[Abahlali] Ashraf Cassiem Speaks at the Brecht Forumin New York City tonight

Hello all, we wanted to let folks know about a speaking event tonight at the Brecht Forum in NYC. Ashraf Cassiem, the chairperson of the Western Cape Anti-Eviction Campaign in South Africa will will be speaking along with Jean Rice, lead organizer from Picture the Homeless in NYC. Ashraf and his organization are part of an alliance with the Shack Dwellers Movement featured in our film Dear Mandela , that is called the Poor People's Alliance. The important and inspired work being done both in the shacks and townships of South Africa as well as on the streets of New York City forms the frontlines in the struggle for a world where every person counts. In South Africa the fight is against immoral evictions being done in the name of development as the Soccer World Cup approaches. Ashraf lives and organizes in the forefront of the fight to stop the forced removal of families to transit camps far outside the city, away from work, schools and health clinics. In New York City the fight is against injustice and stereotypes perpetrated against homeless people as more and more families are foreclosed on and evicted in the midst of the "Great Recession" we are living through. Picture the Homeless has been fighting this fight for 10 years now and tonight offers an opportunity to meet and hear one of their key leaders. We look forward to seeing some of y'all tonight.

South Africa will be on the global stage as host of the 2010 World Cup. Yet, with one of the world's highest rates of economic inequality and social protest, it is likely that the country's glaring contradictions and its militant poor, perhaps more so than the "beautiful game," will be center stage next summer.

For the past nine years, Western Cape Anti-Eviction Campaign has been one of the most prominent organizations of militant poor, fighting against evictions and police brutality as well as for free basic service and quality health care in South Africa's poor and working class communities. As a coordinating body of over 15 community organizations in the Western Cape Province, the AEC has been at the forefront of challenging the neoliberal economic policies have been imposed since the fall of apartheid, recently helping to found the Poor People's Alliance as a national network of poor people's movements.

Please join us for an evening of discussion and solidarity with Ashraf Cassiem, the chairman of the Western Cape Anti-Eviction Campaign, as he calls attention to the problem facing South Africa's poor and draws connections between the struggles being waged in his country and those now being taken up here in the midst of the Great Recession.

I hope this message finds you well. Over the past few month, I have been helping to organize a visit to the U.S. by a South African social movement activist from the Western Cape Anti-Eviction Campaign (www.antieviction.org.za).
South Africa will be on the global stage as host of the 2010 World Cup. Yet, with one of the world's highest rates of economic inequality and social protest, it is likely that the country's glaring contradictions and its militant poor, perhaps more so than the "beautiful game," will be center stage next summer.

This month, one of the Anti-Eviction Campaign's coordinators, Ashraf Cassiem, is going around the U.S., speaking at college campuses and meeting with activist to share information about post-apartheid community struggles, particularly with the forced removals and the resulting protests taking place in the run up to the 2010 World Cup. He is also here to witness the work being done in the U.S. around layoffs, foreclosures, and other issues that have come to the fore with the current recession.

Badil Releases Issue #42 of al-Majdal (Autumn 2009): Nakba Education on the Path of Return

The Badil Resource Center for Palestinian Residency and Refugee Rights
is pleased to announce the publication of issue the Autumn 2009 issue of
al-Majdal (issue #42), titled Nakba Education on the Path of Return. The
issue looks at Nakba education: education in its various forms on the
history, culture, geography and society of Palestine over the past sixty
one years.

The authors in this issue of al-Majdal, are directly involved in the
process of Nakba Education in various places, directing their work at
different communities, and cover various aspects of the topic. Rami
Salameh looks at education in Palestinian elementary and high-school
classrooms and the need to develop the pedagogical methods in
Palestinian Authority schools. Said Barghouti examines the way Israeli
history textbooks over the past forty years have presented the history
of the land to Palestinian students. Dan Walsh examines the way the
“Middle East Conflict” is taught to U.S. high school students,
suggesting that Palestinian poster art can be used to present this topic
in a more accurate and student-empowering way. Also in the U.S., members
of the Palestine Education Project describe their work with students in
Brooklyn to learn about the experience of Palestinians and draw
connections with their own lived experiences. Nidal al-Azza shares his
reflections on teaching Palestinian refugee rights under international
law to Palestinian law students. Also looking at education in the
classroom, Amaya Galili describes How do we say Nakba in Hebrew? a
recently launched resource packet developed by Zochrot in Hebrew for
teachers wishing to engage Jewish-Israeli students about the Nakba.

Other authors focus on Nakba education outside of the classroom. Khaled
al-Azraq, a political prisoner for the past twenty years, tells us how
the Palestinian prisoners' movement has educated its cadre. Mo'ataz
al-Dajani looks at the efforts of al-Jana Center in Lebanon to engage
Palestinian children and youth in the writing of their own history by
engaging with older generations and with their surroundings, while Rich
Wiles describes the educational activities of refugee community centers
in the Bethlehem district.

While the articles in this issue provide a small sample of the forms
that Nakba education can take, the experiences and work described by
these authors offer a useful guide for others engaging in this field.
Sharing and learning from the experiences of others is one of the ways
educators can learn, and this issue of al-Majdal aims to be a
contribution to this shared learning process.

Hindus ask new Sofia mayor to urgently improve Roma plight

Hindus have strongly urged newly elected mayor of Sofia (Bulgaria) Yordanka Fandakova to improve the plight of Roma people residing in Sofia, who are reportedly facing apartheid like conditions.

Rajan Zed, acclaimed Hindu statesman, in a statement in Nevada (USA) today, said that mayor Fandakova should make Roma upliftment her first priority as their maltreatment was a dark stain on the face of Sofia and Bulgaria.

