Relocation of Children after Divorce and Children's Best Interests: New Evidence and Legal Considerations

State courts have rightly termed relocation cases, in which a custodial parent's desire to move away with the child is opposed by the other parent, one of the knottiest and most disturbing problems courts face. The recent trend is to permit such moves. This trend was encouraged by Judith Wallerstein's influential but controversial amica curiae brief in the California Supreme Court case of Burgess v. Burgess, which argued that allowing such moves is generally in the child's interests because social science evidence shows that in general, what is good for the custodial parent is good for the child. Subsequent papers have challenged Wallerstein's characterization of the social science evidence, but in fact there has been no single study offering direct evidence on this question. The current study, which divides college students whose parents were divorced into groups based upon their parents' moveaway status, sought such direct evidence. We find statistically significant differences favoring children of divorce whose parents did not move, on a variety of outcomes, as reported by the students themselves. These results suggest that the child's interests require separate consideration from that of the custodial parent's in the rules by which such relocation cases are decided.

Back in September, our beloved Brenda left a comment on this foster contractors blog. The foster contractor responded just a couple days ago. I posted a link in the newsgroup, and know that Brenda and a couple others responded.

This person has refused to publish many comments in an effort to hide the truth about why many people become foster parents.

The number 1 reason... For the money.
The number 2 reason... They want your kid of their own.

Those who just want to help are few and far between, but foster parents who suck up to workers and believe every lie a worker tells them and spews the regurgitated bullshit that is nothing more than CPS propaganda and misinformation are many.

This is how they make themselves look good while warehousing children for the states.

Unfortunately, the Division of Youth and Family Services (DYFS) can no longer be trusted to care for children in home care. As a registered and certified school nurse, I have struggled with this agency on numerous occasions, viewing firsthand this poorly managed child-welfare system. Departments are fragmented, and a tremendous lack of supervisory checks and balances exists. Its workforce is inexperienced, with 80 percent of directcare staff (those who work directly with clients, i.e. therapists, psychologists, etc.) having less than five years' experience, and 25 percent of the casework staff (staff members who arrange for client services) are trainees with less than one year of experience. Children are not visited by DYFS workers regularly, sometimes not for months at a time. Physician referrals are made but not enforced, and cases are closed with uninvestigated complaints of abuse. This is in violation of ethical, professional standards of practice, those principles that express values or standards of conduct.
