingin melihat SBY mengatasi dan menyingkirkan kebusukan dalam kerangka hukum Indonesia.

Media-media asing lainnya juga menyoroti skandal ini. Di antaranya Wall Street Journal juga mengangkat skandal politik ini dengan judul: "Tapes of Alleged High-Level Conspiracy Electrify Indonesia". Koran The New York Times dengan judul: "Indonesia Officials Resign in Graft Scandal". JAKARTA - Thousands of Indonesians have taken to the streets in the past week to protest the arrests of two anti-corruption commissioners and demand that President Susilo Bambang Yudhoyono take a stand against graft in a nation with a long history of bribery and political shenanigans.

The demonstrations are a stark reminder of those that occurred more than 10 years ago, when Indonesians rallied to demand the ouster of dictator Suharto. This time, the weight of remonstration is digital, in the form of a Facebook group.

The popular social networking site claims a small but rapidly growing market in Indonesia, the world's seventh-largest Facebook community with 8.52 million users, according to data compiled by Google Trends. The growth rate is fast - 8.23 million

joined in the past 12 months alone.

After two members of the Corruption Eradication Commission, better known as KPK, were arrested last Thursday, more than 350,000 people joined a Facebook page in support of the deputies. Thousands more signed up throughout the day and new comments have been posted to the wall almost every second. Public demonstrations have since been held, but they've drawn nowhere near the support seen on Facebook.

By Friday morning, a week after the site launched, it was well on its way to reaching one million members, with more than 925,000 people having signed up by 9am. Wall posts have ranged from outrage toward the police - "Confess now, then ask forgiveness later", wrote Agus Sutragus - to pleas for the president to "defend the people's struggle" and to root out corruption for the good of the country.

The site's main goal, according to creator Usman Yasin, is to push for law enforcement reform in Indonesia. The corruption scandal continues to swirl, raising daily intrigue and conspiracy theories. But what many analysts here are now discussing is how people have democratically responded to an event that has created mass public dissatisfaction and could, they say, significantly undermine the social and political stability that recently re-elected Yudhoyono struggled to rebuild during his first five years in power.

"Now we have a new model on how to control our government," said Teten Masduki, the secretary general of Transparency International in Indonesia and a part of the team summoned by the president on Sunday to advise him on an appropriate response to the uproar. "With new technology it's easy to share our dissatisfaction with the president: just update your status."

Teten also highlighted the importance of a change in election laws that saw politicians directly elected by voters for the first time in the 11 years since democracy has taken hold in Indonesia. He remains sanguine about the potential for Facebook and other on-line social networking sites to mobilize public opinion.

"People want to say we support the KPK and we believe justice will win. Facebook has become a political indicator of that," said the anti-corruption activist, who worked with a popular Indonesian band to release a ringtone Wednesday in support of the KPK. In the first few hours after its release, more than 40,000 people had used the jingle.

After decades of authoritarian rule under Suharto, which included a stranglehold on independent media, Indonesia now enjoys greater freedom of speech and more open political debate in the news arena.

The Internet increasingly plays a critical role as a platform for independent debate, "so much so that mainstream media are left with no choice but to start reporting issues that are causing waves in cyberspace," Jakarta Globe columnist Karim Raslan wrote on Thursday. He believes that the pushback from civil society shows people are not as complacent as they seem, and this could prove a challenge that will keep Yudhoyono on his toes throughout his second term.

Many politicians also have recognized the importance of the Internet, and several took their campaigns online during the July presidential elections as a way to win over young voters. New information minister, Tifatul Sembiring, says he sends out daily tweets on Twitter, a site that allows people to post short thoughts or questions.

'Game-changing' agent
Some see Facebook users as a strategic segment of society and believe a presence on the site increases their access to Indonesian youth as well as high-level bureaucrats and businesspeople who can influence public information. Other analysts say the latest Facebook showing is more proof of digital media's power, not only among Indonesian youth, but also among those who lost faith in the independence of mainstream media during the Suharto years and now prefer the Web for independent news and analysis.

"The Internet is a 'game-changing' agent even in a polity such as Indonesia where the media is relatively free," wrote Karim.