Zed, who is the president of Universal Society of Hinduism, stressed that it was simply immoral to continue staying apathetic and silent spectator ignoring Roma plight, who reportedly regularly faced social exclusion, racism, substandard education, hostility, joblessness, rampant illness, inadequate housing, lower life expectancy, unrest, living on desperate margins, stereotypes, mistrust, rights violations, discrimination, marginalization, appalling living conditions, prejudice, human rights abuse, etc.

Commissioner for Human Rights of Council of Europe Thomas Hammarberg, who recently concluded a three-day visit to Sofia, visited a Roma settlement in the Republika district of Sofia where he assessed the living conditions as inhumane. “No one should live in these conditions in today’s Europe” he declared.

Capital and largest city of Bulgaria, Sofia is the second oldest city in Europe whose roots can be traced back to about 7000 years. Lonely Planet has described Sofia as "city waking up after decades of slumber".

References to Roma people in Europe, who are believed to have their roots in the Indian subcontinent, reportedly went as far back as ninth century AD.

All Charges Dropped Against the Pemary Ridge 13

Abahlali baseMjondolo was unable to secure a lawyer to represent the Pemary Ridge 13 in the Pinetown Magistrate's Court this morning. They were represented by Shamita Naidoo, Chairperson of the Motala Heights Abahlali baseMjondolo branch. She made a vigorous argument against police brutality against shack dwellers in general, and the Pemary Ridge settlement in particular, and showed how the police claim to be victims of the people they brutally and unlawfully assaulted to be entirely ludicrious.

All charges were dropped against the 13.

The police always make their arrests on Fridays or on public holidays as it is difficult to get a lawyer at these times and people can be held (and somtimes assaulted in detention) until the courts reopen. The police are systematically abusing their powers to arrest and detain people as a form of intimidation. They routinely arrest and detain people when they know very well that they have no evidence against them will not be able to go to trial.

The Pemary Ridge community are planning various strategies to hold the police accountable for this attack and to prevent future attacks. The media are encouraged to seriously investigate the systemic unlawful and violent abuse of the poor in general and grassroots activists in particular at the hands of the police.

Police Attack on Pemary Ridge - 11 arrested, at least 15 injured

The attack on Abahlali baseMjondolo continues.

The first van from the Sydenham Police Station arrived at the Pemary Ridge settlement at 8:00 p.m last night. The police officers went to a woman's tuck shop and kicked down the door saying that they were looking for alcohol. At the time, a man was walking by, and the police assaulted him – they struck him, and swore at him. His sister, who saw the attack, screamed in terror. When members of the community gathered around to see what was happening, the police opened fire, and started shooting people at random. Some residents ran to the river to hide fearing a shoot to kill operation. Others assembled at the top of the road, and began burning tires in protest. More police arrived and they attacked the people protesting on the road opening fire several times. They then went from shack to shack kicking down the doors of residents' homes and assaulting people in their homes. People were beaten bloody with fists and batons. Some were also pistol whipped. The police fired several rounds into Philani Zungu's shack.

At least 15 people have been badly injured but we can't give the final figure yet as many people scattered into the bush down by the river and some are too scared to return to the settlement.

11 people were arrested and are being held without charge in the notorious Sydenham Police station where many Abahlali baseMjondolo members, and other poor African people, have been badly assaulted, and at times even tortured, over the years. Most recently the Kennedy Thirteen were severely assaulted in the Sydenham Police Station. Many of the people who have been arrested were visibly injured when they were arrested and community members saw them being beaten further as they were arrested and put in the vans. But the police are denying that they are injured and have denied them medical attention.

The Pemary Ridge Eleven will appear in the Pinetown's Magistrate's court on Monday. It is not yet clear what they will be charged with. Visiting hours at the Sydenham Police station today start at 12:00.

This is the third attack on the Pemary Ridge settlement by the Sydenham Police since the attack on Abahlali baseMjondolo in Kennedy Road. The last two times they came and arrested people for connecting themselves to electricity. This was an attack on the whole community. Before they left the police said "This is a lesson - tell the others."

The total number of people arrested since the attack on Abahlali baseMjondolo began on 26 September 2009 is now 32. There is no democracy for the poor in Durban. In this city if you are a poor person the police are dangerous criminals and you must fear them.

Repatriation Of Maori Human Remains From The UK

Te Papa To Undertake Second Largest Repatriation Of Maori Human Remains From The United Kingdom And Europe

Thirty-three M�ori ancestral remains will be repatriated by Te Papa from five museums and institutions in Wales, Scotland, Sweden and the Republic of Ireland between 16 November and 28 November. The largest repatriation took place in 2007 when 45 kōiwi tangata were repatriated from the United Kingdom.

The institutions are:

o National Museum Wales, Cardiff (Monday 16 November)

o Gothenburg Natural History Museum, Gothenburg, Sweden (Wednesday 18 November)

o Museum of World Culture, Gothenburg, Sweden (Wednesday 18 November)

o Hunterian Museum, Glasgow University, Scotland (Monday 23 November)

o Trinity College Dublin, Republic of Ireland (Wednesday 25 November)

Note: the dates above are Northern Hemisphere dates

The majority of the ancestral being repatriated are köiwi tangata (skeletal remains) and four are toi moko (tattooed preserved heads). The köiwi tangata and toi moko will be welcomed onto Te Papa's marae in a ceremony on Monday 30 November.

'This is both a time for sad reflection on the turbulent journeys these ancestors experienced and, at the same time, a cause for joy and hope as they are returned', said Ms Michelle Hippolite, Te Papa's Acting Chief Executive and Kaihautū.

