Title VII of the Civil Rights Code explicitly states that no employer can discriminate on the basis of race, color, national heritage or gender and has been in place for over forty years.</p>
<p>Disparate treatment is outright racial discrimination in employment (also affecting gender and heritage) that violates a persons protected class such as gender or race. Treating one differently on the basis of their appearance has caused litigations that resulted in hefty fines for corporations.</p>
<p>All stages of employment are protected under Title VII, which was given a boost by the US adoption of the Civil Rights Act of 1991, which allows for punitive damages to those who experienced racial discrimination in employment.</p>
<p>Because those of non-Caucasian decent were historically underprivileged in the eyes of the law, in commerce, and public perception, individuals and groups joined forces to eradicate racism from the work place.</p>
<p>Affirmative Action is a key movement in the effort to curb racial discrimination in employment. The idea of Affirmative Action is to extend equal opportunity across all prospective workers and a push for diversity in the US work force. Kennedy is given credit for coining this term in the 1960s, but it was President Lynden Johnson that said it was not just to promote the idea of equality and democracy, but to realize the results of this endeavor.</p>
<p>But the rise of promoting non-whites in the workplace brought an onslaught of reverse racial discrimination in employment. In the 1970s Allan Bakke sued a medical school for refusal to accept him in favor of affirmative action candidates. The court ruled that this indeed projected discrimination on the white Bakke, but upheld the ruling that Affirmative Action was still a legal and useful tool.</p>
<p>Preferential treatment and quotas is the bane of the conservative movement to end such practices. But it is still upheld today, causing many discrepancies in public opinion as well as court cases.</p>
<p>In 1997 Houston voters upheld Affirmative Action when propositioned with a ballot that would eliminate it. And in 1998 both the House and Senate refused to accept amendments that would terminate the Disadvantaged Business Enterprise program as well as use of the policy in higher education admissions procedures.</p>
<p>But in 1998, California banned the use of Affirmative Action in University of California institutions. Proposition 209 in 2006 instigated this reform, as it prohibited the use of race or gender based preferences in education and state government.</p>
<p>Racial discrimination in employment is a complex beast that cannot be solved by initiatives and laws alone. The repercussions of implementing such tactics may actually thwart a companys ability to hire the top talent, as they might be required to hire a lesser employee on the basis of race alone. All of us are equally capable, but we dont all have equal opportunities when society is so fixated on skin color.</p>

When employees choose to represent themselves with the Equal Employment Opportunity Commission and in court, the action is called a pro se case. This translates from Latin into English as self representation. While there are examples of plaintiff pro se won verdict employment discrimination cases, many employees choose to hire representation for a number of reasons.</p>

Discrimination and prejudice stems from eons of cultural ideology in which one nationality or race deems themselves better than another. This is still alive in many facets of our daily lives, and sadly, one of those is in the realm of a necessity to a fruitful life: employment.</p>
<p>Landmark cases on racial discrimination in employment have catapulted our citizens into a state of heightened awareness. The traditional patriarchal view that in some ways recognize white men as the leaders in industry and economy (as well as intellect and ability) is thankfully dwindling due to some brave individuals who fought for the right to equal value and opportunities.</p>
<p>One such example of a landmark case on racial discrimination in employment is that of a group of former Walgreens employees versus their former employer. The US Equal Employment Opportunity Commission found that Walgreens employers had been assigning African Americans to lower performing stores in African American neighborhoods. Further violating Title VII of the Civil Rights Code, Walgreens denied promotions to non-white workers. The ensuing lawsuit against Walgreens resulted in a $20 million settlement.</p>
<p>These landmark cases on racial discrimination in employment can provide an insight into our social paradigms and help to swing the pendulum into a blind society where skin color and dimensions are not used as guidelines for employment or abilities. </p>
<p>In April of 2005, Judge Susan Illston of the US District Court for the Northern District of California deemed Abercrombie and Fitch guilty in racial discrimination against employees. The approved settlement stipulated that the retail chain pay out $40 million in damages to the claimants. As of now, Abercrombie and Fitch are under a consent decree to set benchmarks for hiring those of African American, Latino, or Asian decent as well as women. </p>
<p>The positive repercussions of this landmark case on racial discrimination in employment may indeed spur a more diverse employee base in one of North Americas largest chain clothing stores. But this attention may also only serve to propagate the racial judgments that got them in this predicament in the first place.</p>
<p>Affirmative Action is a byproduct of these landmark cases on racial discrimination in employment. Some revel in the apparent equality that this measure summons, but others lament the requirement to hire on the basis of race and gender as they feel it presents a more invidious hiring approach and deepens resentment between racial groups.</p>
<p>Either way, it seems these landmark cases on racial discrimination in employment are deepening our awareness of workplace diversity as well as the legal implications of who hires whom.</p>

