<p>If you will be convicted for DWI then it will be having far reaching consequences and these can last for many years. For these reasons representing yourself, although an option you are free to take, is not advised as few have succeeded when taking this route. But best thing is that you hire a lawyer by any means so that you can have lesser penalty, particularly if you have previous convictions for DWI offenses.<span id="more-1934"></span></p>
<p>You will have to prove that you cannot afford any lawyer then you will get the right to have a court-appointed lawyer. For that you can request before the trial hearing and judge will appoint someone there (if available). Some states require you to submit detail financial statements to prove that you cannot afford a private lawyer. As a matter of fact private lawyers are having only marginally higher success rate than court appointed lawyers.</p>
<p>The court-appointed lawyer is paid by the state and judge is legally grateful to make this known to the court at the start of the trial. Court will be informed at every stage of the proceedings as to the cost of the legal counsel being paid for by the state. One thing you must that you cannot change a court-appointed lawyer further down if you do not get on with them or you feel they are not properly defending you. Only in one case you can change them if you prove misconduct or malpractice on their part and even then the judge may not agree to a change. If you and your lawyer can’t get on, then you agree with the lawyer for them to petition the court to be relieved and someone else appointed. By the way you can hire a private lawyer anytime if you find that you are having enough financial capacity.</p>
<p>It’s best to have a meeting with private DWI lawyer or different lawyers for discussing your case. Obviously first consultation will be free of charge and there are chances also to negotiate a fee rate with which suits you both. You can do this if court won’t qualify for a court-appointed lawyer if court feels that you do have the financial means to hire someone privately.</p>

<h3>Blood Alcohol Concentration (BAC)</h3>
<p>Any driver in Vermont with blood alcohol level of 0.08 percent or above will be considered “per se intoxicated” under the law. According to this law only this evidence is enough for driver to be convicted for Driving Under the Influence (DUI) or Driving While Intoxicated (DWI).<span id="more-1931"></span></p>
<h3>Zero Tolerance Blood Alcohol Concentration</h3>
<p>Zero tolerance laws in all states mainly focus on drivers not of legal drinking age. Any driver under the age of 21 years in Vermont operating motor vehicle with 0.02 percent blood alcohol content or over will be subject to DUI penalties.</p>
<h3>Enhanced Penalty Blood Alcohol Concentration</h3>
<p>Some states are having severe punishments for those DUI convicted drivers who are having high blood alcohol concentration at time of arrest, which is usually .15 to .20 percent above the legal limit. Enhanced penalty laws are not applicable in Vermont.</p>
<h3>Administrative License Suspension/Revocation Penalties</h3>
<p>These are minimum compulsory penalties imposed on drivers that are having blood alcohol level above 0.08 percent in Vermont, or they are subject to implied consent laws if they refuse to submit to breath, blood, or urine test for blood alcohol level.</p>
<p>These penalties include suspension or revocation (temporarily or permanently) of driver’s license by the Department of Motor Vehicles (DMV). For initial DUI offense in Vermont, the mandatory suspension is 90 days; for the second offense, one year; for third offense, three years.</p>
<h3>Vehicle Confiscation</h3>
<p>Vehicle confiscation penalty temporarily or permanently is a chance in some states usually for repeat offenders. While in Vermont this penalty is not valid one.</p>
<h3>Ignition Interlock</h3>
<p>Ignition interlock is a device which is attached with vehicle of DUI convicted person. It requires the driver to perform breath test before starting the vehicle. This penalty for DUI can be an option in some states; this is not a choice in Vermont.</p>
<h3>Mandatory Alcohol Education and Assessment/Treatment</h3>
<p>Alcohol education and prevention program, alcohol abuse treatment, and appraisal of a person for possible alcohol or drug dependence can be required for DUI offenders in Vermont. Such steps are usually taken instead of sever punishments like incarceration or paying fines.</p>

