Gay marriage was declared legal in California by a court ruling in May of 2008, later made illegal in November of 2008 by Proposition 8. The California Supreme Court upheld Proposition 8 in May 2009, but determined gay marriages performed in the months gay marriage was legal will remain valid in California. In August 2010, a federal judge declared Proposition 8 unconstitutional, but the ruling was stayed indefinitely by a US Circuit Court of Appeals.
Since June 1, 2011, Illinois has allowed same-sex civil unions with the same rights as marriage.
Gay marriage has became legal in New Hampshire on January 1, 2010.
Connecticut began recognizing civil unions in 2005, and later recognized gay marriage in 2008. In 2010, all existing civil unions were “upgraded” to marriages.
A bill allowing gay marriage in New York was signed into law on June 24, 2011 and took effect July 24, 2011.
Gay marriage legislation was passed by the legislature and signed by the governor in February 2012. This law will take effect on June 7, 2012, but may be delayed by a voter referendum. In 2007, S5336 created domestic partnerships in Washington.
On March 1, 2012, Maryland's Civil Marriage Protection Act legalized gay marriage. However, the law does not take effect until January 1, 2013 and may be challenged before then with a referendum. Meanwhile, Maryland Family Law still prohibits gay marriage.
Civil unions have been legal in Rhode Island since July 2011. Though gay marriage is not allowed, marriages from other states have been recognized since May 2012.