But whether online activism translates to political action remains to be seen. Some suggest it may be just a passing fad, pointing out that the majority of Facebook users in Indonesia are already well-educated, well-informed members of the middle class. That automatically makes them more likely to take an interest in politics and seek to influence politicians through outlets outside of Facebook.

Others say the swelling support seen on Facebook pushed Yudhoyono to assemble a fact-finding team into the allegations on Monday. But it was ultimately the public dissemination through court hearings of wiretapped conversation indicating that senior police and attorney general's office officials may have been complicit in a plot to undermine the KPK that led to the two commissioners' release on Tuesday.

This is not the first time Facebook has played a role in public protest in Indonesia. In July, thousands signed up to support Prita, a mother of two who was accused of criminally defaming an international hospital in an e-mail that criticized the facility's treatment. Whether or not the Facebook support made a difference, it did draw attention to Prita's case, with nearly 60,000 supporters signing up to the Facebook group calling for her freedom. When she was eventually released from jail, many social activists credited the campaign sparked by Facebook.

Other on-line protest groups include an anti-polygamy coalition started after a controversial global polygamy club launched a branch in Indonesia in mid-October. Indonesia Unite, which launched a page as a way for Indonesians to take a stand against terrorism following the Marriott and Ritz Carlton hotel bombings in July, has since participated in a blogging conference and launched its own T-shirts, pins and stickers in an effort to gain a presence outside the Web.

While Facebook has become a prime way of coordinating people and promoting public awareness campaigns, the Internet still only reaches around 10% of Indonesia's 240 million people. Mobile connectivity is greater, with nearly 60% of Indonesians owning a cell phone, and the explosion of portable Web devices such as BlackBerrys have given more people access to Facebook and Twitter, allowing them to update their status on the go.

The low cost of such devices also opens Facebook to a wider swath of society, giving more citizens access to tools that help them shape not only the news but also the way the government responds to their demands. Public arguments on the social networking site have also raised debate about how the country's draconian electronic information law can best be applied in the new digital age.

After one week of solid support for the KPK deputies, in democratic fashion, one Facebook user posted a comment that backed the other side: "Go Indonesian police, swallow those geckos alive," wrote the user, referring to a derogatory term used to describe the KPK. Hundreds of angry comments followed the post, while others reminded members to the group that Indonesia is now a country that embraces free speech.

But the corruption scandal and the online response has revealed a rift in society that Transparency International's Teten said is becoming more polarized. "You can see the president is behind the police and the attorney general while the people are behind the KPK." It's an expression of popular dissent that wouldn't have been possible under the authoritarianism of Suharto, or before the advent of Facebook.

Corruption bomb explodes in Indonesia

JAKARTA - Only a few short months since Indonesian President Susilo Bambang Yudhoyono was re-elected with an overwhelming mandate on an anti-corruption platform, protest marches and chants calling for revolution against his government have been heard on the streets of the national capital and other cities.

"Revolution, revolution, revolution to the death!" This rally cry, not heard since the 1998 fall of former dictator Suharto, is being chanted by anti-corruption activists and other protesters over Yudhoyono's alleged involvement in a complex plot to criminally frame two deputy chairmen, Chandra Hamzah and Bibit Samad Rianto, of the country's highly successful and widely respected graft-busting Corruption Eradication Commission (KPK).

The politically explosive allegations were captured in a wiretapped

conversation involving businessman Anggodo Widjojo, police and prosecutors, in which they appeared to plot against the KPK. Widjojo mentioned the police force's top detective, Susno Duadji, and deputy attorney general, Abdul Hakim Ritonga, as supportive of the plot. The conversation was nationally televised during Constitutional Court hearings and widely reported in the local media.

Both Duadji and Ritonga resigned their positions without explanation on Thursday. Under public pressure, Yudhoyono has launched an investigation, led by a group dubbed Team 8, into the allegations, and he has said that officials mentioned in the tapes should be suspended until the inquiry is complete. There are no indications that Yudhoyono intends to temporarily step down over the mounting scandal.

Anggodo allegedly contacted the Attorney General's Office and senior police officials to convince them of trumped up allegations against Chandra and Bibit. Anggodo Widjojo is the brother of fugitive Anggoro Widjojo, who is wanted for fraud and embezzlement and known to be at large in Singapore. Anggodo is heard on the tape to be soliciting "help" from Ketut Sudiharsa, deputy head of the witness protection agency, the LPSK, to protect his brother.