'On behalf of the Karanga Aotearoa Repatriation Team, I thank the institutions involved for their positive decisions to repatriate and for their support in the repatriation planning', said Ms Hippolite.

Canada seeks to unconstitutionally abolish Algonquin's customary government to avoid honouring agreements and recognizing legitimate leadership

Kitiganik/Rapid Lake, Algonquin Territory /– On Friday, October 30, 2009, Indian Affairs Minister Chuck Strahl sent notice to the Algonquins of Barriere Lake that he will not recognize their legitimate leadership, but instead impose elections on the community in April, 2010 by invoking a section of the Indian Act that would abolish the customary method they use to select their leaders.

The attempt at assimilation would be a violation of Barriere Lake's constitutionally-protected Aboriginal right to their customary system of government.

"The Canadian government doesn't want to deal with our Customary Chief and Council because we are demanding that the federal and Quebec governments implement agreements they signed with us regarding the exploitation of our lands and resources. So rather than recognize me, they want to do away with our customary system of government by which I was selected," says Jean Maurice Matchewan, Customary Chief of Barriere Lake. "And while they are not recognizing our community's legitimate leadership, Quebec has been taking advantage by illegally allowing forestry companies to clear-cut our forests in violation of our Trilateral agreement."

Documents released under court-order indicate the Government of Canada was invested in quashing the precedent-setting Trilateral agreement, signed with Barriere Lake in 1991, and undermining Barriere Lake's legitimate Customary Chief and Council.[1]

Jean Maurice Matchewan was reselected as Customary Chief on June 24, 2009, but the Government of Canada has refused to answer six consecutive letters sent by Barriere Lake's lawyers, the last on Thursday, October 29, requesting that the Government recognize this result. The June leadership selection process was facilitated by Keith Penner, a former Member of Parliament who chaired the Special Parliamentary Committee on Indian Self-Government in 1983 that culminated in the historic Penner Report on Indian First Nations Self-Government. Penner concluded that Matchewan and his Council "followed and adhered to in each and every respect" Barriere Lake's Customary Governance Code and are the "the legitimate and properly constituted leaders," a result which should clear up confusion about the identity of Barriere Lake's legitimate Customary Chief and Council.[2]

At a Federal Court hearing on September 24, 2009, Prothontary Tabib urged the Minister, in light of the new leadership selection, to withdraw his recognition of Casey Ratt, whom the Minister has been dealing with as Chief since March 2008. This could allow the claims to leadership to be resolved through the Courts. Rather than recognize the June leadership selection or take direction from the Courts. Minister Strahl has decided to impose elections on Barriere Lake, alleging the community is "lacking the political will and the governance tools to resolve this matter" of their leadership selection.

"We already have a Customary Governance Code, which would work well if it were not for the internal interference of the Government of Canada. First the Government of Canada recognized and worked with a minority faction which didn't respect our Customary Governance Code, in order to derail our signed agreements. Now that we have the Government backed into a corner because of our legal challenges and the recent leadership selection process, which was documented by credible witnesses, they are trying to win some more time by attacking our customs," says Customary Chief Matchewan.

Section 74 of the Indian Act states that the Minister of Indian Affairs can impose an electoral system on First Nations with customary leadership selection processes. But Barriere Lake’s Customary governance code is recognized and affirmed by Section 35 of the Canadian Constitution, and the Minister is therefore prevented from changing their customary system of government.

Barriere Lake wants Canada and Quebec to uphold signed agreements dating back to the 1991 Trilateral Agreement, a landmark sustainable development and resource co-management agreement praised by the United Nations and the Royal Commission since 2001. Quebec signed a complementary Bilateral Agreement in 1998, but has stalled implementation despite the 2006 recommendations of two former Quebec Cabinet Ministers, Quebec special representative John Ciaccia and Barriere Lake special representative Clifford Lincoln, that the agreement be implemented. The 2006 recommendations include forest plans to harmonize logging operations with the Algonquin's land use and revenue-sharing to give the Algonquins a $1.5 million share of the $100 million in resource revenue that comes out of their territory every year.

The Algonquin Nation Secretariat, a Tribal Council representing three Algonquin communities including Barriere Lake, continues to support Chief Matchewan.

The Advocates and Leaders for Police and Community Trust (ALPACT) dinner at the Ren Cen comes at a time when the FBI has shot down a respected Detroit Muslim leader, Imam Luqman Ameen Abdullah. They have arrested 10 other Muslims on wild charges and media hysteria reminiscent of the Counter Intelligence Program (Cointelpro) that attacked Malcolm X (El Hajj Malik Shabazz), Dr. Martin Luther King, Jr., the Black Panther Party, Angela Davis, the American Indian Movement, Assata Shakur, and others.

CRST voted to boycott Dale’s Sinclair after hearing of the many incidences of abuse and discrimination against CRST members by its owner, Dale Lesmeister.
Among the allegations that led to this resolution are:
*Lesmeister beat Carl Dupris so severely that he required hospitalization. Lesmeister is currently facing charges for this crime.
*Lesmeister pulled handfuls of hair from Jocelyn Chasing Hawk after she was attacked in his business. Charges are pending for this crime.
*Lesmeister forcibly took the keys from Laverna Long, 76, and forced her to walk to her home in the manor (elderly home) to get more money after she accidently over-pumped by a few cents at his station.
*Lesmeister kicked a five-year-old Lakota boy so hard that it broke the skin on the boy’s leg.
*Lesmeister has made repeated derogatory comments about CRST members and has refused to take their checks.

As Lakota people we can join together and refuse to give any more of our money to this business. We have to show this individual that he will be held accountable for his actions.