Issues that are covered under the various laws against discrimination in the workplace include equal pay, sexual harassment and pregnancy rights. In this article, we will explore the different facets of gender employment discrimination and what rights women in the workplace have today.</p>
<p>The earliest form of gender employment discrimination was prohibited by the Equal Pay Act of 1963. This act requires that men and women should be given equal pay for equal work in the same place of business. Although the jobs dont have to be identical, they must be substantially equal. It is the content of the job and not the job title that determines whether the jobs are substantially equal. Substantially equal means that the performances of the jobs are equal in skill, including experience, ability, education and training, effort, meaning the amount of physical effort required to perform the job, and responsibility, or the degree of accountability required. The environment must be equal as well. Working conditions should be same, which encompasses the physical surroundings such as the temperature and hazards. The law protecting equal pay for equal work applies only to jobs in the same establishment.</p>
<p>Sexual harassment is another type of gender employment discrimination that is prohibited by law. It should be noted that while women are the most affected by this type of discrimination, men have also been victims of it as well. Sexual harassment can be defined as unwelcome sexual advances, requests for sexual favors or any other verbal or nonverbal or physical conduct of a sexual nature, as defined by Title VII of the Civil Rights Act of 1964. Sexual harassment can happen in any number of circumstances. Some include a scenario where the victim is not a member of the opposite sex, the harasser does not necessarily have to be a direct supervisor, the victim may not be directly harassed but is affected by the offensive conduct, and the harassment does not have to occur with a loss of pay or being discharged. </p>
<p>Another type of gender employment discrimination is pregnancy discrimination. An employer may not refuse to hire a woman because of her pregnancy or a pregnancy-related condition. If a pregnant employee cannot perform her job because of her pregnancy, her employer must treat her like any other employee that is temporarily disabled. If the employer allows temporarily disabled employees to modify their tasks or perform different assignments, he must allow the same for the pregnant employee. Also, pregnant employees must be allowed to work as long as they are able to perform their jobs. If she must be absent from work for pregnancy-related reasons, he may not require that she continue her leave until the birth of the baby. Finally, an employer must hold open a job for an absence related to pregnancy for the same amount of time jobs are held for employees on sick or medical leave. </p>

Employment discrimination on the basis of sexual orientation is now explicitly illegal in eighteen states and the District of Columbia. Six states have also taken measures to combat employment discrimination on the basis of sexual orientation for transgendered people.</p>
<p>Because the US Equal Employment Opportunity Commission did not outright recognize employment discrimination on the basis of sexual orientation alone, several measures have been taken to ensure equality. The Office of Personnel Management, for example, interprets conduct as inclusive of sexual orientation, and thus protects employers from firing employees on this basis alone.</p>
<p>But in 2000, Executive Order 13152 amended the Equal Employment Opportunity Act to include prohibition of employment discrimination based on sexual orientation. This reflects the emerging viewpoint that all people deserve equal treatment, perhaps in part propagated by the 1989 Supreme Court ruling that discrimination on the basis of sex stereotyping violated Title VII of the Civil Rights Act. The case represented a woman, last name Hopkins, who was denied a promotion on the basis that she was not feminine enough. The court awarded Hopkins with $371,000 in damages plus attorneys fees.</p>
<p>Sexual stereotyping is an unfortunate reverberation of archaic gender roles.<br />
This is exhibited in the case of Bruno vs. City of Crown Point. A female interviewee was asked how her spouse would feel about her taking on employment, perhaps insinuating his own belief that it is a womans sole responsibility to tend to children. Thankfully, laws were implemented that sought to divert this negative and irrational ideology from the sphere of public opinion. </p>
<p>This motif of political progress is in full force today to help combat the disease of prejudice in America. Employment discrimination on the basis of sexual orientation is waning  due in large part to the efforts of lawyers and activists who feel they have been denied rights to work because they did not fit in with the expectations of the status quo.</p>
<p>Several cases are cropping up in which gays, lesbians, and transsexuals are suing employers for firing them over their sexual orientation. One such case of this employment discrimination on the basis of sexual orientation involves Jason Reed, a man who claims he was fired for taking an approved bereavement for his partners deceased father. </p>
<p>We have come a long way in our effort to protect all citizens equally, but the fact remains that as long as these anti-discriminatory laws are in effect, we have a long way to go.</p>