The allegations mark a dramatic turn for Yudhoyono, who was widely perceived as supportive of the country's much lauded anti-corruption drive. To nobody's great surprise, given that transcripts had earlier been leaked to the press, the plot by businessman Anggodo Widjojo to solicit false testimony was now on the record. Yudhoyono was indeed mentioned in the conversations as supporting the conspiracy.

Since its establishment in late 2003, the largely autonomous KPK has been at odds with entrenched forces in the government and bureaucracy. High-ranking officials in the police, Attorney General's Office, central bank and parliament have all been targeted for investigation and prosecution by the KPK, which boasts a 100% conviction rate in the cases it has brought before the special Corruption Court.

The KPK has come under fire from vested interest groups, including in parliament, that have tried to reduce or even eliminate the investigative agency's powers. That has been evident in parliament with the foot-dragging in debating a new Corruption Court bill, which effectively let the court's legal mandate expire. Parliament also bid to redefine the composition of the Corruption Court to dilute the number of ad hoc judges, who, unlike many career judges, have proven to be free from political influence.

But it's the alleged covert attempts to undermine the KPK that have caused the greater furor.

The accusation that KPK chairman Antasari Azhar contracted killers to murder a businessman who was the third corner in a love triangle involving a female golf caddy has come under new scrutiny amid the allegations political forces had aligned to undermine the KPK. Antasari is currently imprisoned and awaiting trial on murder charges.

He implicated and later withdrew accusations of abuse of power and influence peddling against other KPK members, sparking the police and Attorney General's Office to launch investigations. KPK deputy chairmen Chandra Hamzah and Bibit Samad Rianto were initially suspended over the investigations and then detained on October 28. There was immediate public suspicion that the two graft fighters, who have subsequently been released, had been framed. That suspicion was articulated in a vigorous online campaign in favor of the two commissioners (See Facebook people power , Asia Times Online, November 7).

Yudhoyono had been inundated with requests to intervene in the commissioners' defense. Although the KPK is an independent body, it is directly responsible to the president. Yudhoyono, however, in a display of his characteristic reticence, said the legal process must run its course. Protesters have since taken to the streets demanding action from Yudhoyono, who was until recently viewed as a dedicated champion of the anti-corruption drive.

Under mounting popular pressure, the police have temporarily released Chandra and Bibit. Police then detained Anggodo, who had appeared on a television show angrily defending his actions and denying he was trying to frame the two commissioners. Later, in another interview at police headquarters, a somewhat chastened Anggodo apologized to everyone he may have harmed through his wiretapped conversation, including Yudhoyono and deputy attorney general Ritonga.

Within 24 hours of his detention, police released Anggodo without laying charges against him. At first, police continued to stonewall the press while Anggodo secretly exited police headquarters through a back door, but soon began to send out mixed messages. Brigadier General Raja Erisman, National Police Director for Economic Crimes, was quoted as saying, "He is now under our protection."

A police spokesman, Inspector General Nana Sukarna, said, "We don't have enough evidence to name him as a suspect in each one of the six allegations. We can't blame him for his conversation with his friends, for mentioning the president, or for his threat to kill someone, as nothing materialized." He added, "It is the people who spread the recordings that should be blamed."

The news drew an immediate reaction from the hastily appointed Team 8 fact-finding group. A team member, Todung Mulia Lubis, a civil-rights lawyer and chairman of the executive board of Transparency International Indonesia, accused the police of "obstructing justice" and added, "This cannot be tolerated." Team 8 chairman Adnan Buyung Nasution threatened to have the entire team resign as their recommendations had largely been ignored. "What's the point of all our work?" he asked.

Some believe the debacle represents a golden opportunity for Yudhoyono to act decisively in cleaning up the police and Attorney General's Office, long seen among the most corrupt bureaucracies in the country. While much remains murky surrounding the alleged plot, including Yudhoyono's alleged involvement, one thing is certain: the president's once clean-hands image is now in doubt.

The new revelations could further erode Yudhoyono's graft-fighting credentials, and they threaten broadly the once vibrant reform movement he was democratically re-elected to lead.