<h3>Impact of Alcohol on Your Motor Reflexes</h3>
<p>Alcohol effects varies, depending on the person and their tolerance related to their age, weight, and diet. In major cases blood alcohol content of 0.01-0.05% is considered subclinical and it results in normal behavior and slowed reflexes  are same as someone has not slept after a day long.</p>
<p>If you get blood alcohol level of 0.03-0.12% then you are considered in the Euphoria stage that results in a loss of critical judgment, emotional instability and the impairment of general perception, memory and comprehension. In simple words it means that you lose the basic skills which are needed to operate a motor vehicle properly. In other effects you can have drowsiness which is dangerous and everything from visual acuity, to glare recovery, to sense motor coordination can reduce all.</p>
<p>When your blood alcohol level reaches at 0.10%, it means you reach the confusion level which will result in loss of motor control, visual disturbances and dizziness. After this point, you reach dangerous levels of Stupor and even Coma.</p>
<h3>Driving Motor Vehicle While Intoxicated</h3>
<p>You can lose some necessary skills to handle a car when your blood alcohol level is 0.03%, for some people it can be even lower. Even at 0.01% blood alcohol level accident risks are higher. And it gets higher if your blood alcohol level is high. In some states 0.08% blood alcohol content is considered legally drunk while they are well beyond safe driving limits.</p>
<p>There is no doubt that driving a car when drunk is a bad idea. Even a single drink can increase the risk of an accident many times over. So when you will be having 0.08% blood alcohol level which is legal in most of states, the risks are infinitely higher, resulting in potential accidents or even deaths.</p>

<h3>Blood Alcohol Concentration (BAC)</h3>
<p>Any driver with blood alcohol concentration (BAC) 0.08 percent in Utah will be considered “per se intoxicated” under the law. According to this law only this evidence is enough for a driver to be convicted of Driving Under the Influence (DUI) or Driving While Intoxicated (DWI).<span id="more-1913"></span></p>
<h3>Zero Tolerance Blood Alcohol Concentration</h3>
<p>Zero tolerance laws in all states mainly focus on drivers of not legal drinking age. Any driver under the age of 21 years operating any motor vehicle with a 0.02 percent blood alcohol level or above will be subject to DUI penalties.</p>
<h3>Enhanced Penalty Blood Alcohol Concentration</h3>
<p>Some states are having severe punishments for those DUI convicted person who are having high blood alcohol content at the time of arrest; usually that is 0.15 to 0.20 percent above the legal limit. Enhanced penalty laws are not applicable in Utah.</p>
<h3>Administrative License Suspension/Revocation Penalties</h3>
<p>These are minimum mandatory penalties compulsory on drivers with blood alcohol content above 0.08 percent in Utah or they are subject to implied consent laws if they refuse to submit to breath, blood, or urine testing for blood alcohol content.</p>
<p>These penalties include compulsory suspension or revocation (permanently or temporarily) of the driver’s license by the Department of Motor Vehicles (DMV). For initial DUI offense in Utah mandatory suspension is for 90 days; for second offense, one year; for third offense it’s up to three years.</p>
<h3>Vehicle Confiscation</h3>
<p>A vehicle confiscation punishment for DUI offenders temporarily or permanently is a chance in some states, typically for repeat offenders. While in Utah its not valid penalty.</p>
<h3>Ignition Interlock</h3>
<p>Ignition interlock is a device which is attached with the vehicle of DUI offender, so that the driver may perform breath test before starting the vehicle. This penalty for DUI can be valid one in some states; this is not a choice in Utah.</p>
<h3>Mandatory Alcohol Education and Assessment/Treatment</h3>
<p>Alcohol education and prevention program, alcohol abuse treatment, and assessment of a person for possible dependency on alcohol or drugs can be required in Utah. Such steps are often recommended instead of severe punishments like imprisonment and paying fines.</p>

The first definition is that if a driver is intoxicated and had a below normal use of physical or mental faculties because of alcohol, drug, or controlled substance use. If any driver is having blood alcohol concentration (BAC) 0.08 percent or above, the driver will be considered intoxicated according to second definition.</p>