The EPA is the Equal Pay Act of 1963 that sought to rectify the gaping wage differences between working adult women and men. Today, there has been some improvement, but women still see only 77 cents to every dollar that the average American male earns.</p>
<p>Title VII of the Civil Rights Act of 1964 added to the arsenal of employment discrimination laws as an effort to prevent hiring on the basis on race, gender, religious affiliation, or national heritage. These fall under protected categories and if violated, the employer can face severe monetary penalties and class-action lawsuits.</p>
<p>The American with Disabilities act was an added entree to the employment discrimination laws platter, providing protection for those with disabilities from receiving harassment or discrimination.</p>
<p>Employment discrimination laws are meant to prevent disparate treatment among employees and prospective hires. The Civil Rights Act of 1991 intended to further fortify the original Title VII amendment by eliminating the claim of business necessity in intentional discrimination acts, clarified disparate acts, and provided for damages to those who suffered employment discrimination on the basis of race, gender, national heritage, and disabilities.</p>
<p>Proponents of Affirmative Action advocate that this practice enables a more diverse and equitable workforce. In some countries, however, affirmative action is illegal as it serves to highlight racial backgrounds and thus promote more racism. Opponents in this country argue that affirmative action only adds to invidious hiring practices, impose limits on the freedom of choice, and sets up racial groups against one another. Richard Epstein elucidates this contention in his book Forbidden Grounds.</p>
<p>Family and medical leave is also protected under employment discrimination laws, and one case shows that an employers irreverence toward this law costs some big bucks. When a former broker for Merrill Lynch filed suit against the agency for wrongful termination, Merrill Lynch set out to make a settlement agreement. The broker was terminated while on leave, and could very well have garnered a six to seven figure reward for this kind of employment discrimination.</p>
<p>But the inequality is equally expressed when it comes time for paternal leave. The Family and Medical Leave Act of 1993 mandates that employers provide 12 weeks of unpaid leave for employees who must take care of children or sick family members, but often this extension applies more readily to female workers than men. Another case of discrimination arises in these cases when it appears evident that social expectations cater to women leaving work to care for children, but scoffs at male workers who petition for paternal leave.</p>
<p>Heavy fines ensue for employers, who disobey employment discrimination laws, but the fact alone remains that as long as these acts are necessary, our society has a long way to go to eradicate discrimination. In some cases, it may actually promote it. Only time will tell how well we achieve equilibrium and equality in employment trends.</p>

			<content:encoded><![CDATA[<p></p><p><img class="alignleft" src="http://www.outofemployment.com/images/thumb1.jpg" alt="Employment Discrimination Law" width="150" height="111" title="Employment Discrimination Law" />Since 1990, the Americans with Disabilities Act has been protecting workers with various types of handicaps. This employment discrimination law guarantees a number of rights to workers with disabilities, not least of which barring employers from discriminating against workers or potential workers with disabilities when it comes to hiring, wages, promotion, hiring or laying off. In this article, we will take a closer look at the employment discrimination law called the Americans with Disabilities Act.</p>
<p>It is important to note that this employment discrimination law does not cover all businesses; in fact, the Americans with Disabilities Act only pertains to companies with 15 or more employees, though local, state and federal offices are included, as well as employment agencies and labor unions.</p>
<p>The Equal Employment Opportunity Commission defines an individual with a disability in the following way:</p>
<ul>
<li> Has a physical or mental impairment that substantially limits one or     more major life activities;</li>
<li>Has a record of such an impairment; or</li>
<li>Is regarded as having such an impairment</li>
</ul>
<p>A qualified worker or applicant with a disability can be defined as one that can perform the duties of the position, with or without reasonable accommodation. Again, the Equal Employment Opportunity Commission tells us that reasonable accommodation can include making existing work spaces which are used by employees accessible and usable to those with disabilities, restructuring jobs, modifying work schedules, reassigning a worker in question to a vacant position, modifying or acquiring equipment, devices, examinations, training materials or policies, and providing qualified interpreters or readers as necessary. It should be clear that employers are not required to make changes that would cause an undue hardship on the operation of the enterprise. Some factors taken into consideration in this case are the size of the business, financial resources or the purpose or physical space of the business. At the same time, the employer does not have to lower his production or quality standards in order to accommodate an employee with a disability.</p>
<p>This employment discrimination law also covers medical examinations and inquiries. This means that employers do not have the right to ask about the nature of the disability, nor the severity or even of its existence. On the other hand, applicants may be asked about their ability to perform certain functions which relate the job in question, and they may be required to perform an exam, but only if all applicants are required to do so. In the same vein, medical exams can only be requested if they are related to the job in question.</p>
<p>Finally, it should be made clear that this employment discrimination law does not cover illegal drug use or alcoholism. Testing for the use of illegal drugs does not fall under the protection of the ADA, and employers may hold those who do use illegal drugs and alcoholics to the same standard as other employees.</p>