Indonesians believe many senior officials are corrupt

Ask any Indonesian about corruption and chances are they will tell you that at some point in their lives they have had to deal with it.

Whether it is paying a bribe to get out of a traffic fine or slipping some extra cash to an official at the immigration office, corruption, many here say, is unfortunately a way of life - it is in the culture.

It is a depressing fact, but a reality that Indonesians have become used to.
But now something has changed.

Fed up and frustrated with the levels of graft within the institutions that are charged with the responsibility of protecting them, Indonesians have taken to the streets in what is being called one of the grandest showings of people power since the days of the 1998 Reformasi movement.

At the time thousands of Indonesians came out on the streets of Jakarta to demonstrate against then-President Suharto, demanding that he resign from his post after three decades of authoritarian and often unjust rule.

This time the demonstrations were not so dramatic - but they were effective all the same.

'Court mafia'

Hundreds of Indonesians came out on the streets of Jakarta to protest against what they saw as an outrageous injustice.

Singing songs against the Indonesian police, and in support of the anti-corruption commission, they gathered at the city's main roundabout, chanting for the dismissal of the police chief and officials in the attorney general's office.

The Indonesian public believes that the anti-corruption commission has become a target of the police and the attorney general's office because of its reputation of putting corrupt officials behind bars - even those in high places.

Politicians fear corruption watchdog

Indonesia is often ranked as one of the most corrupt countries in the world by international watchdogs.

The anti-corruption body has received popular support because so many Indonesians are often victims of corruption in their own land - and there is not much they can do to fight back.

When Indonesians realised that one of the few government bodies they actually believed in - the anti corruption commission - was becoming a target of the police and judiciary, they decided they were not having any of it.

Many here respect the KPK, as the powerful corruption watchdog is known, and have little faith in the police or the judiciary - which Indonesians have dubbed the "court mafia".

The sentiments of 20-year-old Budi sum up how many Indonesians feel about these institutions.

"I think the public aren't satisfied with the work of the police," he said.

"Just look at how they behave on the streets. Maybe it's just individual police doing bad things - but if a lot of them do it, then the entire institution is also to blame."
Ika, 29, agrees.

"The image of the police and the prosecutors isn't good amongst Indonesians," she said.

"Many people doubt their honesty. They're involved in many cases, from the streets to those involving institutions and those we read in the newspapers."

Heads roll

This lack of trust in the very forces that are supposed to protect the Indonesian public was reinforced after listening to controversial wire-tapped recordings this week.
Indonesians across the archipelago sat transfixed for hours as the tapes were broadcast on national television.

Discussions on the tapes, allegedly between members of the police, the attorney general's office and a businessman, revealed the speakers were involved in plans to significantly weaken the KPK by framing the powerful agency.

Chief police investigator Susno Duadji was forced to resign

The public demanded that heads must roll - and they did.

Two of the country's most powerful and influential men resigned from their jobs - Abdul Hakim Ritonga, the deputy attorney general and Susno Duadji, the head of the national investigations unit.

Their names were some of those mentioned in the wire-tapped conversations.
In an attempt to calm the public uproar, recently re-elected President Susilo Bambang Yudhoyono vowed to his citizens that clamping down on corruption would be a cornerstone of his 100-day plan.

"I say to the people of Indonesia, who feel like they have become victims of this mafia in the past, or perhaps even now are a victim, to report this," he said in an address to the nation on Thursday night.

"Let's make our system clean."

The Indonesian president encouraged his citizens to work with him in the fight against corruption.

He has introduced a novel method of rooting out rotten officials: there is now a post office box address where Indonesians can send their letters of complaints about any corrupt officials they have come into contact with, and he has promised to respond.

Promises

But political analysts say the president will have to do a lot more than just make promises.

"The president is going to handle this very carefully," said Sunny Tanuwidjaja from the Centre of Strategic and International Studies.

"There will be a big push for reform, but I think its going to be slow. The public wants change and this is an opportunity to make the police institutions more open and transparent.

"It's a big incentive for Yudhoyono to push for true reform in the police. But whether he will do that really depends on his judgement."

A lot is riding on how the Indonesian president handles this case. This is the first crisis of his second term in office - a term that many thought would go smoothly because of his past track record.

Susilo Bambang Yudhoyono was re-elected in July in part because of his vows to clean up corruption in the country.