Results from a report examining the lifestyles of Maori in 150 Nelson and Marlborough households have shocked Maori Party co-leader Tariana Turia and local member Rahui Katene.

The research, involving 187 Maori adults and 135 children, has revealed an inferior quality of care being provided by family doctors.

“A result which really stood out was the finding that while more than 80% of Maori adult had visited a GP in the year of the survey; only 15% were aware that the cholesterol level in their blood was high” said Mrs Turia.

"Despite this, when the study tested these same adults a massive 80% had recommended levels of cholesterol; 13% of these were high risk".

"This is a level of negligence and professional indifference which cause me great concern" said Mrs Turia. "Something is going drastically wrong if GPs are failing to test Maori for cholesterol and insulin resistance as a matter of course – particularly given the high levels of obesity reported in the study".

"I'm very concerned that it appears Maori living in Marlborough and Nelson are not receiving the quality of care we should expect our health system to deliver" said Mrs Katene.

"We are often told that Maori are not accessing the health system – but this report tells us something different. It reports high levels of access to health services from Maori but poor quality of care once they get there".

"I don't find the judgemental attitude of Board Chair, John Moore, at all helpful" said Mrs Katene. "His comments about Maori having enough money to buy cigarettes appears to place all blame for poor health outcomes on Maori themselves, without also recognising the accountability required from family doctors".

"Our people need support to address addictions and to address lifestyle issues, not pointed fingers and blame" ended Mrs Katene.

The report from Massey University's Research Centre for Maori Health and Development found

· Between 33% and 49% of adult Maori tested were insulin-resistant, indicating a risk of diabetes.

Half the adults smoked, including two thirds of mothers, half of these during the first year of their child's life or during pregnancy;
Three-quarters of adult Maori were overweight and at risk of cardiovascular and other diseases

Michigan woman imprisoned by Israel following settler take over of Palestinian home

FOR IMMEDIATE RELEASE

Imprisoned American citizen and Michigan resident Ahlam Mohsen to be deported to the US after being arrested in a Palestinian home taken over by Israeli settlers in Occupied East Jerusalem.

Ahlam was a guest of the al-Kurd family when on the morning of 3 November 2009 Israeli settlers burst in and seized part of the building. Contrary to eyewitness accounts, the police claim the 21- year-old attacked them.

From the Givon prison in Ramle where Ms. Mohsen is currently awaiting deportation she reported that: “The Israeli police were violently pushing an elderly Palestinian woman. So I stepped in front of them. They told me to move and when I refused they started forcefully pushing me. Then they grabbed me and carried me into a police van. While I was waiting at the Israeli Ministry of Interior, the police officers kept telling each other that I was a ‘dirty Arab’ and introducing me as 'Osama Bin Laden’s sister'. One of them, threatened to ‘break my head’. None of the other non- violent demonstrators were targeted; the way they treated me, it’s obvious that I was arrested because I’m of Arab descent.”

The 40 settlers, accompanied by private armed security and Israeli police forces, entered a section of the home, threw out the family’s belongings and locked themselves in.

The take-over came after an appeal submitted by the family's lawyer was rejected by the District Court. In their appeal, the Palestinian family was challenging an earlier court decision that deemed a section of the house illegal and ordered that the keys be given to settlers. The settlers proceeded to enter the house, while the court did not grant them the right to enter the property.

The al-Kurd home was built in 1956. An addition to the house was built 10 years ago, but the family was not allowed to inhabit the section because the municipality refused to grant them a building permit. Visibly unequal laws are used to make it possible for settlers to move into a home where it was declared illegal for Palestinian residents to inhabit. The Israeli authorities exercise their abilities to demolish and evict Palestinian residents, while ignoring building violations from the Israeli population in East Jerusalem.

The al-Kurds have become the fourth Sheikh Jarrah family whose house has been occupied by settlers in the last year. So far, 60 people have been left homeless. In total, 28 families living in the Karm Al- Ja'ouni neighbourhood of Sheikh Jarrah, located directly north of the Old City, face imminent eviction from their homes. Africa Action Applauds U.S. Decision to Lift HIV Travel Ban, Calls for Sustained U.S. leadership on Global Health Ahead of Global Fund Board Meeting

Friday, November 06, 2009 (Washington, DC) – Africa Action congratulates President Obama and the administration’s leadership in lifting the 22-year-old HIV travel and immigration ban in the U.S. Reducing stigma and discrimination associated with HIV is an integral part in the fight against HIV/AIDS and the promotion of human rights internationally.

Ahead of this weekend's 20th Board Meeting of the Global Fund to Fight AIDS, Tuberculosis and Malaria, it is vital that the U.S. fulfill its commitment to fight HIV/AIDS and fully fund The Global Fund to Fight AIDS, Tuberculosis and Malaria.

Last year, the Board approved 94 new grants worth $2.75 billion over two years to support programs fighting the three diseases and it was the largest round in the history of the organization, well over twice the size of any previous round. However, this year the Fund is facing a severe funding gap in the midst of a global financial crisis.

Gerald LeMelle, Executive Director of Africa Action said, "While lifting the travel ban was a positive step forward, President Obama must now sustain his commitment to fight HIV/AIDS and fulfill the U.S. obligation to fully support the Global Fund"

The Global Fund is a public-private partnership; funding grants that are designed to counter AIDS, tuberculosis, and malaria. It has become the main source of finance for global health initiatives. To date, the Global Fund has committed $15 billion in grants to 140 countries, saving approximately 2.5 million people from diseases.

