What I don't understand is how not being a topnotcher gets in other people's heads...<br /><br /><span id="fullpost">The bar exams results are out and my old friend from high school days passed. Congratulations to him and to all the rest who did as well. I am not sure if he topped the bar exams, and if yes, then it's a good thing. But if not, then it does not matter in the long run actually.<br /><br />Just to note, I have a friend who topped the board exam for Chemistry years ago, yet, sad but true, she still fell victim to the economic recession and job cuts in her company.<br /><br />I just stumbled upon this article about bar exams and topnotchers (<a href="http://www.abs-cbnnews.com/insights/03/31/10/bar-exam-take-it-pass-it-and-move-carlos-osi">Bar Exam: Take It, Pass It and Move On - Carlo Osi</a>). Basically his message is that he wants to tone down the celebration for topnotchers and just celebrate passing the bar exams as it is.<br /><br />I somewhat agree; the bar exams is no joke and I know people (from schools in the province) who take it, and fail year after year. And I think passing any major exam, be it an entrance exam for a prestigious university, o</span><span id="fullpost">r a licensure exam, o</span><span id="fullpost">r an aptitude exam for future employment, is in itself a major achievement.<br /><br />However, why does it matter to somebody that other people are celebrating for their own achievements? Is it classic crab mentality? Or envy of what other people have? Understanding this, I guess, requires a higher level of awareness that I do not have right now. I would like to think that my friends were genuinely happy for me when I celebrated my achievement years ago...<br /><br />How about you guys? Tomas told INQUIRER.net.<br /><br />The results of the first overseas exam held in Hong Kong were released Monday. And only two of 90 examinees of the test held in Hong Kong last December 12 and 13 passed. The two successful examinees are Edgardo De Sesto Estrada and Jorlyn Boyayot Gagatam.<br /><br />Malacanang had instructed the PRC to administer the first overseas Philippine nursing licensure exam in Hong Kong on the requests of Filipino under-board nursing graduates working in the former British crown colony, Sto. Tomas said.<br /><br />Most of those who requested for the Hong Kong exam were not working as nurses there, Sto. Tomas.<br /><br />“(The examinees’) work right now does not totally jibe with the expected competencies of beginning nurse practitioners,” the board member said, explaining the very poor results of the exam.<br /><br />“While PRC through the Board of Nursing prepared well for this maiden exams, the sadly ‘low’ performance may be due to lack of appropriate preparation considering the years of ‘zero’ practice of these nursing graduates,” he added.<br /><br />To raise the passing rate in future overseas licensure exams, Sto. In order to be admitted to the electronics and communications engineering examination, an applicant must, at the time of the filing of his application therefor, establish to the satisfaction of the Board that:<br /><br />He is at least twenty-one years of age;<br />He is a citizen of the Philippines or of a foreign country qualified to take the examination under Section twenty-three of this Act;<br />He is of good moral character;<br /><span id="fullpost">He is a holder of the degree of Bachelor of Science in Electronics and Communications Engineering, or such equivalent engineering course from any school, institute, college, or university recognized by the Government or the State where it is established, after completing a resident collegiate course of not less than four years: Provided, That within three years after the approval of this Act, holders of a certificate of Associate in Electronics and Communications Engineering or any allied engineering course or holder of a valid first class radio telegraphy or radiotelephony commercial operator license with at least five years active practice in electronics, communications, or related fields shall be qualified to take the electronics and communications engineering examination.<br /><br />Educational Qualification / Training / Experience:<br />B.S. in Electronics & Communication Engineering or its equivalent<br /><br /><span style="font-style: italic;">Scope of Examination. </span>The examination for the practice of electronics and communications engineering in the Philippines shall consist of written tests which shall cover such subjects as the Board may prescribe.<br /><br /><span style="font-style: italic;">Ratings in the Examination. </span>To pass the examination, a candidate must obtain an average of seventy percent, with no rating below fifty per cent in any subject: Provided, That an applicant who fails to obtain a passing average but who obtained at least seventy per cent in each of at least one-half of the total subjects given in the examination, may be permitted to take within two years from the date of his examination, another examination on the subjects in which he obtained a grade below seventy percent. Should the examinee fail in the set of subjects repeated in the second examination, he shall be required to take all the subjects in the next examination.