He now has to show the public who voted him in that he will stay true to his word.

Those taking dirty money are now under new scrutiny

A lawmaker here in Jakarta confided the other day that he no longer admitted what he did for a living.

"If I'm in a taxi," he said, "and the driver asks me what my job is, I tell him I'm a writer."
It was just easier that way, he explained.

"Public opinion now is very bad. If I tell him I'm an MP, I worry he'll get angry or start accusing me of something."

He is probably right to be cautious.

Indonesia's increasing democracy has meant politicians have had to get used to a new level of media scrutiny - from satirical TV shows to live radio phone-ins.

But nothing has battered their image in recent months quite like the country's Corruption Eradication Commission, the KPK.

Shockwaves

Rumours of corruption have hung over parliament for years, but the KPK has done something unheard of before: it has moved in and investigated them.

In the past few months, it has investigated six MPs, and has just cracked open a corruption scandal which could potentially suck in all 53 former members of the parliament's financial commission, including two cabinet ministers.

That has sent a few shockwaves rattling beneath the green turtle shell-like roof of the parliament building.

"The first reaction was hurt and embarrassment," said MP Eva Kusuma. "It was a very impulsive reaction; people felt the commission had gone beyond what was allowed by law."

But it had not. The KPK has widespread rights to tap phones, block accounts, issue travel bans, order suspension from office and take over investigations from the police and prosecutor-general.

Culture of fear

Rights, in fact, that were authorised by parliament itself. The irony is that few MPs thought they themselves would be the target.

Parliamentarians have been implicated in corruption crackdowns

"It's very funny," said Hajriyanto Thohari, a senior member of Golkar, parliament's main faction. "The KPK was created by parliament; its bill was passed by parliament; its members were elected by parliament. And now they're scared of it!"

He estimates around 20% of MPs are guilty of corruption or abusing power. Others put the figure even higher.

But some parliamentarians say the culture of fear is hampering even the innocent; that lawmakers are scared of simply making mistakes, and are less inclined to seek re-election because of the change in climate.

"Most people are very alert now when using the phone," one MP told me. "We have to be careful; we're frightened to discuss even legitimate issues about money. Most people would rather talk about those things in person than on the phone - in case it's misconstrued by the KPK."

New scrutiny

Some academics dismiss this as laughable - an attempt simply to hide a guilty conscience - and many MPs say in fact they welcome the attempt to clean up parliament.

But a new culture of fear seems to be rippling through other institutions too.

Agus Rahardjo, head of procurement at the National Logistics Agency, said people were now more wary of taking on responsibility for projects and less willing to manage tenders because of the new levels of scrutiny.

He said many employees were finding themselves caught between the KPK and superiors or parliamentarians, who were still pressuring them to break the rules.

Corruption is a huge issue for Indonesia. The country is ranked 143 in Transparency International's Corruption Perception Index - that compares to 72 for India and China, 68 for Colombia and 150 for Zimbabwe.

As one long-term resident of Jakarta quipped, corruption does not interfere with the system here; it is the system here.

'Counter-productive'

So what actually happens to that system when you start blowing holes in it?

Some say corruption oiled the wheels of commerce and trade

According to Indonesia's Association of Entrepreneurs, it means it grinds to a halt.
A major crackdown on bribery among customs officials here, it said, had led to severe delays in getting goods in and out of the country. One entrepreneur said shipments that used to take three days to go through now took several weeks.

The Indonesian Chamber of Commerce recently met with the KPK to talk about the problem - a problem KPK deputy commissioner Haryono Umar put down to low salaries.
For many low-paid state employees, he said, bribery was seen as part of their regular income, and without it there was little incentive to work.

But customs officials here were awarded pay rises shortly before the crackdown - and that did not have nearly as much effect as the KPK operation.

Net widens

Many analysts say that there is little point going after a few corruptors without reforming the rest of the system - but that means more transparent procurement processes and computerised systems, as well as better salaries.

Without a total overhaul, they say, high-profile arrests can only go so far.
Even in parliament, one MP said, "bribery is still rampant. The KPK has just scared the mediocre corruptors and made the slick ones slicker."

But this issue is not going away. The lid has been eased off parliament and there are now calls for the KPK to take on other, tougher bastions of perceived corruption - like the government and the Supreme Court.