Michael Stulman, Associate Director of Policy and Communications said, "The Global Fund has proved to be a very effective tool in the fight against AIDS, tuberculosis and malaria. Unfortunately, the financial crisis has slowed down donor country's willingness to fill the gap and achieve the goal of universal access to treatment in 2010."

The Global Fund's budget for the fiscal year 2011 calls for approximately $5.25 billion to finance ongoing grants and secure the Round 10 grant cycle. The $5.25 billion request is to satisfy the $2.5 billion needed for grant renewals and the estimated $2.75 billion to fund new proposals in Round 10. Africa Action's updated talking points on the Global Fund to Fight AIDS, Tuberculosis and Malaria calls for the U.S. to contribute its fair share: a minimum of $1.75 billion.

Africa Action highlights an urgent call from over 50 Francophone African civil society organizations, demanding that their political representatives put forward a new resolution to the Board on the following issues:

· To set up an exceptional procedure which would allow countries which were refused from round 8 and 9 to present a new proposal within 4 months so that these countries would avoid going from an emergency health situation to a catastrophe.

· Set up a round 10 in 2010, which would be open to all countries without restrictions.

COMMUNITIES FROM ALL OVER DURBAN WILL BE PROTESTING BECAUSE OF A LACK OF SERVICE DELIVERY FRIDAY 6^TH NOVEMBER

The communities of South Durban and other parts will no longer sit idle while its fundamental rights are compromised. Like other communities, we have rights to decent housing, redevelopment, affordable electricity rates, ownership of long rented and paid for units, affordable rent, proper recreational facilities, a pollution free environment and a right to be listened to when we voice our views. The South Durban community are strongly concerned with the lack of housing delivery for the overcrowded of their community. They are worried with the fact that the flats they presently live are not upgraded and maintained yet the municipality and Provincial Housing wants to transfer to ownership.

ESKOM and the eThekwini municipality has recently as 1^st July2009 increased the electricity and water tariff’s to unaffordable rate and since then we have seen communities deprived of water and lights. Further tariff increases by Eskom will affect the poor and marginalized which will result in an increase in electricity cut offs to their homes.

On 6 November 2009, the South Durban community together with sister organizations and communities will lead a march to the City Hall after which it will proceed to the offices of the provincial housing department to issues memorandums to both these government structures. We will also be sending a letter to the Department of Social Welfare and Development demanding that all pensioners be exempt from paying tax and bank charges. Our list of demands to the provincial and metro governments is the following:

MEMORANDUM OF GRIEVANCES

We the community of Wentworth gathered here today hereby demonstrate our anger and disappointment with the following:

1. The water and electricity bills that are extremely exorbitant thus being unaffordable to the pensioners, the grant earners, the poor and unemployed;

2. The bellicose attitude adapted by the EThekwini Metro council in dealing with the Barracks community and the arrogance that council displayed when it refused to entertain any further discussions regarding the Lansdowne project. Remember that Nigel Gumede told the community to go to hell and threatened to allocate people from outside Wentworth in the Lansdowne project which was intended for the Barracks community;

3. Lack of provision of basic services like:

3.1 Street cleaning

3.2 Cleaning of parks and repair of recreational facilities;

3.3 Refuse removal

4. Threatening to rezone residential land in order to extend pollution

We therefore demand the following:

a) The reduction of water and electricity costs as basic human necessities so as to make it available and affordable to all in line with the provisions of the constitution of the Republic of South Africa, Act No 108 of 1996 as amended from time to time;

b) That there be a meeting between the WDF/Barracks Committee and Metro representative (housing) as a matter of urgency to discuss the Lansdowne Road project further;

c) That we be given written guarantees that basic services shall be provided and that a task team consisting of Metro staff and members nominated by the community be established to monitor the provision of the basic services;

d) That the plan of rezoning the residential land in order to provide Engen with more land be abandoned forthwith

Statement on the Barcelona negotiations for outcomes in Copenhagen

Adopted in Barcelona, 02-06 November 2009

We, Indigenous Peoples, express our profound concern over the lack of political will and commitment of state Parties to conclude the climate change negotiations in Copenhagen with a legally binding agreements on ambitious emission reduction targets.

Indigenous peoples around the world are directly and critically impacted by climate change, and by any outcomes of the current negotiations. Climate change has a range of grave implications for the effective enjoyment of indigenous peoples' human rights, including food sovereignty, health, traditional/ancestral knowledge, rights to our lands, territories and resources, cultural integrity and wellbeing, among others. We have intrinsic contributions towards addressing the climate crisis through our traditional knowledge and customary resource management systems that have proven to be ecologically sustainable. It is then critically important, and a matter of life and death for indigenous peoples that any agreement on climate change must ensure the legal recognition of our human rights and the protection of our traditional knowledge to achieve a just and equitable outcome of the climate change negotiations.

We therefore call on all state parties and the global community to fulfill and respect their current commitments and outcomes from Copenhagen that must include the following:

1. A legally binding outcome in the form of an amendment to the Kyoto Protocol for the further commitment period 2013-2020.

2. A binding aggregate emissions reduction target for developed countries (Annex 1) of 49% below 1990 levels by 2020 and at least 95% by 2050.

3. Recognition that international human rights standards serve as a guide to tackle climate change, underscoring the fundamental, moral and legal obligations to protect and promote the full enjoyment of our human rights including our rights to lands, territories and resources, right to subsistence, food sovereignty, right of traditional knowledge and free, prior and informed consent, among others, as enshrined in the UN Declaration on the Rights of Indigenous Peoples.

4. The full and effective participation of indigenous peoples in all climate change related processes at the global, national and local levels.

5. Ensure the direct financing to and by indigenous peoples and local communities for adaptation and mitigation measures.