<br /><br /><span style="font-style: italic;">Foreign Reciprocity. </span>No foreigner shall be admitted to an examination or registration as electronics and communications engineer under this Act unless he proves in the manner as provided by the Board that, by specific provisions of law, the country, state or province of which he is a citizen, subject, or national admits Filipino citizens to the practice of electronics and communications engineering after an examination on terms of strict and absolute equality with the citizens, subjects, or national of said country, including the unconditional recognition of prerequisite degrees issued by institutions of learning duly recognized by the Government of the Philippines.1<br /><br /><span style="font-style: italic;">Penal Provisions. </span>The following shall be punished by a fine of not less than two thousand pesos nor more than five thousand pesos, or by imprisonment for not less than six months nor more than six years, or both, in the discretion of the Court:<br /><ul><li><span style="font-size:85%;">Any person who shall give any false or fraudulent statement to the Board to obtain a certificate of registration as electronics and communications engineer;</li><li>Any person who shall present or use as his own a certificate of registration issued to another under this Act;</li><li>Any person who shall present or use a revoked or suspended certificate of registration as electronics and communications engineer;</li><li>Any person who shall assume, use, or advertise as electronics and communications engineer, or append to his name, letters, or words tending to convey the impression that he is a registered electronics and communications engineer when in fact he is not duly registered with the Board as such;</li><li>Any electronics and communications engineer, or any person on his behalf, who shall stamp or seal any document with his seal as such after his certificate of registration has expired or has been suspended or revoked;</li><li>Any electronics and communications engineer who shall sign his name, affix his seal, or use any other method of signature on plans, technical descriptions, or other documents prepared by or under another electronics and communications engineerÕs supervision, unless the same is prepared in such manner as to clearly indicate the part or parts of such work actually performed by the former;</li><li>Any person, except the electronics and communications engineer in charge, who shall sign for any branch of the electronics and communications engineering work, or any function or engineering practice not actually performed by him;</li><li>Any person holding a certificate of registration who shall engage in illegal wire-tapping and/or theemployment of electronics devices in Rosauro Calupitan who was appointed Chairman, promulgated the mechanisms for registration and licensing. Serving with Engr. Calupitan were Engrs. Felicito Rey Signo and Rigoberto Espinosa as Members. They were registered on March 24, 1971 as the first three Electronics and Communications Engineers.<br /><br /><span id="fullpost">On August 1971, the Board administered the first ECE licensure examination. After Engr. Calupitan, four (4) other members held the chairmanship of the ECE board: Engr. Felicito Rey Signo (1974-1987), Engr. Leonardo B. Faculan (1987-1989), Engr. Fortunato Q. Perlas (1989-1994), Engr. Felicito Rey Signo (1994-August 21, 1997) and Engr. Alfredo T. Fragante (November 10, 1997-to present).<br /><br />The Board issued the Code of Ethics and Conduct which delineates the specific tasks of ECEs in the practice of their profession and in relation with the State, with clients and employers, with fellow engineers, and to the profession itself.<br /><br />The Electronics and Communications Engineering profession plays a major role in the telecommunications industry. To attempt to injure falsely or maliciously, directly or indirectly, the professional reputation, prospects, or business of another Engineer. To attempt to supplant another Engineer after definite steps have been taken toward his employment To participate in competitive bidding on a price basis to secure a professional engagement. To compete with another Engineer for employment on the basis of professional charges, by reducing his usual charges and in this manner attempting to underbid after being informed of the charges named by another. Later in 1937, another group of civil engineers mostly engaged in private practice formed the Philippine Association of Civil Engineers (PACE).<br /><br /><span id="fullpost">In 1950, the PACE spearheaded the passage of Republic Act No. 544 also known as the “Civil Engineering Law.” This decree made certain the growth and well-being of the profession and came to be known as one of civil engineering’s milestones.<br /><br />Through their consolidated efforts in 1972, the PSCE and PACE merged, resulting to the organization of the Philippine Institute of Civil Engineers (PICE). On December 11, 1973, the PICE was registered with the Philippine Securities and Exchange Commission. Two years later, on August 13, 1975, it was accredited by the Professional Regulation Commission as the duly recognized organization of civil engineers in the Philippines.