Some politicians - the speaker of parliament among them - have even begun calling for the death penalty to be applied in serious cases of corruption.

That may be politically savvy posturing, given the mood of the electorate, but it also shows how much pressure is building over this issue - and how big an issue it is.

The KPK, which is seen as one of the few clean institutions in the country, had made the recordings as part of an investigation of Anggoro Widjojo, an Indonesian businessmen, and his brother Anggodo.

In the recordings, Anggodo discusses ways of implicating Chandra and Bibit.

"What should be out is not extortion, but bribery," he tells one person who is not identified by name. In another section, another unidentified man says: "I will kill Chandra once he's detained."

'Reform needed'

The KPK is said to have made many enemies among Indonesia's political and business elite as a result of its success in investigating and charging scores of government officials, members of parliament, business people and central bank officials.

Adnan Buyung Nasution, appointed by Yudhoyono this week to head an investigation of the police handling of the case, said the tapes had "many interesting things from the seemingly central and dominant role of Anggodo, from the police, and other names I need not mention".

"This is not a problem involving several individuals but this is a systemic problem," he told Indonesia's MetroTV.

Nasution said that his team would talk to police and officials from the attorney-general's office who were allegedly speaking or mentioned on the tapes.

JAKARTA, KOMPAS.com - Tim Delapan yang melakukan verifikasi fakta dan proses hukum terkait penahanan dua pimpinan Komisi Pemberantasan Korupsi, yakni Bibit Samad Rianto dan Chandra M Hamzah, mengakui adanya keterkaitan kasus tersebut dengan Bank Century. Oleh sebab itu, Tim Delapan, Kamis (5/11) saat memeriksa Bibit dan Chandra, yang didampingi kuasa hukum Luhut MP Pangaribuan dan penasehat ahli Erry Riyana Hardjapamekas di Gedung Dewan Pertimbangan Presiden (Wantimpres), Jakarta, melakukan pendalaman terhadap kaitan Bank Century.

Demikian anggota Tim Delapan Anies Baswedan, saat ditanya pers, seusai pemeriksaan Bibit dan Chandra. "Ya, Bank Century dibicarakan agak panjang. Kita merasa kasus Bank Century itu terkait sekali dengan persoalan Bibit dan Chandra. Akan tetapi, ini sebatas didalami saja dan belum ada langkah-langkah khusus," ujar Anies.

Menurut Anies, Tim Delapan menanyakan soal penyadapan terhadap Kepala Badan Reserse Kriminal (Bareskrim) Polri Komjen (Pol) Susno Duadji terkait Bank Century dan bagaimana prosesnya. "Jawabannya, ya seperti yang sudah ada di media massa. Itu, kan, sudah lama disebut ada," tambahnya.

Dalam pemberitaan media massa disebutkan Susno diduga terkait dengan penyalahgunaan wewenang dalam pengusutan dana nasabah Bank Century. (Kompas, 7/10). Dikatakan Anies, KPK sebernya tidak bermaksud menyadap Susno. "Yang disadap satu hal, akan tetapi akhirnya tersadap juga hal lain," lanjut Anies.

Saat ditanya soal penyaluran dana ke Budi Sampurna dan lainnya dari Bank Century, Anies mengatakan Tim Delapan tidak dalam konteks menanyakan soal itu.

Sebelumnya, saat mengawali pemeriksaan terhadap Bibit dan Chandra, Ketua Tim Delapan Adnan Buyung Nasution mengatakan dalam pertemuan dengan ketua pimpinan KPK (non aktif) itu, Tim Delapan akan melakukan pengecekan silang terhadap kaitan Susno Duadji dengan Bank Century dan masalah lainnya.

Jakarta - Wakil Ketua MPR Lukman Hakim Saifuddin mendesak Kapolri Jenderal BHD dan Jaksa Agung Hendarman Supandji mengundurkan diri. Langkah ini perlu diambil sebagai bentuk pertanggungjawaban kedua pucuk pimpinan lembaga hukum ini kepada masyarakat.

"Secara etik ini sesuatu yang harus disikapi dengan mengundurkan diri," kata Lukman, menjawab pertanyaan wartawan mengenai status Kapolri dan Jaksa Agung terkait masalah Anggodo, dalam konferensi pers di Gedung DPR, Senayan, Jakarta, Kamis (5/11/2009).