6. Establishment of an Expert Group on Indigenous Peoples and Climate Change under the Conference of Parties (COP) of the UNFCCC, and under the Meeting of Parties (MOP) of the Kyoto Protocol, with indigenous expert members and the full and effective participation of indigenous peoples.

The survival of our peoples, the human family and Mother Earth is at stake. State Parties must stop obstructing real solutions. We have only one Mother Earth, and all Parties must fulfill their responsibilities and obligations.

Brantford, Ontario has become "ground zero" in the struggle over Indigenous rights in Ontario. Most of the city is under landclaim, but instead of halting development until the status of the disputed land can be negotiated, Brantford city council is carrying out an aggressive policy of encouraging the criminalization of Six Nations land defenders. Since 2006, when protests in nearby Caledoniaerupted, over 60 people from Six Nations have faced more than 160 criminal charges as they have tried to peacefully stop illegal developments from taking place on their lands.

It is time for allies and supporters of Six Nations to stand up and bring pressure to bear on our governments and institutions in order to demand that they respect and honor the treaties and agreements we have made with Indigenous nations. The Six Nations Solidarity Network - a group made up of non-native activists from communities in and beside the Haldimand tract, is calling all supporters of Six Nations land rights to join us in a peaceful protest on Saturday, Nov 7th 2009, at 1pm in Brantford's Victoria Park (corner of Market St.and Darling St.).

The demonstration will march through Brantford and stop at a variety
of sites including:

* City Hall (where local politicians have criminalized Six Nations land rights through injunctions and arrests)

When they cannot get their way, they are moody and, like children, have the strangest ideas and fancies. [Perkins, John. To the Ends of the Earth. Pantheon. NY. 1981].

The Defenders of the Land, a non-native organization, invited three women from the Akwesasne Peoples Fire to their Ottawa meeting on Saturday, November 1, 2009. About 35 non-native people were there. They walked to the Federal Court Building. A few said some words on the steps. One of the Mohawk women spoke for less than two minutes about the border issue at Akwesasne.

Suddenly about ten RCMP surrounded her, all non-natives. One pushed a cell phone at her and told her Major Turcotte, a non-native Aboriginal liaison officer, wanted to speak to her. Turcotte asked her if she had the permission of the Algonquins to be in Ottawa and that she had to ask Chief Commanda if she could visit the city. Otherwise she had no right to be there. It sounded crazy. She hung up and proceeded to Victoria Island. No non-natives were asked if they had authority to be in Ottawa.

Misinformation! Ottawa is on the south shore of the Ottawa River which is Haudenosaunee Territory. We never gave these squatters permission to be on our territory according to our law and protocol.

Sounds like another ridiculous scheme of CSIS [Canada Secret Intelligence Service] to intimidate, isolate and try to degrade us.

Jaggi Singh of Montreal is involved with the Defenders of the Land. He tried to organize our youth in Kahnawake to prop up their own causes without doing anything for us. MNN stopped associating with him. Singh became aggressive and rude. He acted like one of those heavily financed gatekeepers who pretend to be activists to divert the agenda. Recently allegations were made that cops were intimidating his organizations!!

The bewildered CBSA Canada Border Services Agency thugs have not been on Kawenoke Island [the island formerly known as Cornwall Island] since May 31, 2009. They fled when we didn’t want these foreigners to be armed for war in the middle of our community so they could shoot or bomb us. They fantasize that we will get tired of freedom and peace and go home!

The Mohawks now have a permanent building next to the empty Canada customs check point in the middle of Kawenoke.

The CBSA have set up a temporary shack on the north shore at the foot of the International Bridge. The Bridge tolls that were on Kawenoke Island are now on the bridge, which is utterly foolish and dangerous. If there’s an accident, don’t blame the Mohawks.

Canada must stop their criminality. Their confused border Gestapo have grabbed at least 40 vehicles from selected Mohawks. If we don’t report to them when they decide, they extort a $1,000 bounty without due process. These racist car jackings could be reported to the police and insurance providers as theft.

Another group trying to sabotage the Kaianereh’ko:wa [Great Law] are the Camel Toe Treaty people. Ahab the Arab [the sheik of the burning sand], his partner Fatima of the 7 Veils [without the rings on her fingers or bells on her toes] and some of their followers recently did something interesting. They apparently loaded the cement border marker on St. Regis Road and took it somewhere. Their emotionally charged internet guru and handler, Natasha, must have gushed.

Those turning their backs on the Kaianereh’ko:wa are committing treason [Wampum 58]. They are supposed to be banished from Onowaregeh [Great Turtle Island]. They’re also violating the Two Row Wampum by accepting another law, leaving the canoe and boarding the colonial ship. When will they get on their camels and leave?

[Abahlali] Corruption continues at the N2 Gateway Flats. Residents demand the closure of the HDA!

We are in a crisis here. The HDA replaced Thubelisha, but still, nothing has changed.

As far as crime is concerned there remains many problems. This includes fraudulent activities of staff members who used to work for Thubelisha Homes but are now reporting to the Housing Development Agency (HDA).

One of the problems is that the lights in the corridors outside of our units are being stolen. No response to this has came from the HDA.

Also, on the 9^th of October, a resident named Thabo was hijacked at gunpoint at 23h55 in the evening in his own parking area. The hijackers even stole his closes leaving him naked. What surprised us as residents is that Thabo stays very close to the entrance gate in full view of the Flats' security guards. But guards claim not to have seen the incident. Thabo was not helped by the security guards with the company saying that the HDA is only paying them for access control and not to keep the Flats safe.