<br /><br />Committed to the advancement of the knowledge and practice of civil engineering in the Philippines, the PICE organized a Speakers’ Bureau to conduct seminars and symposia in the various fields of the profession. Plans and specifications prepared by, or under the direct supervision of a registered architect shall be stamped with said seal during the life of the registrant’s certificate, and it shall be unlawful for any one to stamp or seal any documents with said seal after the certificate of the registrant named thereon has expired or has been revoked, unless said certificate shall have been renewed or reissued. </li><li>No officer or employee of this Republic, chartered cities; provinces and municipalities, now or hereafter charged with the enforcement of laws, ordinances or regulations relating to the construction or alteration of buildings, shall accept or approve any plans or specifications which have not been prepared and submitted in full accord with all the provisions of this Act. Nor shall any payment be approved by any such officer for any work, the plans and specifications for which have not been so prepared and signed and sealed by the author. </li><li>Signing of plans specifications and other documents. It shall be unlawful for any architect to sign his name, affix his seal, or use any other method of signature on plans, specifications or other documents made under another architect’s supervision, unless the same is made in such manner as to clearly indicate the part or parts of such work actually performed by the former; and it shall be unlawful for any person, except the architect in charge, to sign for any branch of the work, or any function or architectural practice, not actually performed by him. The architect in charge, shall be fully responsible for all plans, specifications, and other documents issued under his seal or authorized signature. The Board shall make all necessary rules and regulations relating to signing and sealing of drawings, specifications, reports, and other documents registered by architects. </li><li>Drawings and specifications duly signed, stamped or sealed, as instruments of service, are the property and documents of the Architect, whether the object for which they are made is executed or not. It shall be unlawful for any person, without the written consent of the architect or author of said documents, to duplicate or to make copies of said documents for use in the repetition of and for other projects or buildings, whether executed partly or in whole. </li></ol><span style="font-style: italic;">Suspension and Revocation of Certificates.</span> - The Board shall have the power, upon notice and hearing, to suspend and revoke any certificate of registration of any registrant for any cause specified in the preceding section, or for the use or perpetration of any fraud or deceit in obtaining a certificate of registration, or for gross negligence or incompetency or for unprofessional or dishonorable conduct; Provided, however, That such action of the Board shall be subject to appeal to the Secretary of Public Works and Communications31 whose decision shall be final. It shall be sufficient ground for the revocation of a certificate issued to a person under this Act for unprofessional or dishonorable conduct, if:<br /><ol><li>He has signed, and affixed or permitted to be signed or affixed his name or seal on any plans, designs, specifications, drawings, technical reports, valuation, estimate, or other similar documents or work not prepared by him, or not executed under his immediate supervision, or </li><li>Has paid money except the regular fees provided for, to secure a certificate of registration; or </li><li>Has falsely impersonated a practitioner, or former practitioner of a like or different name, or has practiced under an assumed, fictitious or corporate name other than that of the registered; </li><li>Has aided or abetted in the practice of architecture any person not duly authorized to practice architecture in the Philippines. </li></ol><span style="font-style: italic;">Corporations Cannot Register.</span>- The practice of architecture is a professional service, admission to which shall be determined upon the basis of individual, personal qualifications. A year after, on December 12, 1974, the United Architects of the Philippines (UAP) was organized as the integrated organization. Its constitution and bylaws were adopted through a joint general meeting of the three organizations on December 10, 1975. The 1,300 members of the three organizations became automatic members of the UAP and during its first year, 700 members officially registered for membership.<br /><br />On March 26, 1975 the UAP registered with the Securities and Exchange Commission and became the first professional organization accredited by PRC with a certificate of accreditation issued on May 12, 1975. That same year, the UAP established its first eight regional chapters and held its first national elections on December 12 with Jose V. Herrera elected as National President.<br /><br />In 1978, the UAP organized the National Conference on Architectural Education which resulted to the endorsement of a ladder-type curriculum for architectural education later adopted by the Ministry of Education and Culture. On March 28, 1981, the UAP initiated the preparation of the “International Code of Ethics on Consulting Services” which was formally adopted by the Architects Regional Council in Asia (ARCASIA) on August 6 of the same year. The UAP also hosted the first and the sixth Asian Congress of Architects in Manila. Provided, That in no case should the rating on any subject be less than sixty-five percent. In the event a candidate obtains the rating of seventy-five percent and above in at least four (4) subjects having a combined weight of eight (8) units as provided for in this Act, he shall receive a conditional credit for the subjects passed; Provided, However, That such candidates shall take an examination in the remaining subjects within two years from the preceding examination; Provided further, That if the candidate fails to obtain at least a general weighted average of seventy-five percent and a rating of at least sixty-five percent in each of the subjects reexamined, he shall be considered as failed in the entire examination.