<p>For first DWI/DUI offense driver will face fines up to $2,000, imprisonment from 72 hours to 180 days, and suspension of driving license for 90 days to 1 year. They must also have to take part in alcohol assessment/rehabilitation program.<span id="more-1910"></span> The judge will order between 24-100 hours community service. There is12 hours DWI Education Program which is compulsory for first time DWI offenders.</p>
<p>For second DUI/DWI offense there is fine up to $4,000 plus jail time ranges from 30 days to 1 year, and license suspension will last from 180 days to 2 years. There is 80-200 hours community service which offender must have to serve and also have to complete 32 hours of a DWI Repeat Offender Program.</p>
<p>There are more strict punishments for third DUI/DWI offense. For third offense driver can be fine up to $10,000, 2 to 10 years in jail, and a driver license suspension for 180 days to 2 years.</p>
<p>If any driver under the age of 21 years will be having blood alcohol concentration 0.02 percent or above will be subject to DUI/DWI penalties. He/she will face fine up to $500, 20-40 hours community service, and a 60 days license suspension. The convicted underage driver must have to the alcohol awareness classes also.</p>

<p>Every half an hour DUI accidents cause one death and injure a person in every couple of minutes across United States. Biggest reason behind the criminal deaths across the country is Driving Under the Influence (DUI).<span id="more-1907"></span></p>
<p>Figures show that every year almost 17,000 people become victims of individuals driving under the influence or alcohol or narcotics and die every year. Sad part is that out of these 17,000 almost 2,000 of them are children. Approximately 1.5 million drivers are arrested every year across USA for DUI. Interestingly, this figure is less than 1% of the actual DUI instances while in reality more than 160 million DUI incidents take place every year across the country.</p>
<p>More than 400 children die every year by vehicles driven by drunk drivers. Over 40% deaths are caused by motor accidents due to of driving under the influence of alcohol or drugs. Almost 50 pedestrian children are killed by the DUI drivers.</p>
<p>According to a survey over 75% of the DUI accused individuals are male. Over 50% DUI related accidents and deaths take place on weekends, especially on Saturdays. Most of accidents and fatalities occur between midnight and 4am in morning. DUI drivers cause loss more than $60 billion property every year.</p>

<h3>Blood Alcohol Concentration (BAC)</h3>
<p>If any driver have the blood alcohol concentration (BAC) above than 0.08 percent then he/she will be considered “per se intoxicated” under the law in South Dakota. According to this law only this evidence is enough for a driver to be convicted of Driving Under the Influence (DUI) or Driving While Intoxicated (DWI).<span id="more-1890"></span></p>
<h3>Zero Tolerance Blood Alcohol Concentration</h3>
<p>Zero tolerance laws in all states mainly focus on drivers not of legal drinking age. Any person under the age of 21 years operation motor vehicle with blood alcohol content 0.02 percent or above will be subjected to DUI penalties in South Dakota.</p>
<h3>Enhanced Penalty Blood Alcohol Concentration</h3>

<p>These penalties include suspension or revocation (temporarily or permanently) of the driver’s license by the DMV (Department of Motor Vehicles). For first DUI offense in South Dakota the mandatory suspension is for 90 days; for second offense it’s up to one year; for third offense, its three years.</p>
<h3>Vehicle Confiscation</h3>
<p>In some states vehicle confiscation penalty temporarily or permanently is valid, usually for repeat offenders. While in South Dakota this penalty is not valid.</p>
<h3>Ignition Interlock</h3>
<p>Ignition interlock is a device which is attached with the DUI offender’s vehicle and requires the offender to perform a breath test before starting the vehicle. This penalty for DUI conviction can be applicable in some states but in South Dakota this is not an option.</p>
<h3>Mandatory Alcohol Education and Assessment/Treatment</h3>
<p>Alcohol education and prevention program, alcohol abuse treatment and appraisal of a person for possible drug or alcohol addiction can be required for DUI offenders in South Dakota. Such steps are usually recommended instead of severe punishments like imprisonment or paying fines.</p>

According to DUI laws, DUI is a crime, whether committed on public or private property. So there are chances if a soldier is suspected for DUI then it is possible that military authorities submit the proper information to the DMV (Department of Motor Vehicles). So that they can take a revocation action but this does not happen always.</p>

<p>In other way, a soldier’s DUI offense can be prosecuted in Federal court or State court.<span id="more-1878"></span> If that happened then case will be governed by federal DUI law or State DUI laws. If its prosecuted in Federal court then Federal penalties will be applied in same way. If its prosecuted in State court then Assimilative Crimes Act provides for the adaptation of State laws in Federal jurisdiction. So there are possibilities that a soldier will lose his/her civilian driving license for a DUI offense, if the offense occurs in a civilian place.</p>