As the committee of the N2 Gateway Flats, we approached the senior security guard, Mr. Nobhatyi (073 878 6461) but only to find out that he had already tried to contact the N2 Gateway residents committee. Mr Nobhatyi told us that Bongani Bhele, the HDA caretaker of the N2 Gateway flats, prevented him from meeting with the residents. We also have evidence that Bongani is involved in a number of fraudulent activities here and therefore is trying to prevent residents and the security guards from working together.

We know that the underpaid security guards are not at fault. It is the corrupt people from the HDA who are preventing the security from being accountable to the community.

We have also approached the Langa Police seeking for their intervention. But as you know, they are always short of staff. We could not get much help...or should I say we could not get any help at all.

We approached the HDA directly because of various crime, fraud and mismanagement related issues.

We complained to the HDA about Bongani selling N2 Flats. We complained about people from outside the community being allowed in to kick the doors in and occupy many of the vacant flats. When confronted, these people told us that Bongani Bhele and someone named Eric asked them to pay a security deposit upfront. They claimed that Bongani and Eric would then disappear with the money leaving them without a flat.

The committee has helped one particular lady to write up an affidavit regarding this issue at the local police station. We have copies of her statement to show to anyone who is interested.

The HDA responded to our complaints by saying that there was nothing they could do because they 'did not have a mandate' to intervene. But it is their own people who are causing these problems!

We then approached the Housing MEC who came to meet with us on the 25^th of October. Mr. Figlan, a member of Parliament, accompanied him. But the meeting was not fruitful. He told us that “there is not much we can do. We are tied up as far as the N2 Gateway Pilot Project is concerned”.

Then on the 31^st of October in the early morning, a boy aged 19 was stabbed to death outside his own home while the security guards slept on.

Why must residents die? Who is next?

Why doesn't the government come talk to us so that we can come up with a solution to the problems that they have caused?

Why does the government always say their hands are tied when they are the ones who created the problems in the first place?

The residents of the N2 Gateway Flats are very angry because the government and the HDA have tried to avoid each and every problem with their housing project.

First it was the contractors cutting corners and issuing us with keys that opened everyone else's flats.

Then it was other problems of substandard housing and fraud. The auditor general found these problems. SCOPA found these problems. Even the Geneva based COHRE found these problems.

Now people are being attacked and even killed because the government refuses to work with us and solve the problems that they caused. The HDA is causing more problems and corruption. Its the same as Thubelisha Homes which preceded it. We didn't need Thubelisha and we don't need it the HDA.

Here is our call for government to finally intervene – meaningfully:

We, as the residents of the N2 Gateway Flats can manage our own community. We can create our own form of cooperative governance for our own community. And we can do it without corruption and mismanagement.

Rights groups: UN General Assembly must adopt Goldstone recommendations

On 4 November 2009, the Report of the United Nations Fact Finding Mission on the Gaza Conflict (Goldstone Report) is scheduled to be tabled before the Plenary of the UN General Assembly in New York. Following the Report's endorsement at the Human Rights Council on 21 October 2009, it now falls to the General Assembly to ensure that the Report is endorsed and its recommendations acted upon. The General Assembly must promote and support the primacy of international law in the necessity of ensuring justice and accountability for the war crimes and possible crimes against humanity that characterized Israel's assault on Gaza in December 2008-January 2009.

The Palestinian human rights community fully endorse the Report and urge the General Assembly to adopt each of its recommendations. We are calling for the GA to:

a) fully endorse the Report of the Fact Finding Mission on the Gaza Conflict;

b) urge the Security Council to endorse the Report, and to expeditiously pursue all accountability mechanisms presented therein; and report to the GA on the progress in this matter;

c) demand that credible internal domestic investigations and prosecutions be carried out by the parties to the conflict in accordance with international standards of impartiality, independence, promptness and effectiveness;

d) remain fully appraised of the matter until appropriate action is taken at the domestic or international level in order to ensure justice for victims and accountability for perpetrators;

e) establish an escrow fund for the purpose of compensating the victims of violations of international law committed during Operation Cast Lead;

f) request Switzerland to convene a conference of the High Contracting Parties to the Geneva Conventions to ensure its respect;

g) promote an urgent discussion on the use of munitions such as white phosphorous (as mentioned in the Report), and a moratorium on their use by Israel.

It is no less crucial that over the coming weeks and months, given the statements from several of the Permanent Member States of the Security Council that they will oppose consideration of the Report in that forum, that the issue be pursued by all appropriate international mechanisms and UN Bodies. Should the Security Council fail to ensure accountability as demanded in the Report, and by the victims, the GA should prepare for further action. The focus of the General Assembly and of the Security Council must at all times be on ensuring accountability for the crimes documented in the Goldstone Report.

The Palestinian Authority and Palestine Liberation Organization, as the representatives of the Palestinian people, must also strive to ensure full implementation of the Report. Palestinian advocacy and activism at the General Assembly is crucial in ensuring that lessons are learned from recent experiences which saw international legal obligations sidelined in favor of political expediency.

The international community of States, along with civil society, and the general public must stand firm and united in upholding the conviction that both State and non-state actors must respect international human rights and humanitarian law; that there is no peace and security without justice; and that accountability for violations of international law is fundamental.

MNN Consensual Decision Making Process

MNN. Oct. 31, 2009. The meetings in Kahnawake to set up a justice system are supposedly based on the decision making process of the Rotino’shonni:onwe. [Wampums 5 to 11, Kaianereh’ko:wa]. Our ancestors brought rational thinking to a principle. To keep our identity, we have to be free in body, mind and energy. We have to make up our own mind based on all the facts. There are many similarities in the nature based philosophies of all Ongwehonwe on Onowaregeh [Great Turtle Island] and beyond. These are the basic principles of our decision making process.