Menurut Lukman, Kapolri dan Jaksa Agung memiliki tanggungjawab yang besar terhadap segala hal yang terjadi di lembaganya. Menjadi berat pertanggungjawaban kepada masyarakat ketika anggota lembaga hukum ini ikut dalam pembicaraan Anggodo.

"Ini tanggungjawab moral kepada masyarakat," kata Lukman.

Mengapa harus sampai Kapolri dan Jaksa Agung dicopot? "Karena rentan, kendalinya sangat besar," jawab politisi PPP ini.

JAKARTA, KOMPAS.com - Dibebaskannya Anggodo Widjojo setelah diperiksa penyidik Polri selama 24 jam, membuat kecewa para anggota Tim Delapan. Anggota Tim Delapan, Amir Syamsuddin menyesalkan mentahnya rekomendasi tim yang tidak dijalankan oleh kepolisian.

"Kalau rekomendasi kita tidak diperhatikan ya apa gunanya. Ya kalau tim ini dihargai seharusnya rekomendasi ini juga dihargai," ujarnya seusai pertemuan dengan pemimpin redaksi media massa, di Hotel Nikko, Jakarta, Rabu (4/11).

Sebelumnya, wacana mundur dari Tim Delapan pun bergulir dari Ketua Tim 8 Adnan Buyung Nasution. Ketika ditemui di tempat yang sama, Amir menegaskan dirinya menyerahkan seluruh keputusan kepada tim. "Pokoknya apa kata abang, kita kompak. Pokoknya kita akan serahkan kepada tim. Dan saya tidak bisa bertindak lain daripada tim," tuturnya.

(Foto: dok detikcom) Jakarta - Tim 8 merasa dilecehkan karena nasihatnya agar Kapolri tak membebaskan Anggodo Widjojo tak dituruti. Tim 8 berpikir untuk mengundurkan diri.

"Iya tentu saja. Karena kita ini kerja percuma. Iya kan? Kita bisa lihat kalau ini kerja percuma. Kalau ini saja tidak bisa dilaksanakan, apalagi yang lebih besar. Itu yang kita rekomendasikan," ujar Ketua Tim 8 Adnan Buyung Nasution ketika ditanya apakah merasa dilecehkan dengan pembebasan Anggodo ini.

Hal itu dikatakan Adnan Buyung usai acara pertemuan Tim 8 dengan pimpinan media massa di Hotel Nikko, Jl MH Thamrin, Jakarta Pusat, Rabu (4/11/2009).

Apakan Tim 8 akan mundur?

"Ya itu kita pikirkan tentunya. Kalau nasihat kita tidak didengar, buat apa kita terus kerja. Kan percuma aja dong, ya nggak? Kita pertimbangkan, saya kecewa berat kalau dilepas," tukas Buyung dengan nada tinggi.

Berarti kerja Tim 8 tidak didengarkan oleh jajaran pemerintahan SBY, beserta jajarannya, termasuk Kapolri dan Menkopolhukam?

"Berarti nasihat kita, pertimbangan kita tidak didengar sama sekali oleh Kapolri dan Menko Polhukam. Dan berarti sudah sampai ke tangan Presiden kan? Buat apa kita kerja terus? Adnan menyampaikan hal itu dalam acara pertemuan pimpinan media massa dengan Tim 8 di Hotel Nikko, Jl MH Thamrin, Jakarta Pusat, Rabu (4/11/2009).

Adnan menyayangkan kekuatan politik yang tidak berbuat apa-apa terkait kasus Bibit dan Chandra ini. Saat masyarakat resah dengan persoalan hukum menyangkut KPK, partai-partai politik justru tidak kedengaran suaranya.

"Something wrong. Institutionally, partai-partai gagal menjalankan aspirasi rakyat atau pemerintahan ini," imbuh pria berambut putih ini.

Tapes of Alleged High-Level Conspiracy Electrify Indonesia

JAKARTA -- Wiretapped telephone conversations played to an Indonesian court and broadcast on national television Tuesday appeared to implicate senior government officials in a high-profile corruption case that has sparked a public uproar.