The landmark Civil Rights Act of 1964 did away with segregation and ensured working rights for African Americans and included the famous Title VII which prohibits employers to discriminate based on race, sex, religion or national origin. Since that time, a number of employment discrimination cases have made their way to the Supreme Court and have effectively changed how employment discrimination law is practiced today. In this article, well take a look at a few of the employment discrimination cases that were judged by the Supreme Court and have shaped the law as we know it today.</p>
<p>The first of the employment discrimination cases of note, Griggs v. Duke Power Company, dates from 1971 and was an important victory for African Americans. The Court decided that it is unlawful to expect that certain educational requirements be met or to administer intelligence tests that are not related to the job to be filled. In many cases, these requirements or intelligence tests were an underhanded way to exclude African Americans from being considered for employment. </p>
<p>The next of the important employment discrimination cases was an important victory for pregnant teachers  1974s Cleveland Board of Education v. LaFleur. At that time, public school boards had what would be considered archaic rules about at what point pregnant teachers would be forced to take their maternity leave. The Cleveland School Board required that pregnant teachers take unpaid leave five months before the expected childbirth and would not be permitted to return until the semester after the child reached the age of three months. Another school board noted in the case, in Chesterfield County, Virginia, required teachers to take unpaid leave four months and to give notice six months before the birth and would not be eligible for the next school year after the first day of school. The Court recognized that each pregnant teachers case is different and that many are able to continue working through the end of the pregnancy, making these imposed rules by the school boards violations of the pregnant teachers guarantee of due process. </p>
<p>Many of the employment discrimination cases have to do with sexual discrimination. In 1986, the case of Meritor Savings Bank v. Vinson found that a claim of a hostile environment can be considered a form of sexual discrimination. The Oncale v. Sundowner Offshore Serv., Inc. case in 1987 found that same-sex harassment can be considered a form of sexual harassment as covered by Title VII. In 1988, the case of Faragher v. City of Boca Raton found that an employer may be found liable for sexual discrimination caused by a supervisor, but liability will be dependant on the reasonableness of both the employers and the employees conduct.</p>

 Engaging in any act of retaliation against an employee who files a complaint of employment discrimination or takes part in an ongoing investigation about discrimination.<br />
 Making hiring decisions based on stereotypes based on sex, age, religion, color, national origin, disability and so on. To be safe and avoid employment discrimination charges, employers should make hiring, firing and promotion decisions based solely on an employee&#8217;s qualifications and demonstrated performance. Take care with the wording of employment advertisements, as well. These can sometimes be used to prove discrimination claims.<br />
 Making hiring decisions based on a potential employee&#8217;s marriage to someone based on color, race, religion, origin, disability and so on. The potential employee or the employee&#8217;s spouse should not be a factor in hiring, period. This is the best way to avoid a claim of discrimination based on these factors.</p>
<p>Employers that want to protect themselves against claims of discrimination should take measures to ensure fair practices throughout their business structures. Employees should be rewarded or reprimanded solely on their performance and abilities. Never allow other factors to come into play and the chances of a claim being filed are minimized.</p>
<p>Employment discrimination is a very big issue facing employers today. To protect a business, it is best to use the best judgment when hiring, firing or promoting. Creating uniform policies and procedures and ensuring they are followed can go a long way toward this end. Even with the best laid plans, however, complaints are sometimes still filed.</p>
