Patenting Landscape in India

In recent years, India has witnessed rapid changes in its patenting landscape as a result of the growing economic activity and reforms (related to patents). In May 2008, Evalueserve investigated the patenting landscape in India, focusing on the patent applications published over 2005–07. The present study includes data for 2008 and analyses the latest trends and developments in the Indian patent landscape.

Evalueserve has identified the top patent filers at the IPO for the past four years by analysing 112,515 patent applications published by the IPO during the period January 2005 to December 2008.

The top 25 filers list includes 11 corporations from the electronics and telecom domain, and 8 from the pharmaceuticals and chemicals domain. It is interesting to note that Qualcomm has emerged as the top filer for both 2007 and 2008. During the period 2005–08, Qualcomm had 2,068 published applications at the IPO, which constitutes about 63% of its filing with the USPTO and 45% of its PCT filings during the same period. This shows how seriously Qualcomm protects its innovations in India, which is the world’s fastest-growing mobile market, growing at the rate 18% annually . In addition, General Motors, Wockhardt, General Electric, Tata Group, LG Electronics, Research in Motion, 3M, Alcatel-Lucent and Sony Ericsson have significantly improved their rankings. In contrast, the rankings of Philips, Bayer, Microsoft and AstraZeneca have dropped marginally.

I have come across a patent search tool in Xyggy Patent website, which allows you to find the similar patents for a particular patent. For example, let's use the patent number 7,209,620, using the auto complete box, enter the patent #'7209620' and select the patent from list displayed. Here you can select one or more patent either by patent number or title. After selecting the patent from list displayed, you will find the similar/relevant patents to the selected patent. Xyggy Patent finds and ranks patents to how similarity they are with the patent '620.

IP Hall of Fame 2010

Intellectual Asset Management (IAM) magazine is pleased to announce that the nomination process for IP Hall of Fame 2010 inductees is now open.

The IP Hall of Fame was designed by IAM magazine as a not-for-profit exercise that honours individuals from areas such as business, politics, finance, the law, academia, the arts and science and technology who have played a major role in the creation of today's IP system. Inductees into the IP Hall of Fame are selected for the outstanding contribution they have made to the development of IP law and practice, so helping to establish IP as one of the key business assets of the 21^st century.

To nominate those individuals whom you believe should be honoured next year, simply fill in the nomination form and supply a paragraph of between 50 and 100 words to support your nomination. When the nomination process closes on 2nd December, all nominations will be submitted to the members of the IP Hall of Fame Academy. Comprising a mixture of previous IP Hall of Fame inductees and invited thought leaders from the global intellectual property community, the Academy will make the final decision as to whom should be inducted.

The names of the inductees for 2010 will be made public in February 2010. A gala dinner to honour them will be held during the IP Business Congress in Munich, Germany, on 21st June 2010.

The submissions to the Journal are selected for publication on the basis of a peer-review mechanism conducted through an external Article Review Board consisting of academicians and experts in the field of technology law. The Journal is edited by an Editorial Board consisting of students from the National Law School of India University selected on an annual basis through a selection process that tests them on their editing skills and knowledge in the concerned areas of law.

The Journal accepts academic submissions in the form of articles, notes, comments or book reviews on a host of legal issues regarding the interface between law and technology, including e-commerce, cyber crime, biotechnology, bioethics, competition law, outsourcing, intellectual property, related public policy, and law and society issues posed by new technology. The Journal is also oriented towards publishing academic work that considers the aforementioned is sues from a comparative perspective and/or the perspective of the developing world.

The Editorial Board invites submissions for Volume No. 6 of 2010. The Journal follows a rolling submissions policy and the deadline for the forthcoming volume is 15 December 2009.

European patent office has announced today the launch of the patent teaching kit, a collection of teaching materials that can help to promote awareness about patents among university students. Patent teaching kit allows the students to understand the following concept.

Protecting original ideas and inventions has become essential in today's knowledge-based economy. Large corporations, small businesses and start-ups use patents to ensure their ideas cannot be copied and to defend their competitive edge. Universities too are making increasing use of the patent system to safeguard and commercially exploit their research results and to facilitate technology transfers to industry partners.

Anything from 15 to 25 % of all research efforts are in vain because (unbeknown to the developers) the invention has already been patented. Raising awareness of patents and providing information on how to search for existing patents can prevent this from happening.

An awareness of patents, how they work and how they can benefit companies and research institutions is vial for employees in a wide range of industries. Today's students are the engineers, researchers, lawyers, politicians and managers of tomorrow, and it is important they embark on their careers with at least basic knowledge of the patent system.
What is the patent teaching kit?

The patent teaching kit has been created by the European Patent Academy - the education and training arm of the European Patent Office - to help promote awareness of patents among students.

Designed for use by university lecturers, it contains everything you need to provide students with a comprehensive introduction to the patent system, including information on how to file patent applications and search for existing patents.

Whether or not you have previous experience of patents, the kit's ready-made teaching materials will enable you to prepare and deliver a core lecture lasting between one and two hours, as well as three additional sub-modules if required.

The kit has been designed for students of any subject, but will be of particular interest to those studying natural sciences, engineering, law, medicine or business administration. The material assumes no prior knowledge of the subject on the part of either students or teachers.

The patent teaching kit contains PowerPoint presentations, teachers' notes, background information and real-world examples and case studies.

It is made up of two core modules:

* an introduction for students of science, engineering, medicine and business administration, including information on intellectual property rights, basic facts about patents, the essentials of filing for a patent, help deciding whether or not to patent, and a guide to using patents as a source of information.

* an introduction for law students, including information on intellectual property rights,patentability requirements, issues of ownership, disclosure requirements, infringement and litigation and commercialising patents.

World Intellectual Property Organization [WIPO] released report on World Intellectual Property Indicators 2009, in which indicates slow down in the patent filing and grants growth rate.

In 2007, patent filing increased 3.7% compared to a 5.2% increase in the previous year. Despite this slowdown, around 1.85 million applications were filed across the world in 2007. This figures show the early effects of the global economic downturn on patent filing and the available data for 2008 point toward a further slowdown in patent filing.

The majority of patent filing are from residents of developed countries and there is a strong relationship between the patent filings and the level of GDP and investment in research and development. China, Japan and the US are the top three ranked countries in terms of GDP and R&D. In 2007, about 59.2% of world patent filing were filed in these three countries alone. Patent offices of India, Brazil and Mexico, also received a significant number of filings. However, the majority of filing received by these offices originated from non-resident applicants.

The substantial increase in filings by the residents of China and the Republic of Korea over the past few years has reduced the gap between these two countries on the one hand and Japan and the US on the other. In 2007, China and the Republic of Korea had more resident applications per GDP or R&D expenditure than the US.

Indian High Court Rejects Bayer Complaint For Patent Linkage

Indian generics manufacturer Cipla can get marketing approval for its generic cancer treatment Soranib, the Delhi High Court ruled Tuesday, and the Indian drug regulatory authority does not have to check its patent status first. The court this week rejected a complaint by drug multinational Bayer against the Union of India, the Drug Controller General of India and generic drug producer Cipla.
