Nursing Homes in California Confront Pharmacists’ Errors - NYTimes.com:

"In reports obtained by The Bay Citizen, the department found that in 18 of the 32 investigations conducted in California nursing homes between May 2010 and June 2011 — 17 of the 32 were in the Bay Area — pharmacists failed to red-flag cases in which residents were inappropriately prescribed powerful antipsychotic medications like Seroquel, a drug used to treat schizophrenia. Pharmacists also overlooked or approved cases in which medications were prescribed at questionable levels or in unsafe combinations that could put patients at risk of seizures, accidents or even death, according to the public health department."

Don't get tripped up.

Many folks are interested in becoming a California Home Medical Device Retailer (HMDR Exemptee.

However, it's easy to miss that the application states some minimum requirements about who is qualified to submit an application.

According to the California Application for Home Medical Device Retailer Exemptee License - New and Renewal form, these are the minimum qualifications:

Education: High school diploma GED or equivalent. Attach copies of any applicable certifications or licenses that you may hold.
On-the-Job Training: Attach copies of current employer's training records listing job-specific training provided and dates completed.
Work Experience: One or more years paid experience, attach dates, name(s) of employer(s), and addresses. Training must have been supervised by a licensed exemptee, Pharmacist-In-Charge or equivalent.
Training Programs: Indicate by yes or no the training you have completed specific to the five topics listed. Attach copies of certificates or transcripts.

Especially watch out for the Work Experience requirement.

This Program licenses all California and Out-of-State facilities and businesses who supply medical devices or durable medical equipment for use in the home to treat acute or chronic illnesses or injuries. There are three distinct licenses issued by the HMDR Program, in-state California firms, out-of-state firms, and (pharmacist) exemptees who are required employees of firms selling prescription, dangerous medical devices as described under California and Federal medical device laws. . . . The following message was recently sent out from the CA Board of Pharmacy.

You'll want to read this very carefully, in the event you might be affected.

Subject: California State Board of Pharmacy Subscriber Alert
Date: Mon Jan 09 10:48:59 PST 2012

Special Alert to Board of Pharmacy licensees whose licenses will expire on January 31or February 1, 2012 – This message will affect both site and individual licenses issued by the board that expire on these dates.

Please be aware that the renewal operations of the Department of Consumer Affairs are delayed about four weeks. This could affect your license status on the board’s website on or after January 31 regarding your license status if you wait to renew your license.

If your license expires on either date and you have not returned your renewal payment yet, please do so as soon as possible and mail to the PO Box Address listed on the renewal notice.

Alternative 1: the Board of Pharmacy will process your renewal if you send the renewal to the board’s office (1625 N. Market, Suite N-219, Sacramento, CA 95834). Please allow at least seven working days for us to renew your license.

Alternative 2: you may walk into the board’s Sacramento Office to renew your license any workday (January 16 is a holiday). The license should reflect the new expiration date within two to three working days.

We are working with the Department of Consumer Affairs to reduce their backlog. We apologize for any inconvenience.

CA Board of Pharmacy:

"I did not receive my renewal notice and my license is coming up for renewal. What do I do?

Approximately six weeks before the expiration date of your license, a renewal application will be mailed to your last known address of record. Licensees are responsible for renewing their licenses even if they do not receive a renewal notice. The board does not send duplicate renewal applications.

If you have not received the renewal notice within 4 weeks of expiration of the license, you may renew your license by submitting a Request for Renewal form. Do not submit a renewal request more than 60 days before the expiration date of the license.

A renewal request form may be viewed and printed by clicking on the appropriate license type below: . . . "

Then here's how to find out what you need to study before you take the exam . . .

First, locate the Candidate Information Booklet (CIB) for the Certified Designated Representative Laws and Rules Examination - click on the DDC-Certified Designated Representative link that's on the web page. CAUTION! - if you try searching for the CIB on the web, be aware that there are several out-of-date versions floating around out there.

Second, in the CIB, go to approximately page 3-4 to learn about the exam "Content" and the law and rules "References" that you're responsible for.

Section 111656.3 starts out with:

"Each home medical device retail facility shall have written policies and procedures related to home medical device handling and, if authorized by the department pursuant to Section 111656.4, the dispensing of prescription devices. Those written policies and procedures shall be adequate to assure compliance with this article and shall include, but not be limited to . . . "

Notice the phrase, " . . . shall have written policies and procedures . . . "