<br /><br />Failing candidates to take refresher course. Any candidate who fails in two complete Certified Public Accountant board examinations shall be disqualified from taking another set of examination unless he submits evidence to the satisfaction of the Board of Accountancy that he has enrolled in and completed at least twenty-four units of subjects given in Certified Public Accountant Examinations.<br /><br />For purposes of this Law, the examinations in which the candidate was conditioned together with the removal examination on the subject in which he failed shall be counted as one complete examination.<br /><br /><span style="font-weight: bold; font-style: italic;">Limitations on the Practice of Public Accountancy.</span> Single practitioners and partnerships for the practice of public accountancy shall be registered certified public accountants in the Philippines: Provided, That from the effectivity of this Act, a certificate of accreditation shall be issued to certified public accountants in public practice only upon showing, in accordance with rules and regulations promulgated by the Board and approved by the Commission, that such registrant has acquired a minimum of three (3) years meaningful experience in any of the areas of public practice including taxation: Provided, further, That this requirement shall not apply to those already granted a certificate of accreditation prior to the effectivity of this Act. Any of the following shall be sufficient ground for proceeding against a Certified Public Accountant:<br /><ul><li>Conviction by a court of competent jurisdiction of any criminal offense involving moral turpitude; </li><li>Immoral or dishonorable conduct; </li><li>Insanity; </li><li>Fraud in the acquisition of the certificate of registration; </li><li>Gross negligence or incompetence in the practice of his profession; </li><li>Addiction to alcoholic beverages or to any habit-forming drugs rendering him incompetent to practice his profession; </li><li>False or extravagant or unethical advertisement wherein other things than his name, profession, limitation of practice, office and home address are mentioned; </li><li>Issuing an accountant’s certificate covering the examination of the client’s accounts without observing the necessary auditing standards; </li><li>Aiding or acting as a dummy of an unqualified or unregistered person to practice accountancy; </li><li>Violation of any provision of this Decree and the rules and regulations promulgated thereunder; </li><li>Conduct discreditable to the accounting profession. </li></ul><span id="fullpost"><span style="font-style: italic;">Administrative Investigation. </span>Within five days after the filing of written charges under oaths, respondent Certified Public Accountant shall be furnished a copy thereof requiring him to answer the same. The administrative investigation shall be conducted by the Board of Accountancy or any of its members as may be designated by the Chairman, or may be conducted by a legal or hearing officer of the Professional Regulation Commission: Provided, however, That the decision shall be promulgated by a majority of the members of the Board.<br /><br />The rules and regulations promulgated by the Professional Regulation Commission pursuant to its rule-making power shall govern the procedure and conduct of administrative investigation before the Board.<br /><br /><span style="font-style: italic;">Criminal Offenses. </span>Any person who shall by himself or in cooperation with another defeat, deceive, or obstruct any person in the matter of his right of examination by the Board of Accountancy, or who shall falsely rate, grade, estimate, or report upon the examination or standing of any person examined by the Board of Accountancy, or shall aid in so doing, or shall make any false representation relative thereto or concerning the person or persons examined or who shall use or furnish any special or secret information for the purpose of improving or injuring the prospects or chances of any person so examined or to be examined or receiving a certificate, shall for each offense be punished with a fine not exceeding five thousand pesos, or by imprisonment for a period not exceeding two years or both.<br /><br />Any person who shall knowingly make any material false statement in his application for examination, or who shall connive at any false statement made in any certificate which may accompany his application, or who shall make any material false statement in any certificate to accompany the application for examination of any person, or who shall impersonate any other person or permit or aid in any manner other persons to impersonate him in connection with any examination or application for examination, or who shall falsely make or forge any certificate in connection with his application, or who shall commit or attempt to commit any fraud, or violate in any manner the provisions of this Decree or any regulations promulgated under the provisions hereof, or aid in so doing, shall be subject to the same penalty as in the preceding paragraph provided.