The tapes offered insight into an open feud between the Corruption Eradication Commission, or KPK, and the national police, which works with prosecutors in the attorney general's office.

The conversations -- as provided and transcribed by the KPK -- appear to feature a number of people, including two senior prosecutors from the attorney general's office, discussing a plot to create a false charge of bribery against two senior KPK investigators in a bid to get the KPK to drop a case against an Indonesian businessman.

The two KPK officials were suspended by President Susilo Bambang Yudhoyono in September, when police named them as suspects in a bribery case.

Police last week arrested the KPK officials, Bibit Samad Rianto and Chandra Hamzah, in connection with the bribery allegations and for allegedly abusing their power while at the KPK. Both men denied the allegations.

On Friday, National Police Chief Bambang Hendarso Danuri defended the arrests, after leaked copies of the phone transcripts indicating the suspects had been framed were reported in the local media.

On Monday, hundreds of people, including student groups and lawyers, protested in downtown Jakarta and in other major cities to demand the pair be freed, saying they had been unfairly targeted by the police.

A Facebook group set up to campaign for their release had reached 590,000 members late Tuesday -- evidence of the popularity of the KPK, which is valued by many Indonesians because of its successes in prosecuting officials and lawmakers for graft.

Transparency International ranks Indonesia as one of the most corrupt countries, and the police as one of its most corrupt institutions -- a view reflected in public-opinion polls.

A police spokesman said Tuesday that the investigation into alleged abuse of powers by the two KPK officials would continue. He said both men would be released to maintain peace "in the interest of the nation."

Some police and lawmakers have complained about the KPK's powers, including wiretapping without a warrant. The battle between the KPK and police escalated in July, when it emerged that a senior policeman had been wiretapped by the KPK.

Mr. Yudhoyono has declined to get involved publicly in the case. On Friday, he said justice should be allowed to take its course and the tapes should be investigated. A spokesman said Mr. Yudhoyono had no further comment Tuesday.

Tuesday's hearing at the Constitutional Court, one of Indonesia's highest courts, was watched intently across Jakarta. The tapes were submitted by lawyers for Messrs. Hamzah and Rianto in a case to determine whether their suspension from the KPK in September was legal.

The tapes were recorded by the KPK as part of its investigation into alleged corruption involving Anggoro Widjojo, a businessman, lawyers said. Mr. Widjojo's whereabouts are unknown and he couldn't be reached to comment. It is unclear if he has legal representation.

In the tapes, according to a KPK transcript, Mr. Widjojo's brother discusses at length a plot to set up the KPK investigators.

In one conversation, dated July 29 in the transcripts, Wisnu Subroto, a former deputy attorney general, and Mr. Widjojo's brother discuss a plan to recruit someone who would testify, falsely, that he gave bribes to the KPK officials. Attempts to reach Messrs. Widjojo and Subroto were unsuccessful.

In a conversation in August, an unidentified male calls another deputy attorney general to set up a meeting with Mr. Widjojo, the suspect's brother.

A spokesman for the attorney general's office was unreachable.

Setelah REFORMASI, sekarang sudah diperbaiki dimana Eksekutif adalah sejajar posisinya dengan dibuatnya pemilihan presiden dan pemilihan anggota dewan di saat yang bersamaan menandakan posisi Legislatif dan Eksekutif adalah sejajar.

Tetapi saat ini perlu ada reformasi lagi yang menegaskan posisi YUDIKATIF harus sejajar dengan Legislatif dan Eksekutif. Yudikatif saat ini letaknya dibawah politikus tunggal yaitu Eksekutif. Hal ini bisa membuat ketidak seimbangan sistem demokrasi di Indonesia.

Hal ini yang membuat sistem dan konstitusi kita selalu tumpul dan tidak seimbang yaitu tidak diletakkannya posisi Hukum (Yudikatif) dan Penegak Hukum pada posisi yang sejajar dengan PILAR DEMOKRASI yang lain yaitu LEGISLATIF dan EKSEKUTIF.

Perlu ada REFORMASI LANJUTAN untuk menegakkan SUPREMASI HUKUM di Indonesia dengan meletakkan HAK INDEPENDENSI YUDIKATIF agar sejajar dengan LEGISLATIF dan EKSEKUTIF.