GOAL. The decision must be in the best interests of all the people. Consensus does not mean that all agree but that all understand the decision.

NOTE. Whatever ideas are put into the process, the needs and attitudes of each is considered and complements the decision. The individual has a duty to be directly involved, and to bring their ideas into the discussion within their clan. The final decision will be fully satisfactory to some, satisfactory to others and relatively satisfactory to the remainder, and will reflect elements from each group. This is a slow careful process requiring the reaching of a full understanding by each individual and not a decision made by a leader.

WAR CHIEF. Presides over the meeting to make sure that collective rational thought and behavior are followed.

CLANS. The people are divided into three clans: Bear, Wolf and Turtle. Each have 3 chiefs for a total of 9.

ASSISTANT WAR CHIEF. Each clan selects a temporary spokesperson called an Assistant War Chief.

WELL-KEEPER announces the subject for discussion and passes the issue over the Council Fire.

The three clans deliberate.

Then the Assistant War Chief either reports or asks questions or reports a final decision. If the Clans disagree or there is an error or the proceedings are irregular, the Assistant War Chief calls attention to it on behalf of his clan. They once again deliberate.

The issue is then passed by all three clans.

THREE CRITERIA.

When an issue is discussed, the clans consider the short term and long term pros and cons of the issue. Three criteria must be met:

1.PEACE. Does it preserve the peace that is already established?

2.RIGHTEOUSNESS. Is it morally correct? And

3.POWER. Does it preserve the integrity of the nation? What does it do for the present and how does it affect the future seven generations from now?

DURING DELIBERATIONS.
Each must follow the criteria of peace, righteousness and power at all times. Persons are asked throughout the process if they fully understand. If not, the process stops until this is accomplished. One cannot simply be stubborn and refuse to understand as they will be questioned.

Every Person has a responsibility to expand and exercise their minds. The forces of life have given the human being the potential to use the mind to create a better life through peace, power and righteousness.

In the decision-making process:

-all opinions have to be considered;

-all must be completely reasonable;

-all should come with an open mind;

-all must fully understand the other’s viewpoint;

-each participant cannot repeat a position once it has been fully explained and understood;

-if a person does not agree with the views that have been stated, they must fully explain their dissenting views;

-no one can impose their will nor make decisions for another;

-all must understand the viewpoint and agree of their own free will; and

-if there is no consensus, the consensus is to retain the status quo.

The Chiefs and the War Chief who preside over the meeting make sure that the Kaianereh’ko:wa and collective rational thought and behavior are followed.

All human beings are capable of rational thought, which leads to solving even the most difficult problem. The underlying philosophy is that human beings are loving, caring and wish to interact in a positive way. People cannot think clearly when they are in psychological plain, or have feelings of rage or lose hope. The process must bring us from despair to hope. We have to resist being manipulated or having decisions made for us or pacifying us. We all have a responsibility to develop our minds. To think is to create a sane world for the present and future generations, a world safe from the emotional, irrational behavior controlled by fear, hatred, greed, jealousy, suspicion and conflict. The main obstacle to our survival is fear.

We are a distinct nation with our own law, government, people and territory. We have to always assert this.

It has become common knowledge that the government and politicians ignore the poor. Members of the Blikkiesdorp community have been trying to set up a meeting with Mayor Dan Plato for several weeks now regarding the installation of electricity in the area

Our first contact with Dan Plato occurred in May 2009. As has become customary for politicians, he arrived in our area with scores of bodyguards and great words of promise about how he was going to role out electricity in Blikkiesdorp Phase 1 and 2 by August 2009. As has also become customary with politicians, these words were a lie. Today, we are still standing without any electricity. In the mean time three shacks in Blikkiesdorp have burnt down because people have to continue to use paraffin for cooking. During these fires, sadly two people were injured. Added to this, at a public meeting, one community member also recounted how she is incurring serious health problems as she can’t refrigerate her insulin, which she needs to control her diabetes. So we continue to suffer.

Up until now we have tried to give Dan Plato the benefit of the doubt. We have continuously tried to make follow up appointments with Dan Plato about his promise to provide electricity. In September 2009, we contacted him to remind him of his promise and call him to a meeting. His curt response was that he was due to go on an overseas trip, but that he would make sure to set time aside for a meeting with us after the 15th of September 2009. Sadly, this promised meeting never happened as again his words turned out to be hot air.

This morning, 2nd of November, we once again contacted Plato to remind him of his promises. Again we asked for a meeting to discuss the issue of rolling out electricity in our area. This time round Dan Plato simply refused to meet with us. Sadly, this is yet another instance of the poor simply being brushed aside by politicians. First they dump us in Blikkiesdorp and then they ignore our outcries – ‘democracy’ South African style! So while Dan refuses to see us, shacks carry on burning and the sick become sicker. Clearly, Dan Plato doesn’t care - his plush Mayoral House, and the houses of the rich who he actually serves, have electricity!

Since Dan was not willing to help us we thought we would go straight to Eskom. Eskom was no more helpful than Dan. Eskom told us that the electricity poles, minus the electricity, that have been installed have been installed in the wrong places. They said these poles will have to be removed and maybe if we are lucky we will get electricity in 2010!. Are we actually to believe this?

We will not be ignored. We will also continue to contact Dan Plato and Eskom until we have our electricity. We call on all social movements, NGOs and unions to assist us by also contacting Dan at mayor.mayor@capetown.gov.za and Eskom at jacob.maroga@eskom.co.za. Power to the people in more ways than one!
